If you see the officer again, please be sure to commend him on his great police work for sitting at a speed change nailing people for 20 over and writing it up as 5 over.. What a waste of time - for what a few dollars in the local coffers?
I think this serves a dual purpose. Stops this from going to court and the offender gets no points ...

Re: Quick question, is this ok.....
The court will have the original document so no worries there except that, if there were any typo's on the original you won't know about them.
The only thing I can add is that if the crown hands you disclosure right before the trial, accept it but, try for an adjuornment based on "more time to read it......" and make sure the JP notes that this ...

Re: Different speed limits on each direction of the road
You said it before, print off a map and mark the speed signs, try to show the direction of travel associated with the signs as well. There is no reason whatsoever that I can think of that would allow, say east bound traffic to travel faster then west bound traffic<< just an example.

I just was reading the OHTA and found this:

We have covered this before....let me see if i can find the post.... in the meantime, take pictures and explain it to the crown, i believe they will drop to 12 over at the least.

And that is perfectly fine. How many tickets does an officer write in a given day??? And would the officer and the Crown not have the "canned" statementsvpretty much copy and pasted from another trial, school, whatever the case maybe. It is not a stretch to say that traffic tickets should be dealt with quickly and efficently.

From a citizens point of view, Yeah!. 11 months 4 days. <<<<<<<<< It's right there.
From a "I would like to see the justice system stop tripping over it's own feet" POV, Yeah! And by that I mean that traffic tickets are written everyday, deal with them quickly.

I would get a hold of the video, it seems to be the main source of the charge. Review it and go from there. This charge is very serious and you may want to consult with a paralegal............... there is a form at the bottom of the page.

What about accuracy of speed if adequate testing was not performed at distance of over 500m? There seems to be plenty of case law to support that even where the driver was the sole vehicle on the road.
500m is a very long distance.....and it could be problematic. You will need to impress upon the JP that sweep error is possible at this distance ...

Re: No witnesses for FTC trial ?
I think what you are getting at is this charge only at issue when 2 vehicles are "travelling" on a road. Read the section your daughter was charged under, you can find it online. Does the incident sound like one of the descriptors listed? Then try looking for the two references in CANLII. Google it, comes right up.

All good points.
And you're right, HTA128, that the officer's duty (as he considered it) was to bounce me before I tried to run. I don't blame him for that; he couldn't have known what my intentions were. Please refrain from typing in CAPS.
As far as your ticket goes, the charging company will need to prove you were on their property.

Re: Speeding safely, apprehended dangerously!
That bothers me.
If an officer begins pursuit of a speeding vehicle, I would agree that it's appropriate to overtake and force the vehicle to the shoulder IF there's some indication that the driver doesn't intend to stop. My objection in my case is that the officer who pursued me didn't run his siren, so I didn't know he was there--if I had heard ...

The info you have is for slightly older models and it used to be the norm, i.e +/- 1 MPH, or 2 KMH.... There are some models of moving radar that are capable of measuring speed as well as estimating distance to target. These units, due in large part to the calc'ns required offered a error margin of +/- 3.2 KMH, however according to my sources ...

If this happened close to your home I would suggest you select option #3, which is the trial option. After you get your court date you can then request disclosure and or first attendance. In your disclosure request, you can ask for a copy of the officer's notes, which is the bulk of the evidence against you. Review the notes and look for ...

The attitude of the officer has nothing to do with your ticket. You will have to plead it either at Frist Attendance or trial. Either way you should be able to beat it, if it does not get tossed first. Just explain the situation the same as you did here. A written record, your words, wouldn't hurt.
