Hello, this is my first post on this board... my 17yr old son was stopped this week and charged with driving with invalid/stolen plates (they were given to him by a friend as he had no money to get his own) and driving with no insurance (yikes). I have to say he does not live with me else i would have taken his keys by force if necessary just to keep him and his car off the road. Now my question. He was told by the police that his mother and I will have to appear in court with him, as parents can they hold us responsible for his actions even though he is 17 going on 18 in June? Driving with no insurance is a minimum 5k fine from what i understand. Not sure about the other charge. Thanks,

You have no liability under the highway traffic act for any of his actions, nor the consequences of his actions (i.e. the fines). There are several charges of allowing something to happen, under the highway traffic act (like allowing a person to drive without insurance, allowing a person to drive without a licence, etc), but if you are not charged with those offences, you have no obligation to appear in court.

Sounds weird that the police would've asked you to appear. Was the vehicle registered to your son or was it registered to someone else?

You said he was driving with stolen plates. Was he actually charged criminally for theft and/or possession of stolen property? Or just driving with Plates Not Authorized under the HTA? If he was charged criminally, the police are required to notify you of the Criminal Charge as he's a minor (under 18). If it's just HTA charges, then as long as someone is 16 or older there is no requirement. That being said, it's not uncommon for police to still notify parents of traffic charges, especially when they're driving mom & dads vehicle.

It was his car registered under his name. The plates were given to him by one of his friends who took them from his Dad's garage. Plates were returned to the owner by the police. The charge for my son was driving with plates not authorized for that vehicle on top of a couple of others.

Based on what you told me, you have, as Simon Borys says, no liability or responsibility. They cannot fine you. There is the highly remote possibility that you might get a Justice of the Peace who is poorly trained and thinks he can, but that would be tossed on appeal. If you're concerned about it, you could seek out a paralegal and get a consultation about the situation. (Most offer free consultations.) Chances are, though, they'll tell you the same thing that we did.

Just wondering, will he be losing his license due to these charges? Also, his car is still in the impound yard. Any ideas how much HE will have to pay to get it out? Great forum btw. Tons of information on here.

He could see his licence suspended, but it's unlikely on a first offence. Plates not authorized carries a fine of between $100 to $1,000. It's also possible (but very unlikley) for a jail sentence of up to 30 days, and a licence/permit suspension for up to 6 months. No insurance carries a frightening fine of $5,000 to $25,000 on a first offence. If you get caught a second time your licence can be suspended for a year along with a $10,000 to $50,000 fine. If your son shows up to Court, is respectful, and has a relatively good record, he'll likely get the minimum fine for each offence and nothing else. The problem will be paying off the fines. If he fails to pay, his licence WILL be suspended. Usually the Courts can work out some type of payment plan to make regular installments while you pay everything off. As for towing/impound fees, there's no set rate. Each police service will contract out local towing companies. Police usually get a good rate, but you're tow would still probably be $50+ and another $10+ per day in storage fees. It adds up fast.

Impound fees are big business for tow companies. No idea how much he'll have to pay. Chances are, with the fines he's facing, he'll have to forfeit the vehicle.

Since you were all so kind to provide your opinions I thought I'd post an update... He had his court appearance and got off really lucky considering. He ended up with a fine of $2500 for the no insurance, for the plates not authorized charge he was given a suspended sentence and he has to pay the expired sticker fine. He's also getting a deal from the impound yard. $400 which is a steal considering his car has been there since beginning of February. Sure hope he's learned a lesson. Now he needs to find a job so he can start paying the fines.

Thanks for the update, it's nice to see what actually comes of certain charges. Seems like a relatively fair deal for your son. It's certainly an expensive lesson, but a manageable one that he hopefully learns and moves on from.

Well.... Guess who's son is an IDIOT and obviously didn't learn a thing from his first encounter with the OPP. His second run in happened this week. Charges exactly the same as the first time (No insurance, plates not registered to the vehicle, invalid sticker) plus one additional charge which I haven't found out about. Car is gone to impound again as well. He's on his own this time around and I doubt the courts will be a leniant as they were the first time. Arghhhhh..... teenagers!

