From your description Careless Driving sounds like an excessively high charge, I would fight it. At the very least you can probably plea bargain it down to a less serious charge such as "Change lane not in safety" which sounds like a more accurate description of what happened. All a muffler does is reduce noise. It has zero bearing on co in the cabin either. It does nothing to filter and or reduce exhaust gas ouput. Its for sound suppression(And the laws on that are weak at best too)
