Re: Introducing evidence to court
I reveiwed that case. It seems as though the manual is still allowed, you just have to petition the police for it.
[34] The position taken by the respondent is that any ruling that results in agents being required to commence an O'Connor application every time the testing procedure is sought would impair access to justice and clog up the courts ...

Re: Careless Driving charge
Some more details of what happened would help but it sounds like you strayed into the incoming lane.
Alternative charges could be Failure to Drive in Marked Lane, Failure to Turn Out to Avoid Collision.
While a conviction doesn't help the civil liability prices is a different one. It sounds like you won't really have a leg to stand on when it ...

Read the link provided by Decatur. It speaks specifically to O'Connor.

Tickets from the police and 'at fault' from the insurance company are separate items.

I'd be contacting the insurers and taking direction from them as they're the ones going to be paying out if the judgement is unfavorable.

Why are you dealing with this ? Surely this is between her and your insurance company.

There's nothing personal about the officer turning up. It's his job and, in many detachments, he'll get in trouble for not doing so.

This is a tough one to beat. Either the car was registered or it wasn't. I do feel for you though. I've borrowed vehicles from friends and never demanded to see the paperwork. Certainly I should have but you just assume.

Re: Novice Driver BAC above zero G2
What is it that you think you don't deserve ? As a new/young driver the law doesn't have a threshold where your ability to drive is impaired as it does for older/more experienced drivers - it sets the limit at zero.
You chose to ignore this, rolled the dice and lost.

Re: Reviewing Disclosure for Stunt Driving Ticket
There is no point in going for atrial unless you have a chance of winning. (f you know you are going to lose then ab solely plead guilty. You will be given a chance to address the judge before they pass sentence and this is where people get it wrong - they try to explain why they were speeding (for example) rather than just showing complete remorse ...

Re: Disobey lane sign
I would think that was a logical explanation. Either the officer or someone else at the station noticed the wrong date and binned it. They could serve you a replacement ticket but the chances of that are essentially nil.

These are hard tickets to fight. She did park without a permit and didn't have the sticker. Your best bet might be to see if the court will let you plead to one and have the other dropped.

Re: (Photo Radar) Bill 65-Safer School Zones Act
That is true but as they are in big yellow boxes everyone assumes that there is a camera in each one and therefore doesn't speed. The thing that they are using now which is very successful is average speed monitoring over stretches of roads. You get an average speed limit of 40 mph on a motorway for roadworks and EVERYONE slows down....otherwise ...
