The French Language Service Act (FLSA) requires all services and procedures to be in both languages. It applies to ALL communications. If the part of the certificate or notice of offence that the cop fills in is not in both languages it doesn't pass the smell test.
Unfortunately the courts in Ottawa have rejected that as a valid defence ...

Re: Going 50km over in an 80
Lawman: To you, thank you aswell for clearing the car impound situation up. So, is this what they do, even for 50kpm over the speed limit? Charge 9.75 approx. for each kilometer you were doing over the speed limit?

Re: Going 50km over in an 80
Did he hand you a ticket or notice indicating what you were charged with? To try to explain this, there are two things that can be used to charge drivers going 50 km/h or more over the speed limit. One of them is section 172, which is street racing/stunt driving. This is where they impound your car and take your license on the spot for 7 days ...

Re: Another "Damn Street Racer" busted!
Now if "discretion" includes charging for 50 km/h over under Section 128 instead, then I would agree with it - both charges would match the circumstances, and I know of nothing that states the more severe penalty should apply.
S. 128 would have worked in these circumstances and I don't think most of us would've had any problem with the officer ...

Re: Reporting hit-and-run
That's a pretty good dent. Your insurer no doubt found you 0% at fault. Now I'm really hoping that they catch him, because with more hit-and-run claims, insurance premiums increase for everyone in the region where it occurred.
Like we're not already paying high insurance premiums here!!

I agree with cruzmisl. No one was protected or safeguarded by seizing that vehicle. 49 km/h over has serious enough consequences.

Re: 30 over i need help he said he hade me on radar he was going
Going back to the topic at hand here... yes, it is. A lot of police cars have forward and rearward-looking radar installed. You could pay a paralegal to fight this one or try to plea-bargain for something less, such as 95 km/h in an 80 km/h zone, to save demerit points.firegoblin wrote:is radar accuret wile a police car is in moshion ????

Yes. Make it look, to the Prosecutor, like you're ready to fight all the way... then plea-bargain. I'd imagine that they'd offer you something appealing.martron wrote:So would a good process be:
1) get the court date
2) request disclosure materials
3) find out who the prosecutor is
4) call and bargain

The fact that the steering wheel was cranked all the way over, unable to stop, car had ABS, all points to hydroplaning.

Re: Cop suspended with Pay, HTA 172
Aha, we got you RI! You are a pilot! Ever got asked for a pilot license when speeding?
Believe it or not... yes. That was one of the most unbelievable moments I've had on the road. Officer was trying to be funny when he stopped me: "Let's see the pilot's license, sir, because you were flying down the road back there." I complied.

The weaving was more of an impatient weaving than drunken weaving (the drunken stuff tends to be slower and more like "drifting"). He didn't seem drunk with his "evasive maneuvers" after the collision.
So he was a demented kamikaze instead of a drunk, and also knew he'd hit you by trying to run away. I hope they catch him.

Re: NA's safest vs. most unsafe roads
The roads that remain open during the winter get some salting. Some of the roads through the mountain passes in Montana and Wyoming are closed during the winter, due to lack of winter maintenance, and some of them are avalanche hazards.
Ironically, the National Motorists Association (not to be confused with AAA or CAA), listed Wyoming as the ...

NA's safest vs. most unsafe roads
In September I'll be going out to Yellowstone Park so I got thinking:
Ontario and Massachusetts have the safest roads in North America (lowest fatality rate).
Wyoming and Montana have the most unsafe roads in North America (highest fatality rate).
Any thoughts on why that might be? Curious as to what you think.

Answer time:
1. You can call the Prosecutor and try to plea-bargain. The $5 court fee is already included in the total payable so it doesn't matter when it is paid. Plea-bargaining may also get rid of one of the tickets, or possibly reduce the speed even further.
2. Yes, it gives you leverage when plea-bargaining. "Fail to surrender insurance" is ...
