Hello all, yesterday I received a ticket for parking in a handicapped spot outside of school. I was done classes and had to load up my van with some very heavy and awkward items for transport. I had been parked in the garage across the street for the duration of my classes and decided to bring the van around to the front of the school to quickly load it up. There were no available spots that I could see on the street ( the school does not have a designated student parking lot or loading zone) so I pulled into an empty spot that was not marked on the pavement by a square bracket as a parking spot. I put my four-ways on and ran inside to grab the items to be loaded. I was gone for about 30-40 seconds and when I returned, items in tow (and over encumbered), I discovered an officer issuing me a ticket. The time on the ticket and the time on the punch out receipt form, the parking garage are literally a minute apart which I documented. I explained the situation to the officer, that I was a student at the school and had some very heavy items to load without any assistance (on of them weighs 89lbs). He assured me that it did not matter and I was getting a ticket as I had parked the wrong way in a handicapped loading zone. Because I approached the spot from the wrong direction I did not see the signage (it is turned into the lane facing the other way), and frankly I have very little experience driving in heavily developed areas like Toronto. I live in a rural area, and have been for the entire time I have been driving. I was unaware that parking direction on the street was even governed law (I will not soon forget). Anyways, as a student $450 is a massive deal. Given the amount of time I was in the spot and the circumstances (it was dusk) etc... this seems quite severe. There is no question that I am going to fight the ticket. As far as reduction what do you guys/gals think I can expect?
Fighting handicapped parking ticket of $450
Re: Fighting handicapped parking ticket of $450
Toronto courts are backed up so there is a good chance that if you plead not guilty and ask for a trial, the trial will be more than a year away and you can then apply for it to be dropped on charter violation grounds of right to a speedy trial.

Re: Fighting handicapped parking ticket of $450
I got one of these last year April, and my court date is next month, so I don't know how backlogged they actually are. None the less, request disclosure, and hopefully they won't have it ready for your case (the situation which I'm in right now). That way, you'll be able to get an adjournment and that helps your case even more for an 11B.
Re: Fighting handicapped parking ticket of $450
I agree with the the others, file for court and request disclosure. At the very least you won't have to pay it until the trial process is complete, which will likely be many months down the road. If nothing else this will give you some time to save up the money in case you lose and wined up having to pay. Also you should be able to ask the justice of the peace for extra time to pay if it comes to that. There is of course also the chance that they won't be able to schedule your trial with in the legally mandated one year, in which case you can have the ticket dropped. Also the officer may be a no show or you may be able to find some other defence once we see what the officer's notes say, when you get disclosure.
Re: Fighting handicapped parking ticket of $450
Alright, thanks for advice! I will pop by the office tomorrow and let them know I am pleading not guilty and will also request disclosure. Hopefully the case gets tossed, even if it doesn't I don't mind paying some amount for this offense. $450 is out of the question though, it's too bad the issuing officer couldn't have been more understanding of the situation.

