I'm seriously thinking about abstaining. We've got three great candidates and frankly I would be happy with any and all of them.

If we really have to vote then the candidates should answer the same question, respond to the same test or complete a skill testing assignment so that we can tell them apart.

You can be more aggressive with your disclosure requests. You can ask for a list of witnesses, will say statements, even contact information of all witnesses prior to trial.

Unless the officer is an accident reconstruction expert, the Crown will need at least one witness to testify about what happened. The accident report does not carry much ...

Carefully reread your notice of motion.

The charge you have is before the court and it cannot be amended or changed without the court's consent. Likely there is a court date on April 29 to hear a motion to change the charge to careless driving.

It's fairly straightforward to do. You have to file your appeal within 15 days. Then request a transcript. In Toronto, you then wait a year and shell out about $80 before you get it (3 copies).

When it's finally ready, you submit the transcript to the prosecutor and the clerk of the court. They'll only schedule a trial after getting the ...

The fax numbers I have are: 416-338-7703 (Prosecutor) and 416-338-7700 (Court House). Just double check my numbers especially for the clerk of the court. You don't want to blow it over a simple mistake.

Congratulations! No conviction is a win no matter how you get it.

Usually they schedule defendants to appear 30 mins before court starts. That way they can poll the court to see how many are contesting the charge and how many will cave. They also have time to do some last minute negotiating.

Hindsight is 20/20. A stay application 15 days in advance of trial would have stopped their disclosure in its tracks.

The amount of time it took them to process your disclosure request is long but not unusual (Toronto takes a minimum of 8 weeks).

The amount of time to go to trial is just over 10 months which is not unreasonably long.

Hold on. Brian never stated he drove while drunk. He did say that the Dr.'s report triggered a license suspension for seizures. So ease up on the preachy stuff.

I've got to dissent on this one. S 159.1(1) is slow down and S 159.1(2) is slow down and move over. Slow down is not an option, it's mandatory. At 90 km/h, this is not a sufficient reduction to the posted limit. It may have been a significant reduction to what you were driving but that doesn't matter - you were speeding before.

They can't raise the ticket back up to the original speed limit. The insurance implication as Racer suggested is what you need to worry about. The cost of fighting the ticket (time off work) may not be worth fighting the charge.

p.s. Don't you need a GST registration number before you can charge GST?
