Glad I made you laugh.lol Google map 180 wellington street west toronto.(you will see emily to the right) The streets nearby (wellington, simcoe, adailade etc all have the one-way arrows. Emily does not. it has a stop sign at each end. The north end has a 1-way arrow and the is the only sign like that.( I believe it is to stop entry from king street) I entered from the south-end and went half way up and parked. I then did a 3 point and went south to the stop-sign there. On the way I passed a cop. She raced around and caught me over on John street. She said I was going the wrong past her. I said there is a stop sign there so why can't I use the street both ways? She says I cannot do that. Very funny to me too but she still gave me a ticket. The description of what is a 1-way is what I needed to tell the D.A. I have to explain that the street is not 1-way. sorry about you falling off your chair. I will add "read at your own risk" to my signature haha You see I have to prove the cop can't read the sign. Cheers Viper1

It does not show any directional arrows when I used the Bookm Google Map Friend :) OR when I used mapquest. I tried another site called multimap. It shows the northbound one way traffic arrows on Emily Street. Sure is weird to see a stop sign if you are going the wrong way on a one way!

Some one way streets have laneways that cross them in the middle of the one way street, but there is no one way sign when you exit the laneway onto the street. Thus if youre not aware it is an one way street, you could turn the wrong way when exiting the laneway and only realize after youre on the street that all the cars parked on both sides of the street are facing the opposite direction of your travel. I personally encountered such a situation in Chicago. It also had a stop sign at both ends of the one way street, so there may be some reason why they do this.

People park on this street facing both ways. The cop even mentioned it. Even the no parking signs are facing the other way.(like on a 2-way street),(on each side that is) The earlier post noted that the street must be clearly marked. Emily street is not marked except at the north exit. Thanks for the pointers Chers Viper1

It sounds like the street was once a two way street then converted into a one way street but the signs were never removed. Take picutres of the signs if you are fighting this in court. Be sure to take the pictures yourself, though, otherwise you'll need the person who took the pictures to appear in court with you. Good luck!

I believe the stop signs are placed as a cheap way to prevent serious accidents should a driver not realize he is going the wrong way on a one-way street. Two of the houses I grew up in were on one-way streets. We always reminded company about it before they left the house. There is nothing scarier than watching a car at speed confidently head the wrong way toward an intersection. These stop signs may confuse us a tad, but they would save lives and help trigger a motorist to the one-way signs once stopped at the intersection.

It's been awhile since I parked on Emily (I used to work near there 10 years ago. I don't think it's changed since then.) Emily is unusual in that it is a small street and it becomes one way just north of the loading zone on the south end of it. So the the north 2/3 part of the street is one way, the south 1/3 part is 2 way. That's why there are stop signs on both ends. Take a breath and try the bilingual argument (see my sight, Step 5-->bilingual defence) to fight this ticket. I think it's the only option you have if the cop saw you making a 3-pter in the one way part of the street. Also disclosure (don't ask for it) should provide the by-law for the street's direction. If you don't get it, then there's no evidence against you. Good luck and good fight!

I thought the same about the 1/2 1-way stuff. There is no sign anywhere there.(not or for years) Where could I find this by-law? Any idea? I am gonna take a short video of all of the street. Question: In court do I need to bring the T.V.? Cheers Viper1

You don't. The prosecutor has to file the by-law in court. They should release it to you when you request disclosure. DO NOT REQUEST THE BY-LAW!!! If you do, they'll give it to you. Instead, request disclosure and when they forget to give it to you and try to file it in court, argue improper disclosure. I think the court administration handles that, but a picutre(s) will do. As long as the photographer is in court, that should be sufficient. I admit I haven't driven by there in awhile but are you absolutely sure of this? I remember a one way sign visible from King St. and I remember a "One way begins" sign just north of the loading area on the west side lamp post. There used to be construction there over the years and sometimes the scaffolding obscures the sign.

I cover this in more detail on my site (Step3-->Find the Act). Basically municipalities enact by-laws regulating speed, parking, turns, etc. Then they erect the sign. The sign is meaningless without the by-law. Typically the prosecutor will submit the whole by-law (must be a certified copy) at the beginning of the court session as most offences that day will be prosecuted under it. Example, you stop a speeder for doing 70km/h in a 50. Fify is the default speed in built up areas. No by-law needed. Example, you stop a speeder for doing 60km/h in a 40. The 40km/h speed is created by a by-law and it has to be submitted in court. You would never have to copy it yourself. You're ticketing based on the sign. The prosecutor has to submit a certified copy of the by-law that was in effect on the day of offence.

I finally got my notice to appear. September 2009. I went back to the scene and took a few pictures. My !@3#4$(0_+ camera resets the date every time I re-charge the batteries. I did not know this. The pictures I took have the date 2005 on them. Can this be an issue? The date stamp I mean. Cheers Viper1

Try to re-take your pictures. Also, since you probably have an old(ish) camera, replace the dead button cell battery. Most cameras have a small button cell battery (usually a 1216 or similar size) that keeps the clock "ticking". Try to locate that.

