It will be viewed with suspicion. Of course if you're driving a s***-box, the cops probably won't be looking into it too closely. However, you should fix it up as well as you can.

Passing on the right is illegal in Germany because hogging the left lane is both illegal and immoral over there. Drivers are taught proper lane discipline in Europe. Over here, hogging the left lane may be illegal, but it's not considered immoral and it's definitely not being enforced.

Why would you waste your time in court by pleading to a lesser charge? Even if it's a 3 demerit offence, the ticket amount is relatively low and as far as your insurance company is concerned, it's still a "conviction". Chances are that they won't raise your rates for the first conviction, but if you get another one over the next 3 years, they'll ...

It's possible, but not highly likely. There are plenty of people who still do 50+ over the limit, so they don't really need to manufacture charges. With that being said, out of about 10 hta offences that I've been charged with over the years, one was a complete fabrication by the constable.
