Unmarked vs. Marked cruisers

When ever I've been in court, the officer clearly states that he was patrolling in uniform and in a plainly marked cruiser.

I've never been charged by an un-marked cruiser and always assumed they must be marked to do traffic detail. I now know that NOT to be the case.

So why do we have marked cruisers at all??

Do you really think the oncoming vehicle (the officer) was able to get the speed of the passed vehicle AND the passing vehicle throughout the entirety of this scenario... with moving radar?? Sure it's possible, but unlikely. I'd love to put this cop on the stand:

ME: Officer, prior to me overtaking the vehicle, what was it's precise speed?

Hmm. Dunno. That's the section I worked with on MY stop sign ticket a few years ago. May be obsolete now.

If the pass cannot be made in safety, you should slow down and go back behind the other car.

That's a knee-slapper! LMAO (wipes tear from eye). Yep, your gonna make a perfect cop ;)

As absolutely ridiculous as it may sound, Squishy is right. There is no allowance for passing. Personally, I would take a speeding ticket and pass in safety ANY DAY ...

No. I'd bet large that if the stop sign had run across the road, it would have been seen and stopped for, just as a child would have.

Be sure to read the pertinent section of the HTA and see if it helps your case:
136. (1) Every driver or street car operator approaching a stop sign at an intersection,
(a) shall stop his or her vehicle or street ...

The cop wrote two tickets because he knows the Crown will likely offer to drop one for a guilty plea on the other.

The ownership one would likely be dropped if she were to show the Crown that the original IS signed. But if it were me, I'd try to negotiate a guilty plea on the ownership and have the stop sign dropped.

Someone should call her ...

The thought of sending in a certified statement is excellent.

There is a section in the Provincial Offences Act that appears to facilitate this type of trial in "prescribed parts of Ontario". The intention seems good, until you find out that there are NO "prescribed parts of Ontario" that allow it, LOL.

Tried it once with a co-worker. Shot down ...

I used to just grab a paddle and go. Now I have a complete boat-kit (safety stuff) on board. Not sure how I ever managed without it ;)

Now if I ever get my 6-pack taken away (and fined), I QUIT! I'll just take up TV as my weekend hobby, LOL.
