Received Fail To Obey Stop Sign Ticket Disclosure But No Video

Unread post by jhj1925 »

Hello,

I received a stop sign ticket and applied for early resolution meeting, scheduled this week.

I am more concerned about the cost of insurance going up (which is already crazy high in ON) due to conviction than the cost of ticket itself.

From what I have read, most likely outcome of these meetings are a reduced fine but that will still impact insurance. What can I do to prepare myself to ensure my insurance doesn’t go up?

I do believe that I stopped but might have been a rollover stop. Officer’s disclosure notes state that I didn’t make any stop and it indicates he has video and audio attachments which I didn’t get. On requesting video evidence, even after a week, court said they are still waiting for ICCS. If they are unable to share video, can that act as a favour and can I request case dismissal based on lack of evidence?

Two other things I have in my defence are:

1. My wife as a passenger and witness

2. My insurance app that gave me 100% perfect rating for my driving during the trip

Disclosure, or lack of it, won't have any impact on an early resolution meeting. It would only come into play if you requested it, followed up consistently, and still didn't receive it by trial. Similarly, your wife as a witness will not affect resolution. Your insurance app only knows the speed you were driving, whether you accelerated hard, braked hard, etc. It has no idea of where stop signs are.
