The onous is on the crown to get the trial scheduled within 11 months of the ticket being issued. There is plenty of case law, here on the site that pertains to this very subject......... how you do this in court is up to you. Remember though, that you are not a lawyer and you don't need all the fancy jargon, just bring a copy of the CANLII ...

Take your own pictures and present them as evidence in court. Make sure you take them, that way you can testify to the validity of them. If you don't see the sign, "no right between Time X and Time Y" then the ticket should get tossed.

After an amount of time, if there is no response from you, the courts "assume" you are abandoning the appeal. If you wish to continue the appeal, then go to the hearing and state why you are. If it's a matter of missing correspondance then this will be srted out. This is one of the "checks" in the system to ensure the courts are not revisiting ...

Sounds like a verbal warning to me.......... Try this, get the light fixed and take a picture with the date on it. If this comes up again, you have proof of the fix.

I'd still fight it based on the fact that it is an unassumed road.
The city bears no responsibility for the road, therefore has no right to enforce their by-laws to it.
They have basically stated that it's not their road........ i'm not sure how this would stand up, it is only my opinion.

you were north of Orangeville on hwy 10. That is not a big distance to time 2 vehicles. Disclosure is definitely needed.

City of Ajax has a 3AM - 6AM no parking on streets rule that doesn't get enforced often. I don't even know why that rule is because snowplow trucks don't even show up till 8AM. If you bring that to court and there is still something missing, IMO you are good for a stay. Something being testing notes or other info you would require to mount a full defense.

I don't know that I can prove the other vehicle was traveling faster, I am hoping to suggest that, and attempt to introduce doubt so that the reading could be attributed to either vehicle. Unless you know of a strategy to prove it?

If the car behind you was moving faster, then you will have to prove it. It is not hard to prove that you can get a radar reading from the second vehicle. As far as radar guns, you'll need the make and model used... you can find details online from there. Go for a second disclosure request, ask for typed/legible notes, if you don't get the details ...

I lean to "no". a road is a road and visibility is usually equal no matter which direction you are going. the built up area covers both directions..... take pictures and prove to the crown that the signage ...
