They ticket was issued to the owner of the vehicle, so your father in law will be listed as the defendant in this matter. Also have you talked to your school to see if they can schedule you a make up exam? If you bring them the notice of trial they may be willing to give you your exam on a different day.

I think he may have been referring to the fact the ticket was issued based on the evidence of a civilian witness. Often witnesses who aren't police don't hold up well in court, they are inexperienced at testifying and often forget key details and they can also be easier to trip up on cross examination. Since this offence won't affect your insurance, the only real issue is the fine. It might still be worth booking a trial date and seeing if you can work out a plea deal with the prosecution for a lower fine. Dangerous driving isn't a Highway Traffic Act ticket but a Criminal Code charge. The document you were handed isn't a ticket but more likely an Appearance Notice with a court date to appear in criminal court. This offence does carry points, however if all you want to do is keep the points off your record I'm almost certain that you could plea bargain the ticket down to 15 over so that their would be no points. Unless their was a stop sign I believe you are only required to yield when exiting a private drive, I was always taught that if the way is clear you can go without stopping.

Unfortunately all tickets also come with $5.00 court fee on top of the fine and victim surcharge, so the $40.00 total is correct. As for whether it is worth fighting or not depends how much effort you want to expend on a case you might not win. Someone might correct me but I believe even with a dash cam video the officer still has to take the stand and testify. If this goes to trial it will give you an opportunity to cross examine him about what he says he saw versus what is on the video. I'd probably go with a paralegal, they are cheaper then lawyers and for traffic matters are usually just as good. Check out a couple different firms and see which one you like the best.

I would pick option 3 and request a trial, this option gives you the most flexibility. If you decided later on that you don't want a trial after all you can always change your mind and make a deal with the prosecution for a lower charge or plead guilty. From your description Careless Driving sounds like an excessively high charge, I would fight it. At the very least you can probably plea bargain it down to a less serious charge such as "Change lane not in safety" which sounds like a more accurate description of what happened. Technically I believe a Part 3 summons could be issued for any offence under the Provincial Offences Act, even minor stuff. However Part 1 tickets are preferred for most minor offences because if officers issued Part 3 summonses for everything the courts would not be able to handle the backlog.

A parking ticket won't effect your insurance so you would only be out the $60.00 if you paid. On the other hand you have sure fire win if you fight it. Do you get paid vacation days? While the cop has to submit a regular ticket issued under part 1 of the Provincial Offences Act within 7 days, he has up to 6 months from the date of the offence to serve you with a summons issued under part 3 of the Provincial Offences Act. Fortunately red light camera tickets do not show up on your driving record and have no demerit points attached to them. Since there is no entry on your driving record your insurance company will not find out about it. Still it is a $325 fine so it may be worth your while to speak to the prosecutor to see if they are willing to lower that amount.

It looks like the officer did give you his copy of the ticket, so it is possible that the ticket was never filed since he didn't have a copy to turn in. I would call the court house listed on the back of the ticket and see if they have any record of that ticket ever having been filed with them. If the ticket is not on file then you are probably off ...
