This area is a radar spot. The officers wait under the Queens Drive bridge and point probably 1000ft ahead as the limit goes from 100km to 70km. There's nothing spontaneous about being pulled over here.

How prepared are you really for trial? Have you requested disclosure or not? They aren't going to send it to you if you don't ask.

The difference between no location (Fatal) and incorrect location (non-fatal) is that incorrect location is at least plottable on the map. Make an argument that this is no location because it cannot be plotted on the map.

Your ticket has the name of the street and that is suffiecent enough for a ticket. The disclosure should have more details ...

the speeding tickets that i have had over the years usually have sometype of cross street, perhaps not completely accurate but enough where i could find the actual place or at least plant it on a map. i got on bayview from leslie I believe and went southbound and southbound bayview from there runs several kms...changes speed many times ...

I explained that it couldn't be so that maximum what I could be doing is 68kmh and it considering that I accelerated when I entered a 60 zone.

Yes. 6 weeks isn't an unreasonable amount of time to wait for disclosure. It's not going to be considered anyone's fault. They will likely have disclosure ready for you at the trial that you can pick up. They will reschedule your trial to another date.

HOV lanes are clearly marked. They are usually marked both with signage and road markings in the form of a diamond. It's usually marked every 100 metres on the pavement. It's your responsibility to know how to read Ontario road signs when you get behind a wheel. While it may have been an honest mistake, ignorance is not a valid defense.

Your appeal will not be "trial 2.0". It's not an attempt at proving why the was officer wrong when he issued you a ticket. Actually, I just checked my ownership document, and although my car is dark metallic green, it says "GRY" on the ownership. DOH!

Even if it said "dark metallic green", it wouldn't have made a difference. An officer is not expected to to know every color code made by every car ...

All I'm telling you is I've never heard of it. The officer would have to have enough evidence to proceed with a charge. The system allows you to challenge that in court. We have many policies and procedures but not for every conceivable action that we might take. That's where common sense comes into play.

Adding further, devices are to be mounted or securely placed in your vehicle for button access. Using a headset that requires touching to turn on is also OK. Holding the device in your hand, if that's what happened, is going to be another argument against you.
