Ok so I was reading on the MTO site that the school bus driver and a witness can report someone who has passed a stopped school bus. What I want to know is what will happen to the driver if a witness only reports them? If they write down there lisence plate and car model etc. And call it on to the police. This doesn't seem right if the driver were to get a ticket in the mail just because a witness says they drove past a school bus since anyone can just call in lisence plates and say a driver drove past a stopped school bus?? So does anyone know what happens to the driver if only a witness reports them?

Re: What happens If witness reports a person for not stoppin
Once the police received the traffic complaint, the matter is investigated (ie: does your description of the vehicle match the registered vehicle's information, is the area you described accurate, is the licence plate accurate, is the description of the driver possibly the RO, etc etc etc).
Generally, the registered owner of the vehicle will be charged, as they are deemed responsible for whoever operates their vehicle. If charges are laid, the original witness will be subpeona'd to court and required to testify as to what they observed.
Why does it not seem right? because someone got a ticket does not mean they are guilty- a ticket is only an allegation that an offence occurred, and it is up to the courts to determine the truth. Tickets are allegations that expediate a person's ability to admit to the offence and pay the ticket as opposed to being found guilty in a court.

Re: What happens If witness reports a person for not stoppin
Ok but if someone is Falsely accused of this they will get a ticket in the mail and then have to make time to go to court? What if they don't have time they just have to pay $500 or more!? It should only be the bus drivers responsibility to get the lisence plate and prove that a person did commit the crime. A random witness should not count because they can't be proven to be reliable. How does a witness prove they did it and how can a driver prove that they didn't do it? This seems like a money grab that's why they do this kind of stuff because why can't the bus drivers just drop the kids off at the side walk they need to be on by making an extra turn instead of stopping at the intersection where it is so dangerous, that would end so many violations of this law. Will it not? I know other states have done this which is much smarter. This is a terrible law which I'm sure many people have been falsely accused of doing, witnesses should not be considered reliable since it's simply there word against yours and in court they will much rather give the ticket than not.
Re: What happens If witness reports a person for not stoppin
Where do i begin?
1) You don't get a ticket in the mail. It's issued in person to the owner of the vehicle or the driver if they can be identified.
2) It's everyones responsibility to ensure the safety of other on a highway.
3) It's not classified as a "crime" it's a violation of a Provincial Act.
4) It would be up to the court to determine who's "reliable"
5 A bus driver can't simply drop kids off at the sidewalk. What about the kids who live on the other side of the street? The lights on a school bus ensure that the kids are safe to cross the street.
6) Who cares what they do in the "other states" This is Canada and we have Provinces.
7) This is a great law that attempts to ensure the safety of our children.
Our courts may not be perfect but they've seemed to work well for hundreds of years.
9) Driving in Ontario is not a right. If you don't want to obey the laws, either don't drive or be prepared for the consequences.
10 The courts probably don't care one way or the other if you are convicted. They simply listen to the evidence presented and make a decision based on that.

Re: What happens If witness reports a person for not stoppin
Thanks to the both of you guys for answering. I read on here that you get a ticket mailed to you. How sure are you it's delivered in person? So that means a cop has to go to your door and issue you a ticket? Also you say who cares about other states well I read online that when you avoid the intersections and the school bus drivers let the kids off at the safer area because you can pass a stop school bus in those states and the accidents have been reduced so it's proven to be better and safer. Yeah it takes more time for the school bus driver but who cares its safer for kids. And the courts know these violations well and it would be rather hard for the person being accused to prove they didn't violate any laws, that's why I think a witness in most cases should not count they should need more evidence for someone to receive a ticket.

1. Yes, we are sure the ticket is served to the registered owner in person.
2. We've answered all your questions, any further bones you have to pick with the law/courts can be taken up with your MP.

Re: What happens If witness reports a person for not stoppin
K thanks just have a couple more questions. How long does the officer have to go to the owners door and give them a ticket? And how does the cop identify them what if they don't match the description that the witness gave? Also what if there's more than one person who drives that car, they prob just give the ticket to the owner right? And lastly is there any chance a police officer can decide not to give the owner a ticket?

They don't need to identify the owner. The ticket will be attached to the plates. Since it doesn't go against a specific license holder, it won't have any impact on insurance.

