If you are going to plead guilty but ask for a reduction in the fine amount and perhaps ask for time to pay then it is option 2 that you want. The Crown will rest their case and before you start to give the defence evidence you would make the application. You do not have to disprove the offence, the crown needs to prove it. If they have not covered the elements of the offence then the case should be dismissed.
