Re: Incorrect set fine, incorrect total payable
I had the same issue with a fail to stop read light ticket, the JP did not notice the error and I had to appeal. That having been said the appeal process, at least for me, went relatively smoothly and the applet Judge entered an acquittal in my case.

Re: Summoned 10 years ago. No suspension 10 years later?
It is hard to say what happened, maybe the courts or the police service lost your paperwork somewhere along the way. Either way as long as MTO says your licence is valid you are probably OK on that front, and if you've been stopped for speeding since then, I'm guessing there is no warrant out for your arrest or the cops who pulled you over would ...

Ok, let's say for "argument's sake", that there is a discretion. Any idea who I could contact to plead my case to at the MTO. Or would it be any office?
Unfortunately there is nobody to call at MTO because nobody there has the power to rescind the suspension. The way to ask for leniency would have been to plead not guilty to the charge and then ...

I took a look at the cities website and could not see it either. You might be able to find it somewhere in the public library system or you may have to get a copy from the city clerks office.

Re: Is this a fire route?
I think the curved yellow line is there simply to keep people from driving too close to the last parking space in the row. As for the parking ticket, parking enforcement can come on to private property without the owners permission to enforce handicapped space and fire route violations. That having been said it is unusual for them to proactively ...

Re: Failure to Stop - Red Light (Yes, yes, another one)
I think your best bet is to pick option 3 on the back of your ticket and request a trial. Once you have received a court date you can file a request disclosure, this should get you a copy of the video as well as the officers notes and any other evidence they have against you. This link has a good little primer on how to go about requesting ...

Re: drive under suspension
The maximum penalty you could face would be a $5000 fine and 6 months in jail, although I doubt they will be that hard on you considering this is a first offence and you have already taken steps to resolve the issues that lead to your suspension. Your licence will also be suspended for an additional 6 months. When you do get your licence back you ...

Re: court will notify 3-6 mo. about court DATE
If you don't get a court date after 3-6 months I would check with them to make sure your notice of trial did not get lost in the mail. If the notice does some how get lost in the mail you could miss your court date and be found guilty by default. If that happens you would have to apply to have your case reopened which means more trips to the court ...

I just wanted to let you all know that I had my day in court today and, thanks in no small part to the helpful people on this board, I won my case. Well my court date is on Monday, I think I have a pretty good grip on what I need to do and I think my case is actually pretty straight forward. I'm not sure about the mall kiosks, but you can order them on-line through the Ministry's website. You have to pay a user fee, but then the system will e-mail you a copy of your abstract.

I would do as the others have suggested, get disclosure and see what the officer's notes say. Once you have his notes you will be able to better judge what kind of defense you might have. If you have time do a case law search as well and see if there are any court decisions regarding the use of S.182 (2) for parking offences. I don't know if their ...

Re: Received suspension because notice sent to old address.
The reason most of the mail for your ticket went to your old address is that tickets are processed through the Provincial Offences Court in the municipality where you got the ticket, not through the Ministry of Transportation. So changing the address on your licence with the Ministry of Transportation doesn't do anything to tell the Court that is ...

I'm quite familiar with this area and what you are seeing here are signs for what is called "alternate side of the street parking". Most of the houses in this neighborhood don't have driveways and it was decided at some point that it was not fair for the houses on one side of the street to always have to put up with large numbers of cars being ...

If the parking space did not have a vertical sign then you may have a case as it looks like Reg. 581 of the High Way Traffic Act requires that there be a posted sign not just markings on the pavement. Here is a link to the regulation: http://www.e-laws.gov.on.ca/html/regs/e ... 0581_e.htm

If it were me I would go with either a paralegal or an attorney that specializes in traffic law. Criminal lawyers don't spend much time in traffic court so they won't have a lot experience dealing with this kind of case. Interesting I thought that unauthorized parking on private property was only $30.00 in Toronto. However I haven't looked in a while so it is possible they have increased the fine or added some kind of fee for tickets that go into default. Still before you pay that notice I would call parking tag operations at 416-397-TAGS (8247) and double check ...

Just like for example a liquor inspector can demand that an establishment that is selling liquor present a valid liquor licence or a Ministry of Natural Resources officer can demand ...
