Re: Stop Sign-First appearance- Error on ticket. Chance to win?

Not weird. Some prosecutors and even some JPs help people by pointing out that there are truly good lawyers and paralegals that the court is very familiar with.

You got some great free advice from the lawyer. Consider following it.

Don't show up at trial. Under s. 9.1 of the POA the ticket cannot be amended if you don't show up. The incorrect ...

There's more to this. Are you saying you have both an Ontario and Quebec licence? What licence # did he copy from your ownership?

Re: Speeding 22km/h over the posted speed limit.

While this thread has gone on to other topics, I'll post on the original issue of your ticket.

1. You were speeding.

2. Read #1 again. It is an absolute liability charge at the moment and no excuse or explanation including "hey, everybody's doing it", or an analysis of variable rates of velocity, or distance between chevrons, or what lane you ...

Re: Additional info

There are no signs posted (Describing each lane functionailty) above near the traffic light is or on the side road.
The only sign is on the road itself, only an arrow pointing forward.

May be I should take pictures of the missing signs.

Do I have a case here too?

You do not have a strong case at all. However here are a couple of points to ...

Re: Bad Drivers?

"Gentle flow of traffic"??!?? In the GTA it starts out with "every man for himself" until they see the cruiser, then it's "Oh please let it be the other guy!"

But I do like your imagery. Next time I go to my "happy place" I'll picture the gentle flow of traffic, like a babbling brook in a pristine amazon forest. The sound of blue and orange macaws ...

Re: Obtaining 3rd Party information

If you are fighting your ticket, you can request all this information through disclosure (and avoid the fee!)

Or you can contact your insurance company, if you went through them, to see what information they have.

Re: Case Law Update

In R. v. Brown the court stated:
the applicant submitted that where speeding is the only allegation within a charge of stunt driving, there is no conceivable due diligence defence available. With respect, this Court declines to speculate on possible defences. In my view, it is this Courts responsibility to simply acknowledge that a due diligence ...

Case Law Update

Just surfing Canlii and came across two recent decisions.
R. v. Brown, 2009 ONCJ 6
R. v. Sgotto, 2009 ONCJ 48

Some people had argued that s.172 violated the Charter because it was an absolute liability charge with the possibility of imprisonment contrary to the Supreme Court's interpretation in R. v. Sault Ste Marie and B.C. Motor Vehicle Act ...

Re: Insurance Issues...

Squishy i am going to have to agree with you on that.

As far as gas prices go even if the highways didn't have a limit like the autobahn system there is no way i would max it out all the time.

The gas begins to cost way to much at speeds like that. Even if we had no speed limits many would not "max out" due to gas prices and costs.

I remember ...

Re: Insurance Issues...

I.E. AIG made some bad investments and needs a bail-out.

AIG did more than that. They were underwriting a lot of the subprime mortgages and other high-risk things that the Wall Street "experts" were hyping as good ways to make money. They weren't strictly an insurance company, in that they had several divisions in addition to their insurance ...

Re: Stop sign questions

Just a couple of points I want to clarify. First there is no 3 second rule, that was something your driving instructor used to convince you to come to a complete stop.

Second, there are two elements to stopping. First come to a complete stop and second, proceed with caution. Just because you stopped does not give you right of way.

And finally ...

Just saw Squishy's post and he's probably right about the no by-law required. I'm terrible at estimating distance from memory. I thought it was long enough but likely less than 150m.

Change of strategy. First, the section we are referring to is here .

I still think fighting should at least produce a reduction in the ticket. Also, likely no one ...
