Re: JP rules - HTA172 violates the charter

TC, with your expertise, would you say that if s. 172 is declared strict liability, this would help void the ability to impound a vehicle upfront? I'm somewhat guessing as I have a layman's understanding.

Re: Left Turn (Bathurst & Eglinton)

Yeah, definitely want to know what section you were charged under. I don't know of any "signal" except for the traffic lights at Eglinton and Bathurst. The only other ones I can think of are the pedestrian crossing lights further east on Eglinton. Probably worth fighting, at least from the outset. Sign violations in the city of Toronto where turns ...

Re: JP rules - HTA172 violates the charter

The vehicle impoundment part will be removed, but the 7 day suspension will stand.

Gazing into my squash ball... it seems to show... that hwybear is right.

Probably also the "absolute liability" offences that are under O.Reg 455/07 will be re-categorized, or it may be that the gov't takes the lazy way and simply removes them from being under s ...

Re: JP rules - HTA172 violates the charter

Scary isn't it.The speeding laws do not violate the charter. Yes, if you forget to read section 33 this is a violation of our rights, but because of how the charter itself is written there is nothing wrong with this.

Negative. The government has to invoke the Notwithstanding Clause in the legislation in order for it to withstand a court ...

should i let this slide till the trial and rack up an adjournment if they try and give the discosure at the trial?

Make another disclosure request, but make sure it is in writing either via fax or certified mail. If they still fail to give you disclosure, 15 days in advance of your new trial date, file a motion for a stay based on no ...

Re: ticket for yellow light, cop didnt show

Not sure about appealing. There may be a chance to quash on unreasonable delay of trial, but I can't say for sure at this point. How long ago did you request the trial? Was it January of this year?

If they try to corner you and tell you that they're moving the date again, politely tell them "no you're not," and then strenuously object to the JP ...

Re: Is this charge too heavy for me?

How much damage was done? A fender-bender bump with no injuries where you were otherwise driving somewhat normally does not qualify for a careless driving conviction. To use some technical jargon, careless driving requires a large departure from the standard of driving of a reasonable and prudent driver. The courts have ruled that momentary ...

Re: Zero Tolerance for 1st 5 years of driving...

I think it's mostly to do with all this population growth.

Could be also due to shifting attitudes toward drinking and driving. "One for the road" used to be a literal expression, people would grab a beer and drink it as they drove to their destination. Now we shake our heads at the gall of someone who would stop in traffic, look over at the cop ...
