had the oncoming traffic started to move when you made your left? You might be able to argue that you turned because no one was moving so it would be reasonable to assume they did NOT have a green light.
We have one intersection in Stratford that has a solid green circular light in one direction while the oncoming traffic is stopped at a red. Why ...

Not sure why cops keep telling people this. Just trying to put them at ease I guess, so they don't go all postal on them roadside. "There, there. Everything will be all right. Shh... shh.. shh."

While driving downtown today, the car I was following slowed to a stop for several seconds. I stopped behind him and noticed he was pointing out one of the stores to his passenger. He then went to go, but stopped again for more discussion with his passenger. I assumed he didn't realize he was blocking the lane of traffic so I assisted him with a ...

So, in a sense, you've already received ONE continuance already. There's a good chance you won't be granted another. Others on this board have much more experience in court than I and may offer a more qualified opinion on that.

Attend on your court date and ask the JP for a Continuance (extension of time) so you can file a Disclosure Request (all evidence against you) and so you can seek legal council.
You may also choose to request separate trial dates for each and every charge against you (so you can focus on one charge at a time). I did this and was later able to ...

He made a mistake. He wrote the wrong section down. Don't bring it to anyone's attention 'till your trial. Wave off all plea offers by the JP. Can't decide if I'd request disclosure or not.......... ya, but not until I've received my court date in the mail.

Good luck. Tell it like it is! Even if you lose, at least you tried.
BTW, the Crown will likely offer a lower charge just before court. It'll be up to you whether you accept the deal or not.

Sounds like a witness will-say statement prepared by the prosecutors office. If the details differ from those on the officers notes, by all means point out these discrepancies when questioning the officer on the stand.
I doubt a JP will put much faith in the crowns case if there are inconsistencies.

Yes, whenever I drive someone else's car I conduct a thorough check of all mechanical and safety systems (including crawling underneath) before I run down to the store
Yes I'm being sarcastic
A $10 fix-it ticket would be the normal choice of OUR local PD.

Re: The MPH Bee III radar gun's POP mode
I bugged my cop buddy about this once:
He said it's simple to testify on speeding tickets, "The Radar gun indicated a speed higher than the limit allowed so I pulled him over and gave him a ticket".
I asked him if he was supposed to get a visual opinion FIRST.
He quickly repeated his statement, amended slightly ;)

When was the last time you heard of transmission gears braking, or diff. gears letting go? LOL
Once I applied the parking brake on a car and it wouldn't release afterward (stranded). Haven't used one since ('cept for the occasional "e-drift" on snow, hehe).
Come up with a better design than cables that ALWAYS rust and seize and I'll use it ...

I think you should go to court. The danger you were in when the second car also passed (right on your butt - very dangerous) caused you to accelerate much more than you normally would have in this situation.
You did what was prudent given the circumstances. The cop saw nothing. He just saw that big number on his radar gun and pounced! They don't ...

It's just the way traffic enforcement is these days. It wasn't that long ago that passing other vehicles was considered part of normal driving and the associated speed increase was tolerated.
All bets are off these days. The McGuinty government can't keep its own financial house in order, so it convinces the general public that speeders are evil ...

Only white speed signs are subject to penalty. Yellow signs are "recommended" speed only. There is a discussion on here somewhere and I'm pretty certain Bear backed up this contention.
I'd imagine the "basic speed law" (not sure of wording) would apply though... 80kph max.?

Looks like you've got a great defense. Your truck held stationary when you put it in gear, as required by law. The officer had no right to tell you to, "hit the gas".hwybear wrote:to test the brake:

This has me a tad confused...
Is it called an "Emergency Brake" or a "Parking Brake"? I hear it called both.
Frankly, I would rather the e-brake NOT lock up the rear-end (under engine power). Lock up the rear in an emergency and the ars-end is comin' around quick!
It definitely seemed to hold the truck just fine for parking purposes though ...
