Re: HTA 144(15): Amber Light - Fail To Stop
Amber Light - Fail to Stop is not too hard to beat in Toronto. Basically the Crown has to prove that you either did not stop for an amber light when you could have done so safely, or that upon being unable to stop, you did not proceed with caution. "Speeding up" would be failing to proceed with caution. Perhaps maintaining your speed would be ...

Hmm... that's interesting.
- photo must be available on CD and in a "RAW" format, raw format prevents altering of a photo with a photo editing program
Will add that to the "checklist." :D
Only issues I've seen here in T-dot are:
- Photo is trying to show sign/view was "obscured" by something other than a building or permanent fixture ...

Re: Speeding 85km/h in 50 reduced to 64km
Some answers:
- Vehicle description does not need to be included. The only things that must be on the ticket are the date, the offence, the name of the defendant, the location (does not have to be pinpoint-specific, e.g. Bloor Street is good enough) and the signature of the officer. Everything else can be added or amended at trial.

Glad we have a prosecutor that is on the ball....makes all photos by defendants inadmissable!! Excellent work!

1. Impaired driving
2. Fail to give way/get out of the way of emergency vehicles
3. Fail to keep right except to pass
4. People talking on cellphone/texting while driving
5. Follow too close
Those are the top 5, but by no means the only pet peeves I have.

Just to go back to rbee's original photograph... it did show that several vehicles were making a left turn as you turned right, correct? Can you tell if more than one vehicle turning left went through the red in that photograph?

Re: proceed contrary to sign at intersection 144(9)...2009
I was also confused over that one because I've seen the bilingual defence argument used in court (was in January). Officer's testimony was lengthy, precise and exacting. Defendant's only response was: Sign is not bilingual so it's not valid, and I have photos. JP asks to see photos, asks for closing arguments, then quashes the charge. So I've seen ...

Yeah, Mississauga and Brampton don't let the grass grow under their feet on many different levels... Toronto is the opposite... on many... yeah that's what we get for voting in David Miller.
Anyway you've got a good chance of beating this at trial. You didn't commit the offence as charged. You've got a good diagram of what you did. Back it ...

Re: State Trooper Loses it On Parademic Ambulance Driver!
Here's the full-length dashcam video from the State Trooper. (There's a 30-second advertisement at the beginning):

Looking at it closely, the ambulance was only in the way for a few seconds. It did pull over. The reason it didn't pull over initially was because there was a ...

Re: State Trooper Loses it On Parademic Ambulance Driver!
Good grief. The ambulance did yield in the video (not sure how long it took), but he was transporting a patient. Not sure about the gesture, but seriously, grabbing the paramedic by the throat?! Getting into a verbal shouting match at the roadside?!

Re: Improperly Passing a Streetcar
No you're not. They'll post the names and times of the cases they're hearing (R. v. r0sst3r, for example) outside each court room. Just ask them where the provincial offences courts are located and you can find your room by looking at the dockets. Takes a little longer but it's no big deal. Eventually you'll find a docket with your name on it, just ...

So it is not an actual calibrated something or other that makes this test independent.
Correct. Independent calibration is done by an avionics technician, but that's required usually every year or so, depending on the unit.
After you have done a self test, you basically rely on an object that you can see at a unknown distance (haven't seen a ...

Can I ask for the notes or any documents that the officer made regarding this incident?
Yes. Your uncle has the right to request disclosure of all of the evidence against him, including things like the officer's notes and even "will say" statements from witnesses, etc. There is no harm in pleading not guilty. Even if he gets convicted, the ...
