Got the ruling today. The ticket was quashed.

As this was a first level OCJ ruling, it isn't binding so you don't necessarily need the case law to make the same argument. I have to check with the defendant tonight to see if she's OK with me plastering her name all over the internet.

I would exclude "Statements made by defendant", but otherwise looks fine. Paralegals or 'Bear might comment better though.

Was there a OHTA sub noted?

Section 143 and subsection 144 (9) of the Highway Traffic Act and any municipal by-law prohibiting turns, from our Demerit Points Table: http://www.ontariohighwaytrafficact.com ... points.php , does award 2 demerits, even though these are by-law infractions.

Yeah, the fight implies pleading not guilty.
You can beat the ticket on technicality, or a cop no-show. Paying means that you plead guilty. Many a time a ticket has been dismissed or dropped. You can always talk to the prosecutor and see if he wants to offer you a deal that you cannot refuse.

And even if you loose - well, you fought the fight!

Well the wild guess would be that the clerk with a half brain tells that to the prosecutor, who then notifies the cop, and then it's all fair again :lol:

As a possible defence method, get to the courthouse ASAP with the proper permit. Get that out of the way.

Then fight the 144(9) (prohibited turn) separately. You are right, it carries 2 points (the points are awarded, not deducted).

it sounds impossible to beat. i have been reading into the traffic combat website. i intend to use the advise therein. so wow, if someone is not sure that they are suspended and tells the officer this, it actually helps their case? by claiming ignorance?

also, with the courts being so backed up, what are the chances an officer will show up after ...

This ticket was given to my 78yr old disabled Mother(with displayed disability permit) dwntwn Toronto few month ago.. But Horray to her cause would you believe she took a picture of where she was, because she had taken my advice- to Keep a cheap camera in glove compartment or trunk.
She was actually on a small but busy side street and the picture ...

First off, welcome to the forum!
If you got a ticket, then:
1. File it with "Option 3" AND "Officer present" both checked off, read over www.ticketcombat.com
2. Wait for court date
3. File for disclosure
4. Post back here when you receive disclosure, or not receive it after 8 weeks after you filed for it
5. Post here a month before ...
