As a former Toronto and Ontario Provincial Police Officer, Level 2 Accident investigator, with 28 years experience, and 10 years as a paralegal. My opinion is that it's on private property. The Highway Traffic Act unless specifically specified does not apply to private property and the charge should not have been laid.

I got a ticket coming home from class today, on Main st Markham /16th ave. The fine is for $42.50 and I'm wondering if it's worth fighting. The $40 isn't too bad but I read that going 16-29 over the limit is 3 demirit points, so that makes it 17 over for me... As someone has already stated, a red light violation is an absolute liability. What this means is the red was either red or it wasn't. There is no in between, little bit red, couldn't see past the truck, or couldn't stop in time. It sounds like something was lost in translation.
