if they are being stuborn on the phone, forget the phone. Send it in writing. The legal way - registered mail, track it, request the changes and provide copies of the relevent paper work.

iPhones with later firmware lock up a lot; apples fault, bad software. I dont dare turn my bluetooth on, i'd never be able to answer it.

And for those who might want to chime in, my phone is carrier unlocked so i cant update to the newest firmware yet :P

Consent via coersion or intimidation "he had a gun, of course i said yes" is not informed consent.

But that will change. Now it will be "he had a tazer, of course i said yes". Because.... you know... a Judge in Niagara Falls said its ok to tazer people to compel them.

lots of consented searches get tossed in court. The man above is right, even if they find something it will likely get thrown out. Consent is usually determined to have been given under duress. (The guy had a gun, how could i say no?).

All i can say is, at least they were nice enough to ask.... Niagara cops didn't even give me that.

i would have to argue that there was no stop.

The house in question was being monitored by police because of complaints with teenagers. Police were simply trying to identify people at the door.

They also retrieved the drivers licence from the car during the detainment in the police car.

after stopping in front of a house, turn car off, exit and walk up sidewalk, officer standing there asks for identification. Officer was asked if he was making an arrest, replied that yes he is now.

After arrest and short stay in rear of cruiser, was released and given ticket in thread title.

Easy win?

it hasnt been as bad lately, that was mostly back in the summer or fall. We still arent sure why NIagara Poilice stopped us but im sure i will find out tomorow. Usualy its the tint. if i want to testify, ie: give evidence via testimony, im sure the crown will x-examin me, question me etc... who can question me for the defence?? When i am asking the questions, how do i refer to myself when umm... refering to myself?

Example question:

There isn't a written script that they'll follow, every stop is different. There are general procedures and officer safety considerations that they should adhere to. That said, opening the door without first telling the driver is a bit odd...

this must be a pretty big one for tickets. I dono how many times i've almost hit someone cause the guy behind me turns into the far lane and is in a bigger hurry than i am. I always use the closest lane and then change immediatly after i turn if there was no traffic. I can usualy tell if the guy behind me is going for the far lane to get around me ...