Re: Fighting handicapped parking ticket of $450
You said this was in front of a school, if it is something like York university, they have their own parking enforcement officers, to which they can not enforce the parking ticket unlike regular Toronto parking enforcement officers.
The catch is, if the plates are registered to you, then they know who you are and they can withhold you from graduating until you play up.
You might want to investigate that part also.
Re: Fighting handicapped parking ticket of $450
Awesome, I will ask as the desk today if the school looks after the street or not. I have a feeling they are not in charge of it though and it falls under the city's jurisdiction. The car is not registered to me but it clearly says on the back of the ticket that my drivers license would not be renewed etc if I do not pay.
Re: Fighting handicapped parking ticket of $450
Can you scan and post the ticket with personal and officer info blanked out?
Re: Fighting handicapped parking ticket of $450
I can, although I just inquired at the from security desk and they said it is in fact the city that takes care of the street. I just took some more scene photos to document the angle of the sign. I'll be taking some more at the time the ticket was issued after I am out of classes today. It's funny, in google street view and in my shots there is a car standing in the spot I was in with no permit, the only difference is there is an individual in the vehicle in both cases, also facing the other way. I also managed to grab a picture of a handicapped ttc transport shuttle pulled over maybe 20 meters up the street, presumably letting a passenger off while the car without the permit was in the spot. Would you still like a ticket scan, or was that just to see if it was a non-government party that issued the ticket?
Re: Fighting handicapped parking ticket of $450
Here is the ticket and receipt stub form the garage for time reference.
Thanks again!
Re: Fighting handicapped parking ticket of $450
It clearly says CITY OF TORONTO on it so it is not from the University.
Use the Option 2 to Plead not guilty and request a trial and then request disclosure and go from there. Make a copy of both sides of ticket to keep before you go request the trial.
Re: Fighting handicapped parking ticket of $450
As a side question to others reading this thread, is it City of Toronto POLICE that issue by-law offences like this, or does Toronto have seperate by-law officers?
Re: Fighting handicapped parking ticket of $450
"It clearly says CITY OF TORONTO on it so it is not from the University."
Also this lol. Will do, thanks for the advice everyone!
P.s. I believe it is a unit of the Toronto police that takes care of this, however I did not see the car and was in quite the rush as you may imagine.

Toronto has a separate Parking Enforcement Unit that issues parking tickets. This unit is managed by the Toronto police, but the parking enforcement officers themselves are not police officers, they are unarmed bylaw officers who only have the power to issue parking tickets.

How long does a conviction stay on your record?
I've searched and either I'm not hitting the key words or the topic hasn't been touched on before (which I doubt, but anyway...)
Just curious how long a HTA conviction stays on record (both on MTO and insurance) and does the "clock" start from the offence date or conviction date?
Thanks.
Is this charge too heavy for me?
Hi,
I recently hit a van from behind, at a busy cross section. The reason was my lunch bag and coffee dropped to floor with a 'bang', so I did not fully stop. The police came and charge me with HTA 130 (careless driving), is this too much for me?
BTW I did not mention the coffee thing to the police since I thought this would only involve insurance company (I was hit by somebody a few years ago, the…

105 in 60, officer lost sight
Recently I was cited for speeding 105 km/h in a 60 km/h zone. I have two problems, firstly I am 18 and have my G2 (insurance is already expensive) and although I will likely have my G by the time this is resolved I want this to have the least impact on my insurance possible. The second and more important issue is that the officer who alleges I was speeding did not catch up to my car until I was…
How to prove other driver disobeyed a sign (182.2) in Reg615
I received a 141(5) left turn violation for an accident.
I was making a left turn across three lanes of traffic. The nearest two lanes were stopped for a traffic light up ahead of them and behind me. The third lane was a "right turn only" lane. As I made the turn, I saw a car pull out around the stopped traffic and enter the "right turn lane", so I stopped with my nose in the lane, but instead of…

HTA 144(7): Fail to Yield to Pedestrian - left turn, dashcam
Good morning drivers, law enforcement, and traffic enthusiasts,
I recently received a ticket for "FAIL TO YIELD TO PEDESTRIAN." I was stopped at a red light in the left lane, signalling to turn left. The light turned green and as I pulled into the intersection, a pedestrian on the left crosswalk began crossing in the opposite direction. As I approached the crosswalk to complete the left turn, the…
Speeding 90 km/h in 70 km/h zone (Reduced)
Hi everyone.
I received a ticket on Hwy 6 North in Guelph going 90 km/h in a posted 70 km/h zone. I was clocked at 110 km/h and the officer reduced it to 90 km/h.
I requested for disclosure back in February 8th , after I received notice of trial for March 8th. The disclosure package did not get mailed, and when I went to the court on the day of trial, the clerk informed me that she had just…
Any advice on hand held device while in gridlock traffic?
Hi All,
Hoping for some guidance or recommendations.
I was driving past the ACC today in heavy traffic trying to eventually make the turn to go right to start my trek onto the gardiner. I had my Phone in my lap I was using it for GPS when I hear a knock on my hood. A police officer was just walking through the gridlock traffic to see who was on their phone. He immediately asked me to roll down my…
No Validated Permit, but for suspicious reasons