I went to court yesterday on this matter. What an eye opener. 10:30 start I got there at 10:30 I sat at the back and just watched how it was done. People talked to the DA and automatically got reduced fines to plead guilty. I did not know that I was supposed to go up and tell them I was there but I heard my name mentioned so I went up.(all before judge entered) She asked what plea I had I said not guilty. She said have a seat. Court started. Cop asked to talk outside I said ok. She did not like my pictures but agreed that there was no red circle sign with slash on the street. She tried to get me to plead to some bylaw charge with no record. Then when going back in she said what do I want to do? I said see what the judge says. They call me I say my name the DA says "charge withdrawn officer present no evidence" Total time in courtroom 18 minutes. Not sure if it was long weekend hurry-up but I won hehe. :D Cheers Viper1

When charges get withdrawn as officer has "no evidence" it usually means that police officer did not have sufficent evidence for the prosecutor to proceed with your matter. An example: officer did not make any notes re: the offence and does not recall important particulars.

I have a problem and not sure what the hell to do about it. Few days ago I was stopped on a street going westbound against blinding afternoon sun following the flow of traffic. I drive a taxi for living in Toronto and have ACZ driver's license. I have a perfect record both for professional as well regular demerit points. I haven't been pulled over as a matter of fact in some 15 years for…
I have recently gone to court for a speeding ticket issued by an OPP officer. As it stood, the officer forgot to sign the ticket. So at my trial, before I made a plea, I pointed this out to the justice of the peace and asked that the ticket be quashed. I was asked to produce my copy of the ticket, which I gave and the JOP then agreed with me and dismissed the case. Before he did so, the…
I got pulled over (along with about 10 other cars) for going through a road closed sign. I had just pulled out of a parking lot pretty much right beside the road closed sign, and with about 4 cars behind me there wasn't much I could do but go through, so I think I have a good chance of fighting it. However, on my ticket under the Signature of issuing Provincial Offences Officer, it's left…
So here's my situation, any advice would be appreciated.
On June 26, 2013 I received a ticket for 25 over in a 60 zone
In early October I received my notice of trial (Feb 25, 2014)
In early January I sent in my request for disclosure
In late January I received a letter to pick up my disclosure, however when I picked up my disclosure it wasn't typed (I had requested it to be) and I needed…
Is there a legal requirement to report an accident to the insurer?

- 2 vehicle accident
- each vehicle has less than $1000 damage
- each vehicle has damage roughly equal to insurance deductible
- a police Accident Report was completed
In this scenario the drivers decided to repair their own damages. But are they legally bound to report the accident and damages to the insurer? ...and out of…
I will be representing my wife at her speeding trial next week. Mostly everything is pretty much run of the mill but since she wasn't speeding we will be having her take the stand. Since this opens up the opportunity for the prosecutor to cross examine, I am just wondering if anyone here knows what kind of questions we should expect from the prosecutor in order to best prepare.
i got pulled over by a cop this morning in my kids's school zone for failure to stop at a stop sign. i am thinking of fighting this ticket, but i noticed that on the ticket itself it only says "disobey stop sign - fail to stop" and there is no mention of the demerit points. a co-worker mentioned to me that a ticket should state how many demerit points i am being docked. i know the Highway Traffic…
Alright, so this happened back awhile ago on June and I haven't appeared in Court. However, I would like some inputs and advice before I get into this battle.
Back in June I got a Speeding Ticket claiming I was going 100km/h on Blackcreek going south towards Lawrence. The Speed Limit there is 70km/h.
At this point of time, it was roughly traffic hour around 4-5PM. Coming off of the Highway, and…
Ive already done searches, read the act as best i can but still haven't read a complete answer. Where in the HTA does it state that the front license plate must be attached to the front bumper? My son was returning from school and was just entering the driveway when another vehicle hit the rear end. Police writes a ticket "fail to yield from private drive" 139(i). He is going to fight this ticket and made an application for disclosure. The trial is next week and he still hasn't received the disclosure.
He checked with the court last month and they said that they will call when disclosure…
i was travelling on the 401 (posted speed 100km/h) in the far left lane, when i caught up to a vehicle going ~110km/h. I patiently waited for the vehicle to move over a lane, but they did not. Went to court having not received disclosure (and was not organized enough to apply for a stay), so the trial was adjourned. They photocopied the officer's ticket and notes and provided a log sheet from the plane. I've sent another request for the rest of the disclosure items.

I got pulled over on a 4 lane section fo Highway 7... Thank god I didn't get a stay at home ticket as well or my car impounded.
Officer clocked me at 156 km/h he decided not to impound my car and give me a 149 km/h since it was my first offence and he said I was polite and respectful. I would give this officer a 5/5 review if I could, very polite and respectful.
Long story short, I was driving from Toronto to Ottawa and around Napanee with my friend in two separated cars, the officer was parked on uturn. He followed us turn his light on and got between us and pulled us over, he told me that i was running at 152 km/h without showing me his LISAR. they suspended my and my friends license and impounded the two cars for 7 days. I'm unsure on what to do here. I was under the impression that I could request a stay on the day of trial because disclosure was not given to me in an adequate time. I requested disclosure 2x by fax, 5 months ago.
I read on ticketcombat that I had to file a motion 15 days prior to the trial to request a stay of proceedings.
