Re: misspelled offence for failing to stop at a stop sign

I can only speak for Toronto but if someone shows up and wants to save points the Prosecutors will usually offer Improper Stop Sec 144(5)(a) or Fail to Proceed as Directed Sec 144(12). But only if the person is willing to accept responsibility right away without argument. This will knock the points off on conviction.

Re: Prosecution provides disclosure right away on the spot?

Here in Toronto it isn't overly new. The Part 1's were changed to include a carbon copy of the notes which are submitted with the ticket and both are turned into a PDF that the Prosecutors have access to. Also starting on November 5th digital tickets started where the ticket is printed off a printer in the car and the evidence is typed directly ...

All trailers capable of hauling cargo needs a plate. You can haul a piece of equipment such as a generator or tar pot for asphalt repairs and they will not require plates.

Re: Reduced ticket from 46 km/h over

Also if you go to trial be prepared to fight the full 106 in a 60. You already got the break at the side of the road. Don't know how the Prosecutors are in Guelph but here in Toronto you would be given a chance to plead guilty to the 29 over as is before the trial when you arrive because that's what the 106 would have been reduced to by them if ...

Re: MTO officer did not file the ticket in court after 7 day

The officer actually has 6 months to lay the charge if they decide to go by way of a part 3, and in some cases up to 3 years depending on the charge. Also since your part 1 offence notice wasn't filed in time the officer, at his discretion can still relay the charge within the statute of limitations on the charge. Although it will really depend on ...

Were you charged with Operating a Motor Vehicle Without Insurance? If you handed the insurance card over and it was accepted then this will be on the report. If there wasn't anything to peek the Officers interest then they would likely not have checked. I have only once investigated a collision where an insurance company contacted me to advise that ...

Good luck with your case,

I see you have done a lot of research for your case, not a lot of people do that. Just remember though that the officer does this for a living and when you go to trial that it is an all or nothing proposition. You could probably take a deal at 0 points with the speed you were going.

The practice of testing the device is ...

Re: statute of limitations unpaid speeding ticket

There is no statute of limitations, if you are suspended for an unpaid fine the suspension is indefinite. To get your licence back you are still going to have to pay the outstanding fine and also the licence reinstatement fee. As for graduated licencing you will have to do that because you have let your licence lapse for so long. You are most ...

Today I learned that wearing seatbelts are mandatory for passengers in the backseat

LOL, I'm confused as to why you wouldn't wear a seatbelt in the back seat even if it wasn't mandatory??? Is it safer in the back than it is in the front some way? That just makes absolutely no sense to me at all. All I can see is that you now become dangerous to ...

You may be leasing the vehicle, but you aren't leasing your plates. So yes you will need to sign it. The plates are yours and should have your name on the plate portion of the permit, and the leasing company's name on the vehicle portion.

Re: Driving 183 on the 401

Just wondering how trucks make you nervous but going 183 km/h didn't and seemed like the reasonable alternative. Trucks in Ontario are limited to 105 km/h, the flow of traffic (right or wrong) is generally 115-120 km/h. A speed that IMHO would not likely get you pulled over and would easily allow you to pass a truck. You say you were passing and ...

Pay the ticket and count your lucky stars that you weren't stopped by a more diligent officer. Re: Jurisdiction and Court Location change

Your offence occurred in Toronto, and your trial is happening in Toronto, so your trial is happening in a court in the jurisdiction of the offence. If the officer is from any of the following divisions in Toronto your courthouse IS 1530 Markham Rd.; 32, 33, 41, 42, 43, 53, 54, PDS, and ETF. There might be one more but I think that covers it. And regarding getting your neighbours name, I think it would be a bad idea.... confronting them (retaliation on them) is just going to get you in more trouble than its worth. And even if someone did call, the officer is still going to chalk your tires because then he doesn't need a witness for the trial, he can be the only witness required.

The ticket itself will be quashed during the filing process because it will be seem to be beyond the required 7 days for the officer to file based solely on the offence date. This however does not mean you are free and clear. The officer has 6 months to realize his/her error and reserve you. As for what you do for a company that fires you, that is ...

The Notice of Intention to Appear will have your request for the interpreter and the language reqursted signed by you. That will be in court on your trial date showing you requested an interpreter. Not sure where your ticket is filed but if it is in Toronto and the interpreter isn't in court you have a good chance to have the ticket thrown out.

There is nothing that requires a police officer to put his car where you can see it, if there was they might as well just tell the officer that he must leave his emergency light on too while he is working. One thing people need to understand is it may be called a speed trap, that doesn't mean it is.... You had fair warning of the speed, there are ...

They will only be relying on a 3 year driving record, not back to the beginning of your record, unless you have criminal driving convictions related to driving, they will show up on the driving abstract presented at sentencing.
