that case is the defendants not responding and the duty of the Justice to quash the certificate

but someone who appears, and raises the issue of an incorrect fine-the JP then has the power to Amend the ticket as that case deals with defendants whom didnt respond to the charge --or by not appearing.

'Day'-A 24 hour period at the specified time by the carrier
requirements-there are several maximum driving and minimum off duty time allowed for the day

'Shift'- the work shift starts at the end of 8 consecutive hours of duty and concludes at the beggining of the next 8 consecutive hours off duty

heres the scenario.
Hwy Bear: you pull me over on the suspicion of having a radar detector. before you pull me over i stuff it in my pocket

you walk up and want to search my vehicle.
technically, you cant search me unless you arrest me.
so now we go to court and my defense is---prove that the signal wasnt wasnt bouncing around the upper ...

Off-topic, but while Marquisse is gone, shh! - aren't there workplace safety rules against truckers clearing their trailer tops of ice? It's above the height limit where you need to be tied off, and there is no place to tie off to. At least that's what I've heard.

You will have better luck going after your insurance company to cover it under DCPD, especially since you have the plate number and a police report. Quote them everything you can find on commercial (or even non-commercial) vehicles needing to secure their load while on a highway. I am not happy. I spoke with the logistic's manager and basically, he said he wasn't about to set a precedent and pay for my windshield repair and that is what insurance is for. I told him my deductible wouldn't cover it and he said that there was no load on the truck, therefore what I said happened, basically, didn't. Then I got angry.

Would this Province be better off running its own driver exam offices as opposed to having Serco DES ( a UK private company)?

when the Government of Ontario sold off its driver exam centres things went downhill.

Last week they caught some selling fraudulent drivers licences in false names.

not that this hasnt or couldnt happen with the Ministry ...

I paid what the Notice of Conviction said and went to old city hall to file my appeal. my court date is on Dec 15/09.

I cant figure why teres three totally different fine amounts-

the total payable on the original certificate
a different one on the Notice of Conviction
and the computer says a totallly different figure fom the two above at the ...

I head down to 137 Edward St this morning to pay my ticket.
the amount on the court clerks screen is different from whats on the ticket(as we know its incorrect in the first place)
and its a different amount than whats on the Notice of Conviction.

I find it a risky approach. The prosecutor could have easily tricked you. He might have said that he would withdraw the charge and in front of JP he would have amended the ticket and forced you to go to trial.

I think the prosecutor was honest by telling you that he is not withdrawing your charge and he may have underestimated your research.

Went to Old City Hall today for my 32km over speeding ticket on the DVP.

As discussed in my thread, the Officer made a mistake on the fine amount-$120/ $150 with the victim surcharge.(suposed to be $232)

Anyhow, I arrived at court a half hour early to speak to the prosecutor.

He gets a Speeding ticket for 30 over on Taunton Road. plus he received a fail to change adress on his ownership within thirty days..

He shows me the Ticket. The first thing I notice is The Licence number is written in Correctly, EXCEPT---

So I can jump in a plane and fly it around because I have not signed anything to do with a pilot's licence and thus am not bound by any aviation laws?

I can go enter restricted airspace and refuse to be shot down because I do not consent to their laws. We'll see how that goes.

I saw a posting by a Trucker who wanted to know if a specific violation of the Highway Traffic Act.

On the Offence Notice, theres a specific area for an Officer (Poice,MTO etc)
to fill in theCVOR #

Most cops dont bother filling this in as it is not required. (sometimes they dont to be nice so it wont show on your CVOR) Some MTO enfocement ...
