Re: Rules to over take street car?
I tend to stop behind the doors whenever a streetcar is close to a streetcar stop. If the doors are already open or if it is clearly stopped for passengers, then I stop before the rear of the streetcar. I'm not sure what the interpretation of the law is for your particular situation, but profanity is uncalled-for. If something similar happens in ...

Re: What should we do on the first apperance?
Thank you for the great tip. If the insurance company cancels her insurance, can I at that point provide such an exclusion clause to keep my insurance only (or instead I should act before that happens)?
Thanks!

Re: Woot Woot - It's Back - 2011 Chev Caprice
It looks like the Caprice will now be based on the Holden Statesman instead of the G8/Commodore. The Statesman is pretty close in size to the old Caprice and has monster rear legroom. I hear it is supposed to look like a bigger Impala, which isn't bad but somehow doesn't have the presence of a Crown Vic.

7. She is the second driver in our insurance right now. If she is found guilty, can I remove her from our insurance to avoid it being canceled or big raise by the insurance company? Re: Failed to Yield when turning right on red
Is there any other way to word the charge on the ticket for that section? POA Reg. 950 only lists the 'fail to yield' wording. An alternative is 'red light - fail to stop' but I think 144 (19) also fits, despite the wording on the ticket.

Why is that?
This topic recently came up with a friend of mine. The procedure I came up for her was:

2: Both windows down, rears also if tinted or have more than 1 rear passenger
3: Keys on dash, interior lights on
4: Tell passengers not to talk to each other and to keep ...

Re: Ontario Demerit Points System and What it means for you
Alright, let me try again with the definition. When you speak of "directly affecting" something, you are speaking of relationships. A direct relationship takes one step. Any more than one step and you have an indirect relationship.
Step 1: Oh no, 15 demerit points.
Step 2: License suspended.
Step 3 : Insurance company raises your rates.

Yes, it is REALLY indirect by the very definition of the word.
If I got a traffic ticket, I would not bother playing with the points as they do not DIRECTLY affect my rates. I would play with pleading to other charges based on whether they were classified as minor or major convictions, or had no affect on my insurance like many municipal ...

Re: Ontario Demerit Points System and What it means for you
Well here's a scenario: you are charged with a prohibited turn, 2 points. Counts as a minor conviction on your insurance record. You have a bulletproof case showing that at the time the offence occured (and ticket was issued), turns were in fact not prohibited (maybe you even have a dashcam in your car like Bookm's Lincoln and there happens to be a ...

FYI on the Improper Left Turn forum there was discussion on whether this is the wrong charge as D1 was turning into a parking lot / driveway (note that it is a signalized intersection/"driveway" and there is a road opposite the driveway) I'm not posting here to try again per se, but I just came across something on Ticket Combat that lists 141 (5 ...

I don't have any legal suggestions, but when you get new tires, make sure the old rear tires are rotated to the front and the new tires are put on the rear. If the tires are not directional, rotate them side to side when you do oil changes; if they are directional, you are stuck with that configuration until the tires wear out.

Re: parking infront of crosswalk/walkway, no sign
It looks like all No-Parking Zones in Guelph are only valid if a "Traffic Control Device" (sign) is displayed. I haven't read the entire document as the text size hurts my eyes, but that's what the wording of s. 36 and 37 makes it sound like.

A vehicle can occupy the entire lane (i.e., position as to prevent others from passing within that lane), but is there a law prohibiting two vehicles from occupying a single lane, side-by-side, if both vehicles are "consenting" (not staring daggers or hand gestures) and the lane is wide enough? I have seen signs put up advising not to drive side-by ...

Re: Failure to afford reasonable opportunity to avoid collis
At this signalized intersection there is a street opposite to the parking lot, and the parking lot driveway is more like an access road to various parking areas for a restaurant (where witness was), a liquor store, a book store, etc. No road per se (no name), but not just a driveway. Does this change anything or is it still wrong charge?

Re: Failure to afford reasonable opportunity to avoid collision
If the traffic control signal is just for the store's driveway, you might have an argument, but most signalised driveways are at a T-intersection where the driveway just happens to be on the other side. As long as two highways meet at the traffic control signal, it is an intersection, and turning left at an intersection is turning at an ...

Re: parking infront of crosswalk/walkway, no sign
You might want to check your city's bylaws. If there is in fact a bylaw against parking in front of (what do you even call those?), then it's possible that no "no parking" sign is needed - just the existence of that cross-thing is enough. Toronto uses 15 m from the intersection for parking, but many times the green-circle parking signs are put up ...

That would be lane-splitting, which I'm told is illegal in Ontario. I haven't been able to find an HTA section prohibiting it; maybe "fail to drive within marked lane"?

For insurance: D1 100% at fault, even if D1 is cleared of charges.
Or are you saying that D2 should be given a ticket for speeding? Would probably have to be a very squeaky wheel to someone (prosecutor's office?), and 99% chance you will get brushed off as the notes say only 5 km/h over. Even then, it would only marginally help D1's court case. D1 ...
