Re: (Photo Radar) Bill 65-Safer School Zones Act

I do agree that some municipalities focus on the tax revenues from speeding tic kets as opposed to the actual, safety aspect of it. In my last community there was a road that had a 60 km/hr limit on it when it clearly should have been an 80 zone. The rookie cops would just sit up there and drain their ticket books without actually doing anything for ...

Re: Ticket doesn't offer Early Resolution - speeding - Choose option 2 or 3?

If you are going to plead guilty but ask for a reduction in the fine amount and perhaps ask for time to pay then it is option 2 that you want. You would have to appear in court or have someone do it your behalf so you have to balance up the cost in appearing versus the reduction that you might get.

It isn't the demerit points that matter to ...

Yes, it could be that the best that you get is a charge for the other driver as well. You still turned across a lane where there was a vehicle moving.

It's a tough one for sure and I have no doubt I would feel as aggrieved as you are.

Re: Failure to Yeild right of way from a Driveway

You haven't provided anything in your narrative that would form the basis for a defence. The other car had the right of way and you got in the way. It can be tricky when there are stopped cars in one direction but the onus is on you to be certain before pulling out.

You will take a huge gamble to go to trial if the full ticket will cost you your job.

Some of the things you have asked about would need legal representation and even then are likely to be unsuccessful.

That's tough. You're on the hook if something happens but I suspect you don't want to be the guy that rocks the boat.

I'd at least raise the question and ask formally how the company wants you to clear the snow and ice before driving. Puts the ball in their court somewhat.

Re: I didn't get a ticket, but need help on some research.

It is always the driver's responsibility to make sure their vehicle is safe before taking it out but it would be up to the company to provide safe and legal methods of ensuring that. How you would get your company to do that, or how they could provide you with something after snow accumulation out of their yard, I have no idea.

The 3m bit I found ...

Re: Court Tomorrow - Handheld Device

A few quick notes:

- I'm not sure what type of plea deal you are hoping for. There isn't really anywhere a Crown can go with this charge.
- A judge will give you time to pay if you tell them that you are struggling financially.
- If the police officer doesn't attend then the charge will most likely be dropped (sometimes they are rescheduled if the ...

No. You aren't causing doubt on the officer's credibility. They just made an error. If the vehicle didn't have a permit then it didn't have a permit. Almost impossible to beat.

Re: Fight driver no seatbelt ticket with due diligence defen

The Crown will rest their case and before you start to give the defence evidence you would make the application. You do not have to disprove the offence, the crown needs to prove it. If they have not covered the elements of the offence then the case should be dismissed.

1. Demerit points have no meaning until you accumulate a lot of them. For a single ticket there's nothing to worry about especially as you say you are a non-ticketed driver.
2. Unlikely. It's not like a sorting ticket where the speed was reduced.
3. No.
4. Yes but if you are going to trial they sing want a babe in arms in the stand with you ...

Re: Careless Driving Ticket Advice

This is a tough one. Careless driving is laid far too often in my option and is often used as a catch all knowing that people won't take it to court for fear of the very severe repercussions if they lose. So they speak to the prosecutor, get a lesser charge and the matter never goes to trial.

If it happened as you say, then I would doubt that a ...

If you scan and post the disclosure (with personal details redacted) then people can help with that.

It is your responsibility to slow down when the speed limit changes. Having someone behind you does not absolve you of that responsibility.

Yes, there is no doubt that the op should have stopped but the only way he is getting a ticket was if he was pulled over on the spot.

Re: Ticket for driving a friend's car with expired sticker

Insurance could care less that a validation was expired, doesn't make you a higher risk.

And you have a zero percent chance of winning in court, you could have checked it prior to driving it.

Having said that, your previous driving record might work in your favour and prosecutor might have some mercy, but not sure what you'd get it lowered to ...