149km/h on 401 WB Disclosure Notes
I followed the procedures mentioned in the previous threads regarding the disclosure and received it today. My court date is November 5 2009 in Whitby. After going through the notes I realized 2 things:
1- the notes are horribly illegible and difficult to read
2- I have notes from two different officers.
Now I am not sure if this means that both the officers will be at court for the hearing or…

I hope I can paint the picture with the accuracy that the truth deserves. I have no intention of just beating a ticket.. but more like beating a really unfair ticket. You decide!

Fatal error: Speeding 75km/hr in posted 60km/hr zone.
Hi everyone,
Need an expert advice here. 10 days ago I got a speeding ticket. Ticket has a fatal error on its face-offense not known to law. It says speeding 75km/hr in posted 60km/hr zone. What is the best way to proceed?
1. Should I completely ignore this ticket and let the JP to quash it?
2. Should I go with option 3 - request a trial and force the fatal error by not showing up at court?

DON'T HAVE A CLUE WHAT TO DO!

I have never drunk and drive but I face a problem and Im wondering if anyone can tell me what to do. Several months ago I was at a weekend party and had quit a bit to consume. When I stopped…

123km/h in a 70km/h
Just got this last night on my way to guelph.
Crested a hill, officer coming at me, pulled a u turn and pulled me over.
I will go back and look again but I thought I was in an 80 not a 70 and I am positive I wasn't doing more than 120. My speedo read 110-115. I have aftermarket tires and rims so I assume this would be the difference.
It was around 7pm, already dark, nobody on the road but myself,…
Case Law- Disclosure of only testing pages of radar manual
I am looking for the case law that is commonly used when the prosecution says they only need to disclose the testing pages of a radar manual or laser manual.
I am only interested in the binding decisions (appeals court or higher?), and not in the non-binding Justice of the Peace decisions.

Drive While Under Suspension "Force Fatal Error"

Anyways I got 3 summons for Drive Under Suspension and 1 summons for speeding.

misspelled offence for failing to stop at a stop sign
Hello,
I was pulled over two nights ago and charged with failing to stop a stop sign. On the ticket, it says 'disobey stop sign - foil to stop' and does not say 'fail' -- something I think may be a fatal flaw? I have been driving for 12 years with no tickets, yet I live in Brampton where insurance prices are high so I do not want to be convicted as my insurance rates will spike significantly and…

Improper Mudguards?
Good evening everyone,
I need some help here. So today I was on my way to get my tires changed from my winter tires to my regular summer staggered set of tires. For some context, I drive a stock 2013 C63 AMG with winter tires at the time. I was never…
FTC ticket: rear-ended the lady but no damage
Hi,
I'd like to start this off by saying for the last two weeks I have been browsing the forums. I'm trying to prepare myself for an early resolution meeting with a prosecutor (in Brampton, if that matters). I have a clean record and as a teacher, I always do my best to follow rules (trying to practice what I preach!)
On December 4, 2014 I was preparing to turn right at a very busy intersection.…
Someone took a photo of my license plate
Hi,
I have question, today I was going to work in my normal route there is a triangle intersection with my side being the only one with a stop sign.
There's a car in front me who stopped at the stop sign, and the third-side there's a incoming car with their hazard-light flashing but they don't have stop sign, yet coming in at a slow speed.
Right after the car in front me went through the stop sign,…

I did not realize I was breaking any law it was a dotted line where I tried to…

Discussion - Front license plate
Let me start this with saying that this isn't in regards to a ticket, more a discussion surrounding front license plates and learning about the rules behind them. I know Ontario law/HTA mandates having a front license plate unlike some States in…
It is hopeless to fight a ticket at Ontario Traffic court
Hi Guys! I've just had my trial day yesterday. I was not at fault but was convicted anyways.
It is such a travesty! There is no justice at the traffic court. It is just a no mercy machine to part someone with his money, no common sense applies and no reasonable argument being considered. Such a shame! The justice, the policeman and the prosecutor ganged up against me. The justice kept interrupting…

Well first of all ... glad to have found the forum - hoping to find answers to 'alot' of questions

licensed in another province at time of suspension
I have an unusual situation.
I was traveling down the 401, noticed a speed trap, and started flashing my lights -- in order to warn oncoming drivers.

The officer pulled me over, and while he was polite, clearly his motivation was to…
