Ok so I was reading on the MTO site that the school bus driver and a witness can report someone who has passed a stopped school bus. What I want to know is what will happen to the driver if a witness only reports them? If they write down there lisence plate and car model etc. And call it on to the police. This doesn't seem right if the driver were to get a ticket in the mail just because a witness says they drove past a school bus since anyone can just call in lisence plates and say a driver drove past a stopped school bus?? So does anyone know what happens to the driver if only a witness reports them?

Re: What happens If witness reports a person for not stoppin
Once the police received the traffic complaint, the matter is investigated (ie: does your description of the vehicle match the registered vehicle's information, is the area you described accurate, is the licence plate accurate, is the description of the driver possibly the RO, etc etc etc).
Generally, the registered owner of the vehicle will be charged, as they are deemed responsible for whoever operates their vehicle. If charges are laid, the original witness will be subpeona'd to court and required to testify as to what they observed.
Why does it not seem right? because someone got a ticket does not mean they are guilty- a ticket is only an allegation that an offence occurred, and it is up to the courts to determine the truth. Tickets are allegations that expediate a person's ability to admit to the offence and pay the ticket as opposed to being found guilty in a court.

Re: What happens If witness reports a person for not stoppin
Ok but if someone is Falsely accused of this they will get a ticket in the mail and then have to make time to go to court? What if they don't have time they just have to pay $500 or more!? It should only be the bus drivers responsibility to get the lisence plate and prove that a person did commit the crime. A random witness should not count because they can't be proven to be reliable. How does a witness prove they did it and how can a driver prove that they didn't do it? This seems like a money grab that's why they do this kind of stuff because why can't the bus drivers just drop the kids off at the side walk they need to be on by making an extra turn instead of stopping at the intersection where it is so dangerous, that would end so many violations of this law. Will it not? I know other states have done this which is much smarter. This is a terrible law which I'm sure many people have been falsely accused of doing, witnesses should not be considered reliable since it's simply there word against yours and in court they will much rather give the ticket than not.
Re: What happens If witness reports a person for not stoppin
Where do i begin?
1) You don't get a ticket in the mail. It's issued in person to the owner of the vehicle or the driver if they can be identified.
2) It's everyones responsibility to ensure the safety of other on a highway.
3) It's not classified as a "crime" it's a violation of a Provincial Act.
4) It would be up to the court to determine who's "reliable"
5 A bus driver can't simply drop kids off at the sidewalk. What about the kids who live on the other side of the street? The lights on a school bus ensure that the kids are safe to cross the street.
6) Who cares what they do in the "other states" This is Canada and we have Provinces.
7) This is a great law that attempts to ensure the safety of our children.
Our courts may not be perfect but they've seemed to work well for hundreds of years.
9) Driving in Ontario is not a right. If you don't want to obey the laws, either don't drive or be prepared for the consequences.
10 The courts probably don't care one way or the other if you are convicted. They simply listen to the evidence presented and make a decision based on that.

Re: What happens If witness reports a person for not stoppin
Thanks to the both of you guys for answering. I read on here that you get a ticket mailed to you. How sure are you it's delivered in person? So that means a cop has to go to your door and issue you a ticket? Also you say who cares about other states well I read online that when you avoid the intersections and the school bus drivers let the kids off at the safer area because you can pass a stop school bus in those states and the accidents have been reduced so it's proven to be better and safer. Yeah it takes more time for the school bus driver but who cares its safer for kids. And the courts know these violations well and it would be rather hard for the person being accused to prove they didn't violate any laws, that's why I think a witness in most cases should not count they should need more evidence for someone to receive a ticket.

1. Yes, we are sure the ticket is served to the registered owner in person.
2. We've answered all your questions, any further bones you have to pick with the law/courts can be taken up with your MP.

Re: What happens If witness reports a person for not stoppin
K thanks just have a couple more questions. How long does the officer have to go to the owners door and give them a ticket? And how does the cop identify them what if they don't match the description that the witness gave? Also what if there's more than one person who drives that car, they prob just give the ticket to the owner right? And lastly is there any chance a police officer can decide not to give the owner a ticket?

They don't need to identify the owner. The ticket will be attached to the plates. Since it doesn't go against a specific license holder, it won't have any impact on insurance.

Tireburst-Careless driving ticket
Hello All,
I was driving on 401 east right lane, and my left rear tire burst, causing the car to hit the right rail/ concrete wall along the high way.
OPP gave me a ticket for careless driving (490 dollars). Even though there was no other car involved, but bodily injury to the passenger.
Since its not my mistake, how should I contest the ticket.
Any suggestions ?
Thanks in advance...