Wow that was like 15 days after the court date? I feel bad for you since it seems like you dont want anything thing to do with your son and he gets into these situations, but I'm also glad your son got caught before he could do some real damage like get into an accident not at fault, or at fault. If he ran over someone, and they are injured for life he would get sued for 100k+ and he would have no life anymore. How did he buy the car anyways?

How do you figure I don't want anythinig to do with my son? I cherish my, albeit strained, relationship. By saying he's on his own is far from not wanting anything to do with him. I was simply stating that I took a day off work to make sure he made it to his first court appearance and even sweet-talked the crown prosecutor a little. This time he can do it himself because he obviously did not learn a lesson. I too am glad he was caught. As you stated having him involved in an accident or worse, hitting a pedestrian or cyclist he would be finished. He bought the car in November(ish) with money he got from a part time job. He can kiss that one good-bye cause I ain't forking out a dime to help him get it from impound!

I would guess that, unless the Prosecutor and/or the officer really goofs it up, it will be very, very, very costly. Very.

Well, not as costly as I had expected for a second offense. $3000 plus court costs. His other charges were on the sheet the prosecutor was looking at because he asked my son if he had started to pay off the previous fines.

I have 2 teenagers and I am interested how the second set of charges went. My daughter (the oldest) took our car TWICE (she was 16) without our permission and drove around with a bunch friends. She DIDN'T HAVE A LICENSE.... I consider myself lucky she didn't hurt herself or anyone else. I warned her the last time, if it happens again, I would call the police myself and report the car stolen. It hasn't happened since. Keep us informed please... and know you're not alone. Teenagers !

So a quick rundown... First offence: Driving without incurance - $2500 Driving with plates not registered to the vehicle - Suspended Driving with an invalid sticker - $100 Court Costs - +/- $1000 Sub-total - $3600 Second Offence: Driving without incurance - $3000 Driving with plates not registered to the vehicle - $100 Driving with an invalid sticker - $100 Court costs - +/- $1000 Sub-total +/- $4200 Grand Total - +/- $7800 That's a rough start for a teenager who decided to move out of the house at 17 and just started working... Oh and he didn't pay the "Invalid sticker" fine in time so license is now suspended (and he hopes to one day get insured).

Well the next "drive without insurance," which hopefully won't happen, will probably go into the $10 000+ category. Is his car still impounded?

