Thanks for the input. Even if there is a 1% chance that the "infraction" was captured on tape, it still leaves video evidence of the encounter [regardless of how "complete" it is]. My understanding is that the Crown has the responsibility to disclose this evidence,

The case law you mention is regarding a continous recording video system that overwrites itself every 72hrs. That system is completely different than in cruiser video, so therefore...
Reading what you posted it would be "rare" as in maybe 1% chance or less that the offence will be on video. Reason I would say that is that the video is "activated ...

. There were simply cars in both the fast lane an d the shoulder lane and my daughter decided to switch into the slower lane because the car in front of her was going below the speed limit. She had hardly gotten into the shoulder lane when she came upon the officer.
wow...the other cars in "fast lane" slowed down as they had seen the officer ...

By the photo, doesnt appear the cruiser even has damage on the rear, so wasnt going that fast. Maybe 5-10km/hr, which does not seem unreasonable.

I was unaware at the time that I was supposed to have a BAC of zero, as the MTO doesn't send mail out when they make changes to the "law". Apparently this law came into effect on August 1st, 2010 along with the Novice Driver Escalating Sanctions

I don't know any way you can avoid the suspension, it's mandated by law and not at the discretion of ...

on several occassions, I have only remembered the date and told the court my evidence is based solely on my notes, my only independant recollection was I worked on that date, my notes reflect that, and make notes shortly thereafter the incident. Never been an issue in court.

The "charging" document before the court is the original ticket.
The "notice of trial" is just that, notifying you of a trial. Simply whomever typed in the "notice of trial" forgot the "1" in "19" and the computer defaulted to the other wording.

Depends what it looks like.....blue preprinted with hand writing on white, I would say that should be original that is filed with court.

but just got thinking, some places have computer tickets, so white version could be actually "your copy".

HwyBear, I seem to remember reading a post from you a while back, that indicated demerit points stay on record for 2 yrs from the date of conviction. Which is correct: date of conviction or date of infraction?

o a copy of both sides of the officers copy of the ticket (Notice of Offence); Here there is no back to a ticket as it is all elecronic

We are not so computer era here and still hand write the PON. However, still a redundant thing to ask for.
Front of police copy = will be the same as your yellow copy you got in your hand and same as white ...

Is this as simple as having the officer on the stand and asking them what they saw, knowing they did not witness anything?
Or do we need to do more?.
This is the same as every other collision, officer will be able to provide, vehicle/driver information and pedestrian info. The pedestrian who was struck will give the evidence of being struck etc ...

The officer did provide me with an incident number. Should I have obtained a copy of my statement or the other drivers statement ?
The incident # is all that would be provided at a scene. If a Traffic Report (collision report) was done at scene, you still would only have the basics (location, driver, vehicle info) and no statements.

Today, While i was driving along a street which required me to make a right turn (without a street light) I advanced to cut in front of another person to make the right turn because it merges into one lane.

as per you post above = lane cutting

You know of a right turn ahead....why not wait 3-10 seconds and go in behind the person that is ...

. While I was waiting for my turn, I saw the prosecutor leaf through my package, smile and show it the officer...... In retrospect, I'm thinking the prosecutor was simply asking the officer if he was willing to fight it or not...

It is not up to officers to go to trial or not......most likely showed the package to the officer ...

Or Subaru was in the proper lane, took evasive action to its left as it seen someone cutting out from the right. Then the Subaru got pushed that much further over as it was struck on the side.
