Re: Car Crushing Michael Bryant is in some hot water !

Bryant was a key figure in drafting Bill 203. Very ironic. At this point (as of the time I'm posting), charges are pending against Bryant. So far, these are the details:

- A collision between the Saab that Bryant was driving and the victim occurred on Bloor Street between Church and Yonge
- No indication of what caused the initial collision has ...

Ten years ago...

On September 3, 1999, 87 vehicles crashed on the 401 between Manning Road and Lakeshore 9th Concession Road (now Lakeshore Road 101) in dense fog. Eight people died, dozens more were injured. It was the worst pileup in Canada's history. This is video from the Windsor Star as survivors and emergency workers recount what happened that day:

You can always ask the officer if you can look at the reading, but, as FiReSTaRT indicated, the officer doesn't have to show you anything. Some cops will show you the reading, but that's only happened to me once.

Don't try to beat the train

This is video from an Amtrak passenger train going through a far suburb of Detroit. It was released by the police from Canton Township, Michigan. The railway crossing barriers and lights were working, and the driver of the car entered the oncoming traffic lane to pass a car that had stopped for the lowered safety barrier.

The car's five occupants ...

Re: Plea for lesser charge from Driving While Under Suspension

I'd recommend taking the plea offer of Drive With No Licence. It is the best charge you could plead to in this case, unfortunately. Yeah, it will impact your insurance, but Driving While Suspended has, in the past, caused insurers to cancel coverage, more than double premiums or resulted in the driver having to get risk facility insurance.

Re: Failing to Yield to traffic on a through Highway

This is a weird ticket. As racer says, file a disclosure request. This should give you the officer's notes, in case he saw something that you didn't. From there, you can work on a defence. Keep us posted. If it happened exactly as you described, and everyone was stopped and there was a gap for you to safely move in to, I don't see why you got ...

Re: 40 over in a 40km/h zone

Problem with "pleading guilty with an explanation" is that you're still pleading guilty to 40 over. The JP has the option to lower the fine but the big hit is going to be your insurance.

David Chatten gave you a good reply here so no point in repeating it. Fight the ticket. It's the only way to (possibly) mitigate the impact on your insurance ...

The NCC Traffic and Properties Act is "sort of" a set of bylaws for NCC property. Municipalities (Ottawa, Toronto, etc) also have bylaws that work with the Highway Traffic Act, such as Ottawa having municipal by-law infractions for "disobey official sign," etc. NCC has the same ...

To get a 100% accurate reading - more or less. You're referring to "cosine error." The problem is, cosine error actually does you a favour. The radar device sends out a signal from its antenna. When it hits an object, it is sent back to the ...

Your insurance will not go up, because this type of offence does not go on your driver record and they don't have access to information on these types of "photographed" charges (photo radar, red light camera). You are being charged as the vehicle owner.

Mmm... Tim Horton's...

The problem is that the cyclist community keeps whining that bicycles should be treated like cars in terms of lane discipline, but they don't mind running red lights and going in the wrong direction in one-way streets.

And riding on narrow sidewalks at 40 km/h, then they get livid at the pedestrians for not "getting out ...

Re: Is it worth contacting ticket officer?

Put together some notes on the situation. I'd be interested to know just how far away the officer took the speed reading and what type of device was used - you can find this out through a disclosure request. It's possible that she got the two cars confused, particularly since the one guy passed you. Depending on whether she was using radar or lidar ...

Re: Unethical Speeding Ticket

The ticket will go on your driving record, but you won't get demerit points. The insurance company cares about the record, not the points - as FiReSTaRT indicated. One ticket for 15 over with a clean record otherwise probably won't result in an increase, depending on your provider.

If you decide to fight the ticket, make a disclosure request ...

I think the JP probably thought "oh well he's not disputing it, so I will convict" and didn't bother to examine the ticket to see if it was "correct and regular on its face." JPs are political appointees and they've never been to law school. Some are knowledgeable and do a good job, others seem like they just want to rubber-stamp every charge that ...

Re: left turn, disobey sign. need help for Friday court!!!

Maybe try: City of Toronto by-law 32-92 section 39 (1): "Disobey official sign." (I think that's the section.) Anyone else know for sure?

I think the Prosecutor is playing games, or is just not understanding. Instead of filing an 11B application (unreasonable delay) file a motion for a stay based on improper disclosure. The by-law does not need to ...

Re: left turn, disobey sign. need help for Friday court!!!

Couple of points. R. v. Myers backs up the bilingual defence. Bilingual defence is not solely based on the R. v. Myers case. The issue is that, as ticketcombat explains, section 195 (1) of the Highway Traffic Act says that any municipal by-law that contradicts the HTA is deemed repealed. Then, the FLSA says Toronto is a designated bilingual area ...

The R. v. Myers case was appealed by the City of Toronto. During the appeal, the defendant pled guilty! (HUH?) So the actual ruling was not overturned; the defendant, Jennifer Myers, just threw in the towel on the day of trial. Go figure. So no, it was not overturned, she just caved in before the trial. The initial ruling is still available ...

Unnecessary noise, maybe, but careless driving?! Well... you should be able to beat this one. Revving the engine at a standstill (or at a snail's pace) might be considered obnoxious but it's not careless driving. I guess the best way to start off is to make a disclosure request and get the officer's notes on the incident. From there, you can start ...

We're lucky no changes were made to the Criminal Code.

Actually, there were changes made to the Criminal Code by the Conservative gov't in 2006. They specifically created:
- Dangerous Driving (Street Racing), section 249.4
- Causing bodily harm by criminal negligence (Street Racing), section 249.3
- Causing death by criminal negligence (Street ...

To plead to a by-law infraction, show up early on Friday and seek out the Prosecutor. Tell them that you want to avoid a lengthy, unnecessary trial, because you want to save the court and the Prosecutor a lot of time, and you'd like to discuss what options are available. (Bring a big stack of paperwork with you just for show.) Tell them that you ...

To get disclosure, you have to fax, mail (use registered mail or a courier!) or drop off your request to the courthouse. The address is on the ticket that you were given. A clerk will take the information and it will take about 6 weeks (or so) for it to come back to you. More information can be found here:

The weather conditions, if they obscured the sign itself, can save you. Did the officer actually note the condition of the sign at the time? If there were a few little snowflakes on it, that's not enough. If it was completely covered in snow and unreadable, that's a valid defence. Keep the condition of your windshield out of your defence, because ...

That makes it a bit difficult. Maybe show up early and see if the Crown is willing to offer you a plea-bargain to a municipal by-law infraction. I think that's your best option at this point. You could try to argue that you made two separate and distinct movements - first the lane change, then the turn. That's the only defence I can see if it goes ...
