Re: Follow Too Close & Fail to stop
So write out a list of questions for the officer, prepare a closing statement summing up all your valid points, and go to court and have a JP rule.
The new strategy appears to write lots of tickets per stop, go to court where the Crown will drop one or two of them. The cop is happy to get his overtime pay for court attendance (that's why he ...

Re: Court Date refused through mail?...
What's wrong with mailing it? My last ticket was 2 hours away. So I'm supposed to drive 4 hours (endangering hundreds of others on the road, LOL) just to get a court date? And this is smarter?
Perhaps I'll suggest that the crown deliver the date in person to his house, LOL.

Court Date refused through mail?...
A co-worker got a speeding ticket. I told him the usual, "Mail in your Not-Guilty plea and wait for a court date, now get lost, I'm busy..."
A couple weeks later, he receives a return mailing stating he must attend in person to request a trial. What?!!!!
First I've ever heard of this. Kitchener court... Any thoughts?

Re: Cop did not change lane for another emergency vehicle
I was 200 m away from his car when he waved me. I was just about to change the lane, but thought he wanted me to pull over, so I slowed down to 45K, but did not change the lane as I had to pull over.
Actually He did not waved me to pull over, by waving he wanted me to change the lane.
I only could not understand his signal.

I have always requested MY continuances with the JP on the day of the trial, not with the Crown 3 days before the trial.

Cops HATE people you stick up for themselves. I would NEVER consent to a search and I advise my family members to do the same.
Strike down 172 and I just might become "cooperative" again. Might even smile now and then.

Co-worker anxious to show me speeding ticket received with wrong date. Copper dated ticket 5 days BEFORE offence. I calmed him down and said to send in your not-guilty plea then wait for court date. We'll take it from there.
Can't remember if wrong day is fatal. Best plan of attack? (don't say call a paralegal, lol. That's too easy)

Re: Fines - Laser Detectors & Laser Jammers
The case law I have read describes illegal searches of the person that has not given consent to the search AND has not admitted to, nor denied, the possession of the RD. You are not required to answer questions asked by the officer. You have every right to keep your mouth shut and NOT provide evidence against yourself.

You have not been charges properly. The ticket you were issued is invalid thus they is no valid proceeding before the court. You cannot be convicted and even if they convict you then you will win your case on appeal.
S. 8 of the POA allows you to settle out of court by pleading guilty and paying the set fine.

From the MTO's website: http://www.mto.gov.on.ca/english/safety/topics/shareroad.shtml
On multi-lane freeways, trucks longer than 6.5 metres cannot use the far-left lane. Instead they must use the lane immediately to the right (middle lane) to pass slower vehicles.
Also worth noting on the same page...

Note that the centre lane is the truckers passing lane (they typically are not allowed in left lane at all). If you diddle along in the centre lane, you will have a big-rig inches off your bumper until you get the drift and move in to the rightmost lane.
