"Bilingual Defence" - Where it can be used

One of the most frequent tickets we get asked about on this forum is "Disobey Sign" of some sort. In many parts of Ontario, if the sign is not bilingual, there is a possibility that it may be challenged as invalid. This is because of O.Reg 615 (which sets the standard for road signs) requiring bilingual signs in a designated bilingual area, which ...

Re: So just how many deaths ARE acceptable??

There's no numerical answer, particularly since our population is growing. Ontario has the lowest fatality rate per vehicle-kilometre in North America. We had this before bill 203, before the change to the drunk-driving laws, etc. Our injury and collision rates are high thanks to the GTA, but most of that is because of idiotic driving.

The 12 ...

Re: So many questions...HELP!

Although the officer specifically said "Speeding" on the ticket, he didn't say by how much. It's pretty close to a "fatal error," so you should be able to use it to fight the ticket. The reason being, a missing offence is a fatal error which should void the document. It seems like he meant to reduce it to 70 in a 50 zone. Without the speed, you ...

Re: Interpretation of reasonable inspection upon the demand

In our area, we have officers threatened on the highway, threatening notes left on garbage bags in a uturn, homemade steel spike belts placed in uturns and threatening phone calls.

Holy s***. Where do people come up with this sort of stuff? To go so far as to booby-trap a U-turn bay is just whacko. :shock ...

Re: Disobey Stop Sign/Fail to Stop-Back to Court on Same Ticket?

When did you make your first disclosure request? The Crown is under no obligation to make any disclosure until it is first requested by the defendant. If it was at the five-week mark prior to the trial date (which is the impression I got), that might not be sufficient time for the Crown to put it together and the JP may not grant a stay or quash it ...

Re: MPP (PC Leader Candidate) wants speed limit Increased

I found this 2003 report for the BC Ministry of Transportation in regards to changes in the speed limit (mostly increases). It's an interresting read.

Definitely an interesting read...

Here's a pilot project Ontario could try: Eventually, the Trans-Canada (hwy 17 here) will be twinned across the province. Outside of the cities, between Pembroke ...

Re: Advice yellow plate cover ticket

There are a couple of ways of getting it reduced or dropped. If the 407ETR can read the plates, I still think a ticket for a yellow tinted plate covering is a little overboard... but that's just my opinion. (Doesn't mean my opinion works in court.) What police service did the officer belong to? Some are more likely to show up for trial than others ...

Re: MPP (PC Leader Candidate) wants speed limit Increased

A couple of c-notes each should make them reconsider the b.s. Also, the ones who took their kids there could get in hot water for child endangerment. So we have laws to cover what they did. We don''t need laws against free speech or peaceful assembly as that was not what the terrorist-supporter scum was doing in the first place.

Agreed. In ...

Re: Advice yellow plate cover ticket

All i know is that i got a ticket for 110 dollar section 13(1) higway traffic act.And it said confused identity of the plate.

So he ticketed you for driving with an obscured plate... however... section 13 (1) of the Highway Traffic Act reads:

13. (1) No number other than that upon the number plate furnished by the Ministry shall be exposed ...

Re: MPP (PC Leader Candidate) wants speed limit Increased

ALot of roads in texas will have posted limits of80-85 mph.

Fastest limit in Texas is 80 mph. Texas DPS (aka the Texas Rangers) and the Sheriff's Deputies don't have much of a tolerance, either. "I cot yew unner dat ovvapass dun 84 mile an awr. I'm goan hafta rat yew a tiggit."

I believe that the speed limit increase would do nothing more ...

Re: MULTIPLE TICKETS big fine

You may also be able to talk to the Prosecutor about offering to plead guilty to some of the infractions in exchange for dropping others. For example: Could offer to plead guilty to 30 km/h over speed limit plus fail to remain in lane in exchange for dropping the insurance & registration, or maybe 40 over in exchange for dropping all others ...
