Re: careless driving charge - need advice

It may be upsetting, but from an impartial perspective, I'd say you really don't have much to worry about. That said, due to the serious nature of the charge, I'd still suggest a paralegal or traffic lawyer - shop around and see who is offers the best service and expertise. If you want, there's a form at the bottom of this page to fill out for a ...

Re: Can the HTA be enforced in a mall parking lot

1) I have some business in some area malls after hours. Once I have pulled into the mall lot on the way to the closest door I rarely stop at stop signs unless there is a car or person nearby. (i do not carelessly speed, i do show caution, just do not fully stop) Can a police officer charge me with an offence under the HTA? Worse case senario If a ...

Notes are a good thing to start with. Write them down now while it is still fresh in your head.....Describe weather, road and traffic conditions. Physical characteristics of the road, dips, bumps, hills..etc..... Go back if you can, it may help.....then wait for disclosure.......that time will depend on where this took place.....

Re: Senior Driver's Conditional Licence?

They're restricting seniors from driving on roads that are statistically the safest in the province??

Statistically senior citizens get into collisions mostly at intersections controlled by traffic lights and signs. Maybe the province should look at mandatory re-testing every few years instead of banning them from the 400 ...

Re: Highway speeding

Hi Reflections,

Just for the record I very much appreciate your opinion and I'm always prepared to learn from it. I was presenting an argument that, given the hundreds of vehicles on a section of highway and further given the argument that the office was multitasking and tracking a vehicle behind him, that a reasonable doubt is introduced.

If ...

If you are talking about multi-lane roads then just follow the painted lines. If the line are solid, you are not allowed to change lanes, if they are dashed then feel free to move about the roadway. :D

Re: Careless for driving 105 in a 100 zone with some snow on hwy

If driving on snow means I'm careless then we had better stop driving in the winter.

My driving instructor, back in the day, told us drive at a pace that you feel comfortable at. This year will be 17 years of driving for me and I've gone through some serious weather, gotta get to hockey right?? :D

This is Ontario and we get snow every year and I ...

I cannot speak for any paralegal, nor do I want to speculate or comment on their actions. That would be inappropriate. If you have concerns with them, the best thing for you to do is talk to them directly. They'd be able to tell you a lot more than any of us would.

I will offer this, though. If your agent (or anyone else, for that matter) cannot ...

Can ANY past case be used as case law

This I do know: Yes. Any decided case is (more or less) case law.

Why the court decides to publish certain cases and not others, I don't know. CanLII seems to have some rather uninteresting cases but some of the really important ones that guided and instructed the Justices in those "uninteresting" ones are ...