Falsely Accused of Handheld Device Usage
Hi!
This is my first time ever getting a ticket and I am completely frustrated and don't know what to do.
On July 7th, I was driving to work, taking my usual route and it's about a 15 minute drive for me. At the first red light, I noticed I had a bit of time thanks to the countdown so I quickly reached into my bag to grab a lip balm. I noticed I had brought the wrong one so I just kept it out and…
Turning left on amber light and hit by a forthcoming car
It happened last December. I was facing north in the middle of the intersection at Donmills and McNicoll waiting to make a left turn. There was a big white van on the other side of McNicoll facing south waiting to turn left too. When the light changed to amber, I checked and the road was clear, there was no upcoming vehicle. So slowly I made the left turn. Suddenly a small car dashed up from…
Speeding 141 - Sep 3 court date (adjourned from June 4)
hey guys,

A question about disclosure
I got a notice in the mail that trial is set four weeks from today, so it's time to request disclosure. I have zero chance of getting an 11b since trial is less than two months after the offense date and the officer did not reduce the charge. I really want to try and create delays on the trial, to reduce the chance of the officer showing up on multiple occasions. Is there any known loop-holes…
Moore St near Bayview (HTA 182 (2)) A couple of questions...
Got my first ticket last Thursday and I have a couple of questions. I was driving westbound on Moore St. (west of Bayview) and made a left onto a residential street at a 4-way stop sign. It was my first time driving through that area - was driving my girlfriend to a wisdom tooth surgery.
The police were set up to catch people, as that intersection had a no left turn sign from 7-9 am (buses…
142(2) - Start from parked position, not in safety
I was in a light collision with a police vehicle last November and will be having a trial by the end of the month. What happened was I was pulled over. I stopped and kept my right signal on. The cop car then tried to pull behind me when he was on my left but 2 cars pulled behind me. The cop wasn't too smart and instead of waiting for the two cars to pull away, he drove forward and boxed all the…

Fail to Stop for School Bus- Owner - 175 (20)
Hi everyone,
My husband was driving my car and passed a school bus with flashing lights. He did not realize this until he was past the bus. The driver honked at him but there were no cops nearby and he didn't get pulled over. I believe the driver or witnesses reported this and we got issued a ticket in the mail. The ticket is under my name as the registered owner: charged with Fail to Stop for…

Section 172 the illegal legislation governing street racing
Hi I'm new to this forum but I hope I'm bringing you all good news.
I recently wrote a book short titled ABUSE OF POWER

To start with the denial of the right to remain innocent until proven guilty was enacted without due process under the Charter of Rights and Freedoms. How it wasn't done…

Was the copy giving me a birthday present?
Hi, thanks for reading. I've read a bunch of articles online and searched the forum to try and find my answers but I'm still unsure so I'm creating a new thread.
I was following a car that was going SUPER fast down the DVP but I got pulled over. I was speeding, too; however I don't want to use the "you got the wrong guy" defence because I'll probably lose.
Anyway, it was on my birthday and I'm…
Failure to Yield at Uncontrolled Crossing
I left my home at 4 am to pick up my daughter from downtown Toronto. When I passed the major intersection south of my house there were two police cars in the middle of the intersection and one officer waved me through the intersection.

Speeding Trial - Prosecutor Questions to Defendant
Hello everyone,
I will be representing my wife at her speeding trial next week. Mostly everything is pretty much run of the mill but since she wasn't speeding we will be having her take the stand. Since this opens up the opportunity for the prosecutor to cross examine, I am just wondering if anyone here knows what kind of questions we should expect from the prosecutor in order to best prepare.
Wrong Address
When the court sends out the notice of trial, do they use the address the officer wrote on the ticket, or the actual address in the MTO database? In the case of the former, what are the implications? The reason I ask is that my wife got a ticket last week and the officer wrote the wrong city on it.
This topic discusses the same thing but with CN police; is it any different for regular offences?
Failure to remain...at the parking lot
Greetings.
Last thursday my wife and kids were in yorkdale shopping mall cinema.
I drove in the parking lot to pick them up, parked , waited about 20 minutes till they showed up, backed up and we left.
Next day i got a phone call from police, who claimed i was involved in the accident and invited me to come over.
Apparently(what they claim) as i was backing up I scratched along a passenger side of…
Single Car Collision, No Witnesses = Careless?
Details:
Driving onto ramp entering a major highway, posted limit is 100km/h, suggested ramp limit is 40km/h - I end up colliding with the concrete barrier on the passenger side of the vehicle.
Police arrive, suspect alcohol and breathalyze me with a result of 0.00 - I am asked for a statement and cautioned, however (stupidly) I proceed to provide the details anyways.
In my statement I say that I…

Disobey Stop Sign Ticket
Hello all,
I've decided to fight a traffic ticket for stop sign violation. The offense was 12 months ago, and I've got a court date for next Tuesday. I've requested disclosure and, although a bit last minute, received it two weeks before my court date.
Upon reviewing the case materials, there isn't much of a defense I can find -based on the cop having an obstructed view, or any mistakes in the…
HTA 144(18.1) - photo evidence of "approaching" the intersection
I will be going to trial for my red light camera offence.
I'll be arguing two issues, centered on the fact that there are two essential elements of 144(18) - a) a vehicle approaching the intersection shall stop; and b) the vehicle shall not proceed until green. Both essential elements must be contravened beyond a reasonable doubt to be an offence.
1) My ticket says I (being the owner) am "charged…
Signalling for speed trap
Hi,
I'm a newbie, so be kind if I'm messing up. Question: is it illegal to signal oncoming traffic that they are approaching a speed trap by flashing one's lights?
I ask because I was stopped for doing that yesterday evening, but did not end up with a ticket. The officer spend 5-10 minutes n his car, then sent me on my way. I'm wondering if he changed his mind or found out it was legal.
If it is…
