Re: Explanation of "I intend to challenge" phrase plea

Just be careful. Remember your insurance company is looking at the number of convictions you have. They will probably let the first one slide, but now you don't have any elbow room next time.

Always choose option 3, even if you're not going to fight the ticket. It gives you a little more bargaining power with the prosecutor.

A solid disclosure ...

Re: Disabey Sign - Act 182(2)

Fight the ticket. You DON"T want the points!

If you were in the GTA, the bilingual defence applies. That could get you out of the ticket. See my site, Step 5 on how to use it.

Otherwise, follow Bookm's advice. It's always solid.

Re: Cruise control and speeding?

Did the officer come from behind or did you drive toward him him and he pulled you over? Was it day or night?

First step, request disclosure.

Re: Obey Sign 182(2) Ticket

tamilrmx, you did not state what the sign says. Was it a bus lane during designated hours? I haven't been there in a while but I believe those signs are not valid, they have to be bilingual (info about this is on my site).

I suggest you
request a trial,
request disclosure,
ask for an early court date

They must provide a copy of the by-law to ...

Re: Trial Location

You have to mail in your trial request. The trial will be in the cop's jurisdiction, not your home city. Justice and convenience are not roommates.

Re: Trial Location

Yes and no. If you don't live in the jurisdiction you were ticketed in, then the back of your ticket should have a mail-in option. Otherwise, you can go to any Provincial Offences Office in the province to request a trial.

Re: So we all get tickets someday...

The 72 hour notice is not a requirement, just a very nice officer.

It's almost impossible to fight a ticket in Guelph. Forget "I hope the cop doesn't show up," the entire detachment will be there!

And the published rulings out of Guelph range from medieval to bizarre.

I call Guelph an appeal town. If you want to win, you have to do it on appeal ...

Re: speeding ticket

Edge, I'm in the process of updating the site with more examples of how to fight specific charges. However, to find the disclosure form go to STEP 4 -->disclosure on the right hand side menu (discussion board rules do not allow me to link to my own site).

klayymann, you've left it too late. I suspect you also haven't requested disclosure. If the ...

Re: Error on Ticket and way speed was calculated

You are barking up the wrong tree. The only relevant part of the officer's book (other than your ticket) is the total number of tickets he wrote for the day and then only to try and prove some sort of quota system. It's a long shot.

You should assume the operator is competent and capable of resetting the device. The chances or arguing improper use ...

Re: speeding ticket

Resend the request asking for a typed version. An example request form is on my site under Step 4.

The prosecutor has to provide you with access to evidence that shows the device was working properly and the officer was properly qualified to use it. They may deem the calibration record or training record unnecessary but they have to show some type ...

Re: 2 tickets - worth negotiating?

I think the cop has 7 or ten days to file the ticket. The 72 hours was probably if you saw the cop before he filed the ticket, he could just rip it up. If it's filed, then it's in the hands of the prosecutor.

Re: Do all traffic signs require a by-law?

In my case, the charge was failing to obey a (no u-turn) traffic sign (182.2). That regulation, as far as I can see, makes no mention of requiring a by-law. Should I still propose a Motion of Non-Suit if I don't get a by-law in the disclosure? If there is a sign, then there should be a by-law creating the no u-turn area. The exception is the ...

Re: adjournment, a second time

Go to the courthouse and file a motion to change the court date. The motion should be heard before the actual court date.

You will have to give an adequate reason why the change is necessary. I would suggest something along the lines of attending to a business matter that is imperative to maintaining your employment/income.

Generally the motion ...
