Re: Fail to Stop for School Bus- Owner - 175 (20)

If you seek representation for this charge, any respectable place will usually turn you down. It usually costs more to hire someone than the ticket is typically worth.

Your average ticket may come with demerit points (if that matters to you) or the possibility of an insurance increase. Since the threat of added expenses may follow you even after ...

Re: 102 in a 50 reduced to 90

Following traffic isn't a thing. It's insignificant to the charge.

Yes, an officer can walk up to you and issue you a ticket. It doesn't matter if you turn off your vehicle and stand next to it. The officer was probably exercising some caution because he was dealing with an individual on a motor bike.

Use some caution when deciding how far you ...

Re: Ticketed for - Improper right turn at St.Paul's Square, Toronto

I don't know off the top of my head if there's any reduction available for this charge as it's pretty low as is. It doesn't cost you anything to try though, other than your time.

I wouldn't put too much thought into the points. They last 2 years from the day you got your ticket and then they disappear. Since you need a ridiculous amount of them in ...

No.

Re: Court Convicts Driver for using Apple Watch

Interesting read. Here's the CanLii link .

Here's some highlights:

Despite the Apple watch being smaller than a cellular phone, on the evidence it is a communication device capable of receiving and transmitting electronic date (sp?). While attached to the defendant's wrist it is no less a source of distraction than a cell phone taped to someone ...

Re: Disobey Sign HTA 182(2) No Right Turn 7-9am

billiards15 brings up a good argument.

If I were to take the opposite position, i'd say the last sign supersedes the previous one. If you can't turn, the road is essentially closed and merge as need be back into traffic. The right turn can't be completed as intended.

Still a bit harsh though either way.

Hopefully some others can chime in.

Re: Disobey Sign HTA 182(2) No Right Turn 7-9am

There's quite a few arguments in your post, so forgive me if I miss any.

- It's not a defence that another moving vehicle blocked your vision of the sign. No turn signs in an intersection are placed adjacent to the signal head. If you didn't see the sign, you didn't see the lights either. So are you proceeding through intersections blindly? That's ...

What are the chances that my license would be suspended?

For a first time offender at 152, you're in the best situation you can ask for.

Varying fines are usually there for individuals who wont learn their lesson or break speed records.

Also, would the insurance company see the stunt driving charge if the prosecutor agrees to lower my ...

Re: turning left into plaza entrance

Agreed. Anyone who turns their vehicle across traffic is required to do so in safety.

The blinding sunlight defense gets brought up quite a bit on these forums. If we're being honest, it's a bit of a crutch for user error. If your vision is so impaired that you're turning into oncoming vehicles and creating accidents, then perhaps pull over ...

Re: 144(18) - Proceed Before Green - Early Res Question

Short answer: Bicycle tickets do not show up on your license and are not subject to demerit points.

Long answer: The Highway Traffic Act defines a bicycle as a vehicle. There exists a separate definition, motor vehicle , which covers your standard car. Motor vehicles are subject to demerit points while vehicles are not.

Court convictions are ...

Re: Donuts in an empty parking lot

If a police officer didn't appear, the chances of being charged are slim to none.

If you were to be charged, it wouldn't fall under the highway traffic act. Obviously, an element of the charge would require the act take place on a highway.

Whatever the charge may be, it would come from somewhere else. For example, there's Dangerous Operation of a ...

Speeding is whats called an absolute liability offense. Basically, that means you were either going the speed limit or you weren't. There's no in between.

Because of that, your argument isn't a valid defense.

Re: Speeding ticket in Quebec with Ontario Drivers License

Ontario and Quebec have a reciprocal agreement and speeding is covered in that.

Once you're convicted, it will be no different than getting a speeding ticket in Ontario. The MTO will then apply demerit points as if it happened here.
