HOV lanes are clearly marked. They are usually marked both with signage and road markings in the form of a diamond. It's usually marked every 100 metres on the pavement. It's your responsibility to know how to read Ontario road signs when you get behind a wheel. While it may have been an honest mistake, ignorance is not a valid defense.

All I'm telling you is I've never heard of it. The officer would have to have enough evidence to proceed with a charge. The system allows you to challenge that in court. We have many policies and procedures but not for every conceivable action that we might take. That's where common sense comes into play.

Adding further, devices are to be mounted or securely placed in your vehicle for button access. Using a headset that requires touching to turn on is also OK. Holding the device in your hand, if that's what happened, is going to be another argument against you.
