last year i was caught driving on the highway at 134 and my licence was suspended for 30 days after getting 4 demerit points. this year i was caught on the highway again speeding at 152 and the officer reduced it to 145 (5 demerit points) and my court date is set for march 11th and i am meeting the prosecutor. Hello Members,
I drive Tractor Trailer (LTL in GTA) I recently set up a make shift Video camera on my passenger side windshield. I have seen to many of my fellow drivers fall prey to the MTO, and those MTO inspection stations that you pull your trunk into, can tear up your world in no time.

Can you provide any authority for this? Because lots of people here can provide plenty of anecdotal experience that this is NOT true.

Re: Need Advice: Trial in 15days..is it too late to request
My wife told her that we didn't get a response to the disclosure request.. and almost immediately, the prosecutor asked if we wanted a new trial date (which is what we wanted). That set off some alarms, and my wife replied that she will have a look at the disclosure and let her know. The fact that the prosecutor was readily agreeing to change the ...

You will definitely be offered something in between 16-29km and 3 demerit points. I don't know how willing they are to go down to 1-15km and 0 demerit points. It depends on the prosecutor, but I wouldn't get my hopes up.

Does anyone know if the infraction I was charged with is serious, in terms of car insurance notification? I can't be deducted demerit pts with a by-law, correct?

not perfectly sure if it applies... but from what i can see from what you say, if you are not in violation of that Act, you can easily fight the ticket. If the officer has charged you with violation of a different act then we'd need to look into that further. :)

Just so you are aware, you are a novice driver who falls under novice driver sanctions. Careless driving comes with a 6 demerit point penalty. Since it is a single offense carrying 4 or more points, your license will be suspended for 30 days. It's something to consider if by chance ...

How do I verify how many demerit points I have. I got a speeding ticket in Alberta a couple of years ago but am unsure as to whether it's still on my record.
You can order a your driving abstract online and get it immediately in a pdf. Demerit points in Ontario last two years from the day you received your ticket.

What if I say I did stop, then use the two photos to contest the officer's notes that claims 1) he had an unobstructed view (I can question him if there is anything else between him and the vehicle), and 2) the stop signs were unobstructed and clear in all directions. Would that be sufficient to prove reasonable doubt?

No. The officer is in his right to write down anything he chooses, whether you believe it is right or wrong. He did not gather that information by breaking into your garage or getting a statement against your will. If you believe the officer is wrong in his notes, I suggest you use that information against him in your defense.

That was what I was afraid of. From my side it seems unnecessarily rigid, allowing me to be 100% at fault even though car A was the one either distracted or following too close. Is it at all possible someone has challenged this type of ruling?

I abandoned the fatal error notion a while ago. Yes I am looking for specific answers that favour my case. For example, does a police officer need to maintain a line of sight with a vehicle to give the driver such a hefty charge?

Due to the position of the Sun which was directly ahead, the video doesn't show the color of the lights when my car crossed the line. In my mind, I crossed the white line before the light turned red. To me it reads a bit more like the latter scenario, which might changes things quite a bit.