I have a problem and not sure what the hell to do about it. Few days ago I was stopped on a street going westbound against blinding afternoon sun following the flow of traffic. I drive a taxi for living in Toronto and have ACZ driver's license. I have a perfect record both for professional as well regular demerit points. I haven't been pulled over as a matter of fact in some 15 years for…
I have recently gone to court for a speeding ticket issued by an OPP officer. As it stood, the officer forgot to sign the ticket. So at my trial, before I made a plea, I pointed this out to the justice of the peace and asked that the ticket be quashed. I was asked to produce my copy of the ticket, which I gave and the JOP then agreed with me and dismissed the case. Before he did so, the…
I got pulled over (along with about 10 other cars) for going through a road closed sign. I had just pulled out of a parking lot pretty much right beside the road closed sign, and with about 4 cars behind me there wasn't much I could do but go through, so I think I have a good chance of fighting it. However, on my ticket under the Signature of issuing Provincial Offences Officer, it's left…
So here's my situation, any advice would be appreciated.
On June 26, 2013 I received a ticket for 25 over in a 60 zone
In early October I received my notice of trial (Feb 25, 2014)
In early January I sent in my request for disclosure
In late January I received a letter to pick up my disclosure, however when I picked up my disclosure it wasn't typed (I had requested it to be) and I needed…
Is there a legal requirement to report an accident to the insurer?
Scenario
- 2 vehicle accident
- each vehicle has less than $1000 damage
- each vehicle has damage roughly equal to insurance deductible
- a police Accident Report was completed
In this scenario the drivers decided to repair their own damages. But are they legally bound to report the accident and damages to the insurer? ...and out of…
I will be representing my wife at her speeding trial next week. Mostly everything is pretty much run of the mill but since she wasn't speeding we will be having her take the stand. Since this opens up the opportunity for the prosecutor to cross examine, I am just wondering if anyone here knows what kind of questions we should expect from the prosecutor in order to best prepare.
i got pulled over by a cop this morning in my kids's school zone for failure to stop at a stop sign. i am thinking of fighting this ticket, but i noticed that on the ticket itself it only says "disobey stop sign - fail to stop" and there is no mention of the demerit points. a co-worker mentioned to me that a ticket should state how many demerit points i am being docked. i know the Highway Traffic…
Alright, so this happened back awhile ago on June and I haven't appeared in Court. However, I would like some inputs and advice before I get into this battle.
Back in June I got a Speeding Ticket claiming I was going 100km/h on Blackcreek going south towards Lawrence. The Speed Limit there is 70km/h.
At this point of time, it was roughly traffic hour around 4-5PM. Coming off of the Highway, and…
Ive already done searches, read the act as best i can but still haven't read a complete answer. Where in the HTA does it state that the front license plate must be attached to the front bumper? I have it on the passenger sun visor (if ppl remember the old temp permits that taped to the pass side of windshield) i figured that this spot would be the same. However now they have got rid of…
My son was returning from school and was just entering the driveway when another vehicle hit the rear end. Police writes a ticket "fail to yield from private drive" 139(i). He is going to fight this ticket and made an application for disclosure. The trial is next week and he still hasn't received the disclosure.
He checked with the court last month and they said that they will call when disclosure…
i was travelling on the 401 (posted speed 100km/h) in the far left lane, when i caught up to a vehicle going ~110km/h. I patiently waited for the vehicle to move over a lane, but they did not. The vehicle behind me moved to the center lane to pass, but because he was a safe distance behind me, i moved into the middle lane ahead of him to pass the slower moving car. When I accelerated, i…
So I was returning from my honeymoon in Montreal, and was cruising down the 401 just inside the Ontario/Quebec border. I was passing one of the Onroute stations and saw an OPP cruiser. I checked my speed and I was doing 120. A few kilometers up the road the cruiser pulled me over and told me I was clocked doing 132 by the aircraft. I was a little surprised to see the ticket was for the full…
I made a right turn during prohibited hours (7am-6pm) in Toronto. I was ticketed by a COP who was specially watching for that trap.
After I've received the ticket HTA144(9), I discovered one of the seven digits of my license plate was incorrectly written on my ticket. I was thinking about to make a First Attendance at the court office to see the prosecutor for a reduced charge...any advice or…
Have been busy and haven't had much time to follow up on this...
Went to court having not received disclosure (and was not organized enough to apply for a stay), so the trial was adjourned. They photocopied the officer's ticket and notes and provided a log sheet from the plane. I've sent another request for the rest of the disclosure items.
So here's my question -- can an officer amend the ticket…
I am not sure if my case is really a case of " mis-use parking permit" and need some advises on whether i should fight the ticket. Here is what happened:
During the labor day long weekend, I took my parents to diner at a local shopping mall. (my father's hip was broken in 2016 and he's been on wheelchair since, the permit is in his name and I been using the permit to help him for doctor's…
I have a court date coming up where I need to subpoena one of the officers that was present when I got my ticket. The issuing officer didn't include the fact that the second one was present at the time in his report (disclosure) but did give me the second officers name and badge number after the judge told him to do it.
What I'm looking for help with is the process of me getting to…
I got pulled over on a 4 lane section fo Highway 7... Thank god I didn't get a stay at home ticket as well or my car impounded.
Officer clocked me at 156 km/h he decided not to impound my car and give me a 149 km/h since it was my first offence and he said I was polite and respectful. I would give this officer a 5/5 review if I could, very polite and respectful.
Long story short, I was driving from Toronto to Ottawa and around Napanee with my friend in two separated cars, the officer was parked on uturn. He followed us turn his light on and got between us and pulled us over, he told me that i was running at 152 km/h without showing me his LISAR. they suspended my and my friends license and impounded the two cars for 7 days. This was a Friday in January…
I'm unsure on what to do here. I was under the impression that I could request a stay on the day of trial because disclosure was not given to me in an adequate time. I requested disclosure 2x by fax, 5 months ago.
I read on ticketcombat that I had to file a motion 15 days prior to the trial to request a stay of proceedings.
Does anyone else get blinded by fog lights on rural roads? I don't seem to have a problem with them on lighted streets, but the badly aimed fog lights or ones with a poor cutoff really get to me when driving the Escort. I just came back from a 20-minute drive, and every single pickup truck had fog lights on, and forced me to focus on the bottom right of the road. My windshield is clean and…
