Re: HTA 144(15): Amber Light - Fail To Stop
Amber Light - Fail to Stop is not too hard to beat in Toronto. Basically the Crown has to prove that you either did not stop for an amber light when you could have done so safely, or that upon being unable to stop, you did not proceed with caution. "Speeding up" would be failing to proceed with caution. Perhaps maintaining your speed would be ...

Some answers:
- Vehicle description does not need to be included. The only things that must be on the ticket are the date, the offence, the name of the defendant, the location (does not have to be pinpoint-specific, e.g. Bloor Street is good enough) and the signature of the officer. Everything else can be added or amended at trial.

I was also confused over that one because I've seen the bilingual defence argument used in court (was in January). Officer's testimony was lengthy, precise and exacting. Defendant's only response was: Sign is not bilingual so it's not valid, and I have photos. JP asks to see photos, asks for closing arguments, then quashes the charge. So I've seen ...

No you're not. They'll post the names and times of the cases they're hearing (R. v. r0sst3r, for example) outside each court room. Just ask them where the provincial offences courts are located and you can find your room by looking at the dockets. Takes a little longer but it's no big deal. Eventually you'll find a docket with your name on it, just ...

Just to clarify, did the officer reduce it to 49 km/h over from a higher speed or did he catch you at 49 over? Just asking. As for the disclosure request, ask for the evidence that liveontheedge suggested. Remember one of the objectives with disclosure is actually not to get it (or part of it), because then you can file a motion for a stay.

I guess this begs the question regarding some of the speed trap operations you see. The officers will run out in front of a speeding car to flag it over, then they immediately approach the driver. Why step in front of a speeding car? You don't know anything about the driver. And then to immediately approach the vehicle without first checking to see ...

The HOV lanes are weird. They're great when traffic is stop-and-go but during most periods of time they're just about useless. People get in them and drive 90 km/h or over 140. On the 404, people are constantly crossing the "do not cross" line because of slower-moving traffic in the HOV that they're trying to get around.
