Some police services like to give you a Careless (major ticket) ticket under these circumstances, to force you into taking a Following too Closely (minor ticket) plea. For that, you have to show up in court, to the tune of some nice overtime pay in comfortable conditions for the constable.

The problem is that the cyclist community keeps whining that bicycles should be treated like cars in terms of lane discipline, but they don't mind running red lights and going in the wrong direction in one-way streets. The problem is that too many cyclists expect to be treated as cars by other participants in traffic and as a cross b/w pedestrians and superbeings (immune to the law) by the police. I make sure I honk at every cyclist running a red/going in the opposite direction of a 1-way street.

I've seen a lot worse.. Flashing lights from 4 cruisers blocking the road and 1 ambulance.. People still tried to get through. At least the a-holes got nailed with tickets :twisted:

That is grounds for 11b and you also have grounds for appeal of conviction (actually 2, if your 11b motion gets denied and the coaching). I am not sure how that would pan out in practice. However, those witnesses could just decide not to show up next time around in the interest of saving themselves from another 2 hours of misery :twisted:

The cruiser is at a police impound lot, so you can bet your sweet behind that the constable will not pay a red cent for impound. The constable will do a week of training or administrative duties and not really be affected. Chances are the union will pay for legal representation unless the witnesses for the prosecution are called off for duty ...

If the JP denies your request, you have solid grounds for appeal. The JP should grant your request, but you never know. It's a purely political position. A retiring JP could recommend his favorite member of Tim Hortons counter staff and chances are that she would get the job. The training that they receive is laughable.

Speeding is absolute liability. You did it, you're guilty, no matter what the circumstances are (even though there are some defenses that you can pull if the amount is really low (like 1-3km/h) or if there was a real necessity (medical emergency). With that being said, you can always book the court date and explore any errors with the Crown's case.

Your best bet is to request a trial date and disclosure. You should know what he's planning to claim in court. Also you need contact information for other witnesses to see if they'll back you up in court.

Lol thanks. Good to be back.. Been busy. Once I got married alive and survived the working honeymoon, I got back to Canada. Been passing my time developing services for the family biz and riding the bike. Even did a track day south of the border. Finally got a bit of free time 8)

From what I heard quite a few states have reciprocity agreements with Ontario. The question is whether they report the offences. I've heard mixed reports, especially about NY.

The way I see it is that you are charged based on the circumstances on the offense date. On one occasion, I got nailed for speeding in an area where they (are you sitting down?) raised :shock: the speed limit b/w the offense date and the trial date so I looked into it 8)

In Winnipeg I'd be more concerned about getting shanked by a dealer/beggar/pimp than by getting run over by a soccer mom. Depends on the city.

We usually just give it but that's because it's dangerous to try to re-form a group once there are a couple of cars splitting it. It's not like we have cell phones to coordinate things. Your best bet is to go through the process and see what technicalities are out there. That could include 11b, lack of disclosure, the cop not showing up etc etc etc. Check out the Ticket Combat site as it has a great primer.

Yeah.. Only one official complaint... The civil disobedience campaign was a sign of approval :roll: On a good note, the citizens of Halton region can sleep easier these days. I've always said that marked cruisers do a heck of a lot more to improve highway safety than ninja tactics.
