Briefly -- I was at an intersection where I had a stop sign (I was stopped) and the road I was turning onto had the right of way. It was very busy, and I waited for an opening to make a left turn. The speed limit here is 60km but most people are doing at least 70km. I watched for a safe opening and began my turn. Suddenly a car was to my left and about to hit me. The driver swerved to the right to avoid a collision, but did end up hitting my driver's side rear door. My car was sent backward to the shoulder, and the other vehicle drove onto the grass and stopped. There were some witnesses to the accident, but aside from them asking if I was okay, I did not speak with them to see what they saw. All occupants were taken to the hospital, and as far as I am aware, we were all released. While at the hospital two officers arrived to give me a ticket of "Turn - Not in safety" for $110.00. I have had my license for over 30 years. I do not even have a parking ticket on my record. I understand that under most circumstances the person making the left turn is at fault for accidents. I feel I did my due diligence and waited for a safe opening. Perhaps I misjudged how fast the traffic was going. Is it worth fighting this ticket? My concern is the insurance premium increase and having a conviction on my clean record. If I fight the ticket, will the other party be called to testify? I've never been in this situation before.

Regardless of who is at fault, you can still ask for a trial and state your case. Maybe the other driver was exceeding the speed limit and the sightlines may have been low. If it takes too long to have your case heard, it could be dismissed on those grounds. It would not appear as a conviction on your driver's licence until the trial came to a conclusion which could take well over a year. Many insurance companies will not penalize you for the first accident.
