This area is a radar spot. The officers wait under the Queens Drive bridge and point probably 1000ft ahead as the limit goes from 100km to 70km. There's nothing spontaneous about being pulled over here.
How prepared are you really for trial? Have you requested disclosure or not? They aren't going to send it to you if you don't ask.

Re: Fatal Error
The difference between no location (Fatal) and incorrect location (non-fatal) is that incorrect location is at least plottable on the map. Make an argument that this is no location because it cannot be plotted on the map.
Your ticket has the name of the street and that is suffiecent enough for a ticket. The disclosure should have more details ...

Re: Out of town trial, no disclosure, trial April 11?
Now..can I request for disclosure via mail again because its not his job to send me the documents..?
Definitely not. If he's not good enough to pick up the disclosure, he's not good enough to represent you. Therefore, your trial should have continued as usual and you should have been found guilty for no showing. I suggest you prepare to defend ...

Re: 68 kmh in a 50 - Reduced - Pacing - Too much Doubds
I explained that it couldn't be so that maximum what I could be doing is 68kmh and it considering that I accelerated when I entered a 60 zone.
You made a pretty big mistake here. I don't know why you'd incriminate yourself like that. Whether you're doing 68 in a 60 or a 50, you're still speeding. Accelerating into 60 zone from a 50 isn't an ...

Re: Out of town trial, no disclosure, trial April 11?
What if the officer did not show up? Is there anyway he would be able to find out this information and get the charges dropped?
It depends on the prosecutor. I've seen prosecutors who will drop the charges and move on if the officer isn't available. I've seen prosecutors who will pretend like the officer is there and go through the whole ...

Re: Out of town trial, no disclosure, trial April 11?
Ask for disclosure at the trial? Sorry that doesnt make sense?
Yes. 6 weeks isn't an unreasonable amount of time to wait for disclosure. It's not going to be considered anyone's fault. They will likely have disclosure ready for you at the trial that you can pick up. They will reschedule your trial to another date.

Re: Speeding 90 km/h in 70 km/h zone (Reduced)
I did pull over before he put on the emergency lights, but I saw the officer pull out of his spot under the overpass and I thought I heard a siren so I proceeded to slow down and move to the right. I'm not sure if pulling over in itself would be treated as admitting guilt, but if it is, I would like the community's advice on how to proceed ...

Re: Company vehicle and insurance rate
Since it was a company vehicle I was driving, will my personal car insurance rate go up due to my speeding ticket?
The tickets are charged against the number on the license of the offender. At the end of the day, the vehicle you were driving has no factor on what shows up on your driving abstract. It'll show on your abstract when convicted (eg ...

Re: Car pool lane mistake
HOV lanes are clearly marked. They are usually marked both with signage and road markings in the form of a diamond. It's usually marked every 100 metres on the pavement. It's your responsibility to know how to read Ontario road signs when you get behind a wheel. While it may have been an honest mistake, ignorance is not a valid defense.

Re: Can I appeal after I was found guilty and paid the fine?
I'm going to agree with what was already said.
Your appeal will not be "trial 2.0". It's not an attempt at proving why the was officer wrong when he issued you a ticket. An appeal is your chance to prove that for some reason, you weren't given a fair shot at a trial. There's many reasons for this, but change of heart isn't one of them. It doesn't ...

The 401 was filled with big trucks and I was nervous and attempted to take them over and had to speed.
I suggest you get someone to represent you and never repeat this statement in court.
Also, on the summons to defendant note, the office wrote the date wrong. he wrote Issued this day: 25 Feb 2013 where it should have been March.

Re: Not sure what to do, looking for advice
I was ticketed early December on the 401 near London and to-date have not received a notice of trial. I promptly sent my request for trial <15 days after the incident and I requested a signature upon delivery (which I have). What should I do, wait and see, or should I be proactive and call the Provincial Offences court in London to see if I have a ...
