Re: When officers break the law...

In over a decade I maybe have had OT on my days off for POA court a handful of times. Those times would be when I have switched to another platoon. All other court is when I'm working. It is being fiscally responsible and I will show up. Further, my days off are my days off, I want to be at home, at the rink, at the gym etc...
By the way, Bear ...

Re: When officers break the law...

.... start by looking in the mirror and don't break the law (guess what, no revenue/tax grab to gov't)
....., if you so choose to break a law, accept responsibility and own up to your error and move on.

If everybody started obeying the laws as they are and there was a low rate of non-compliance, then the laws would get changed to make more ...

Re: Left on red?

Thanks for the update RI.
b81: Just wanted to give you an all-encompassing warning as you'd be surprised at how many people who get ticketed say "but I've seen a police cruiser do it."
RI already mentioned that it's Section 144 of the Highway Traffic Act.

Re: When officers break the law...

If my daughter was killed by a guy doing 160 in an 80 zone and he got off on 11b, I'd obviously be pissed, but a part of my ire would go toward the province and possibly the municipality for bad prioritizing.
The bulk of traffic stops and tickets come from nailing generally safe drivers for minor transgressions under safe conditions. Penalties for ...

Re: When officers break the law...

By the way, I really hope you are more of an aberration than a typical constable considering your lack of respect for the proper legal process. While our Charter is largely useless as long as NWC's invoked, it should still give us some guarantees regarding fair treatment by law enforcement officers and the courts. Those guarantees were created to ...

Re: When officers break the law...

I do agree with your main point that police officers are humans, humans make mistakes and in a perfect world, some leeway should be involved.
I think many people think all cops get away with just about anything because some services are more lenient than others (like the case of a constable who was involved in a wrongful death and then decided to ...

Re: Left on red?

I've seen a Peel Police car go down an unlit street, at night, without the headlights on. Just because you see a police car do something, doesn't mean you won't get ticketed for following suit. As far as I know turning left on red, even under those circumstances would be illegal, but I could be wrong in this one.

Re: How to Drive Like a Moron

I'm sorry but I don't see the necessity of this post for an Ontario forum. I feel that both our training and application of practical skills have made Ontario drivers master all of the outlined skills. Therefore, this should be posted on forums relevant to other Provinces/Territories/States so they can become more compliant with our clearly ...

Riding season starting, watch out for people on 2 wheels!!!

Every spring, as soon as people get out on two wheels, the roads turn into a bit of a slaughterhouse. Riders are still rusty and car drivers aren't used to seeing people on bicycles or motorcycles on the roads. Here are a few tips to make the roads safer:
1) Always perform both mirror and blind spot checks before turning, changing lanes or opening ...

Re: Ticketed for right turn at yellow light [resolved]

One more note: While it's not strictly required, once you appear in front of the JP, it would be a good idea to have course syllabuses and exam schedule printouts to show the JP something on paper that other commitments will make it very difficult for you to prepare your defense. It will save you some unnecessary grilling by the JP. The JP might ...

Re: Ticketed for right turn at yellow light [resolved]

If I were you, I'd go tomorrow. Usually you need to go at least 2 weeks before the trial date even though it's beneficial to do it a bit sooner. I've done it once strategically and made sure I did it about 3 weeks before the original trial date.

Re: Is the registered owner on the hook for impound?

Will do. On a good note, the insurance adjuster is up-to-date on the whole issue and if the cops who dropped by a few weeks ago decide to call back, they'll have a full update.
So far, I've just heard a bunch of horror stories from people left on the hook for towing/impound and/or 407 fees.
The neighbor promised to contact his buyer, have the ...

Re: Is the registered owner on the hook for impound?

The additional issue is that the interaction with the police involved proving that the registered owner was out of town when the incident happened and while the make of the relative's current vehicle was mentioned, I'm not sure if it made it into the notes. The only person who received a fully detailed account of the circumstances was the victim's ...

Is the registered owner on the hook for impound?

A relative got into a sticky situation.. A bit over a year ago, the relative told a neighbor that he could take a non-running vehicle as compensation for some fencing work that he did. The relative signed the back of the ownership, but did not prepare a bill of sale (since the car was a "gift") and neglected to take off the plates.
Fast forward to ...

Re: when fighting a ticket, can they do this...?

Request trial, when you receive your trial notice, request disclosure. If the trial is more than a year from the offense date, you stand a good chance of getting off on 11b. If you don't receive the disclosure, at worst you get your case adjourned (thus boosting your chances of 11b) and at best you get it dismissed. If the cop doesn't show up, you ...

Re: Would this be legal?...

Pennies and spark plugs are old rider tricks (even though they're not really used these days).. Pennies will bounce over the hood and create lots of small dents.. A spark plug will in 95% of the cases render a windshield irreparable.

Actually, if you show up in court, everything was ok with the disclosure and the cop shows up, you can plead guilty and probably get a reduced fine, for not wasting any more of court's time 8)

Re: Driving while under suspension

I really think it applies in your case:
This is the defence of due diligence and it is one of the most potent weapons in your arsenal.

To argue due diligence, you must show that you took all reasonable care to avoid committing the offence.

Your friend was operating the vehicle. The operator of the vehicle had a condition which made him a hazard ...

Re: Driving while under suspension

They're not particularly bad, but it's a crapshoot. If you present a good due diligence defense, you should be home free as long as you come across a reasonable JP. I've mostly had experiences with good ones, but it's a purely political appointment with minimal training. One JP (I'm pretty sure it was in Sudbury) was retiring, so his secretary got ...

FF3 works fine on Intrepid 32 Alpha-4. So it looks like the issue probably stems from wrapper usage on a 32bit pluin. On a good note, the FF issues on 64bit Ubuntu forced me into giving Opera another shot 8)

This might be treated as strict liability, so as long as you can establish that any reasonable person would have done what you were doing, you should be able to get off (as long as you score a JP who understands the concept). Read into ticketcombat.com as it's a great resource to help you learn about the process.

Re: when fighting a ticket, can they do this...?

Regardless, the ticket will be considered a "minor conviction." Some companies do let one slide. Some claim to let one slide but they eliminate your "conviction-free discount." Some immediately raise your rate. Last time I paid a ticket (without the intention to appeal) was when I got a 5 over ticket, while I still had a 10 over ticket. My rates ...