Hello Everybody!
My case is a pretty 'common' one, I suppose. Nevertheless, I would like to read ideas and do some brainstorming: yesterday, after going out for dinner (about 11:00 PM ET in Oshawa) and while driving back on King Street North I noticed a police patrol following me closely. I did not attempt to speed away or anything. I simply continued my driving observing all precautions. Upon…
Red light - fail to stop
Hi, I'm new to this site, everyone seem really helpful to new members here. So here goes nothing.
I'm a G2 driver, aged around 20ish, male.
I got a ticket at around noon at intersection Markham road and Progress ave while I was driving my mother to work. I was going southbound on Markham road, I was going at about 70-75, I saw the approaching light and it was turning yellow and I decided to run for…
Lidar test before & after means?
As I understood, general opinion on this forum radar(as well lidar) should be tested twice-before and after. but I'm confused
1/ Is it enough before and after shift, or police officer must to do it before/after EACH catch.
2/ When PO make notes in ticket ? In time off issuing? How possible he wrote time of test 7.00 AND 19.00, if he stopped me in daytime?
Could somebody clarify?
Is it worth contacting ticket officer?
I got a speeding ticket today while I was at a stand still.
I had to stop as there was an elderly gentleman walking accross the left lane I was in. I could clearly see the speed trap up the hill as well as the en-mass brake lights from the vehicles ahead. I then accelerated up the hill and watched the speedometer. I never went above 60KM/H, speed limit is 50 I know but I'm trying to be honest.…

Careless Driving - Left Turn Hit A Pedestrian
A couple nights ago I was driving in the rain. I was at a 3 way intersection waiting to make a left turn. When i got the advanced green (may have just been a green light) I went and I didn't see any pedestrians. I proceeded to go but at the very end of my turn I saw someone walking towards my car. I abruptly stopped and triggered my abs brakes. When that happened it was too late, the pedestrian…
Urgent - Illegal Stop & Arrest On Private Property
I've searched for hours looking for a similar situation to mine on a number of forums, and I couldn't come up with anything close. I was arrested on private property after being watched and stalked for over two hours…
Improper signage nearly leads to an accident - who would be at fault?
I was driving down a two lane road, in the left lane. As I approached a construction zone, the two lanes merged into one. There was a sign that said the right lane ends, BUT this sign was incorrect. It was the left lane that ended.
Unfortunately I was driving according to what the sign said, and improperly continued into the right lane. This lead to me almost colliding into a bus.
So I'm wondering,…

Fail to obey stop sign HTA 136 a (with video evidence)
I was given a ticket fail to obey stop sign. I was too far back from the white line. He has it on video that I was not at the white line - but he could not see exactly how far behind the white line I was because a big pine tree was in the way. It was dark, and I have a black car.

Wrong speed limit
I got a speeding ticket back in June which I pleaded not guilty to. My main reason being that the ticket states that I committed the offence of driving at 129 km/h in a posted 90 km/h. But it was on Hwy 400 and I know it is 100 km/h.
My court date has been set. Maybe I should have researched more because reading some of these threads I see that this is not a fatal error and can be corrected in…
Review of Disclosure HTA 144(18) Red Light Fail to Stop
Hi Guys, my court date is Sept 28, 2015. Need help on whether I should plea or not. I got no evidence that I had stopped and will just be representing my self. He issues me a caution ticket for going 120km and a ticket for fail to stop red light.…
Alleged Collision - may face charge of leaving the scene
I just had an experience where I had a cyclist ride off of the sidewalk in front of my car at a corner. I managed to stop, she went by me. She was looking backwards screaming at me and lost her balance, mostly due to the grocery bags on her handle bars. She fell in the other lane. I got out to see if she was okay. She had a scraped knee, but was fine. She said she was okay so I left. The police…
