Re: received ticket in illinois. first time in the states :(
Suspended registration means that your car will be considered unregistered in Illinois until your fine is paid. If you, or anyone, gets caught driving that car in Illinois it will be towed away and you will get another ticket for driving without valid registration. Changing your plates form Ontario to Alberta might throw them off if you get pulled ...

Re: Too much reasonable doubt!! Opinions?
I abandoned the fatal error notion a while ago. Yes I am looking for specific answers that favour my case. For example, does a police officer need to maintain a line of sight with a vehicle to give the driver such a hefty charge?

Re: Handicap Parking ticket - Parking without transporting
They ticket was issued to the owner of the vehicle, so your father in law will be listed as the defendant in this matter. Since he has passed away I don't think there is anything they can really do to collect the fine. That having been said, I would still have the executor of the estate attend court with a copy of the death certificate. He can ...

Also have you talked to your school to see if they can schedule you a make up exam? If you bring them the notice of trial they may be willing to give you your exam on a different day.

Re: tricks to fight a ticket for failing to stop for a schoo
I think he may have been referring to the fact the ticket was issued based on the evidence of a civilian witness. Often witnesses who aren't police don't hold up well in court, they are inexperienced at testifying and often forget key details and they can also be easier to trip up on cross examination. Also, as admin mentioned, a non-police witness ...

Re: Defense for disabled parking ticket? Help!
Since this offence won't affect your insurance, the only real issue is the fine. It might still be worth booking a trial date and seeing if you can work out a plea deal with the prosecution for a lower fine. Since you don't have a history of this type of offence you will probably have a good chance of getting the fine reduced, also showing that the ...

Re: Dangerous driving charge
Dangerous driving isn't a Highway Traffic Act ticket but a Criminal Code charge. The document you were handed isn't a ticket but more likely an Appearance Notice with a court date to appear in criminal court. Since most of us here aren't very familiar with Criminal Code charges and the results of a conviction can be very serious I think the best ...

Re: 67 in a 50 zone. $42.50 fine
This offence does carry points, however if all you want to do is keep the points off your record I'm almost certain that you could plea bargain the ticket down to 15 over so that their would be no points. The best way to do this is to book an early resolution meeting with the prosecutor and ask them if they will reduce the charge to 15 over or less ...

Re: Do you have to stop before exitng private drive onto roa
Unless their was a stop sign I believe you are only required to yield when exiting a private drive, I was always taught that if the way is clear you can go without stopping.

Re: Speeding 60km/h in a 50km/h zone ---- fatal error?
Unfortunately all tickets also come with $5.00 court fee on top of the fine and victim surcharge, so the $40.00 total is correct. As for whether it is worth fighting or not depends how much effort you want to expend on a case you might not win. Also was the ticket reduced from a higher speed, because if it was, they can request that it be amended ...

Re: Fail to obey stop sign HTA 136 a (with video evidence)
Someone might correct me but I believe even with a dash cam video the officer still has to take the stand and testify. If this goes to trial it will give you an opportunity to cross examine him about what he says he saw versus what is on the video. The only case I'm aware of where an officer doesn't have to testify is when an automated red light ...

Re: I was wrongfully accused!
I would call them before doing anything else, and see if this is a problem that can be solved over the phone. In many jurisdictions the city clerks are allowed to cancel tickets themselves if there is an obvious error. Even if you have to go to their office in person there is still a good chance that the clerk will cancel the ticket if the make of ...

I'd probably go with a paralegal, they are cheaper then lawyers and for traffic matters are usually just as good. Check out a couple different firms and see which one you like the best.

Re: Careless Driving: help please....
I would pick option 3 and request a trial, this option gives you the most flexibility. If you decided later on that you don't want a trial after all you can always change your mind and make a deal with the prosecution for a lower charge or plead guilty. For now request a trial and then wait for your court date to come in the mail, once it does make ...

Re: Careless Driving: help please....
From your description Careless Driving sounds like an excessively high charge, I would fight it. At the very least you can probably plea bargain it down to a less serious charge such as "Change lane not in safety" which sounds like a more accurate description of what happened. Since Careless Driving is a pretty serous charge, it might be worth it ...
