Re: 30 over i need help he said he hade me on radar he was going

File a "notice of intention to appear" if you have not done so, check the box challenge the police officer's evidence, and also check the box "interpreter required" if English is your second language.

Wait in the mail for your "Notice of trial" then request for disclosure. Disclosure will let you know how the officer recorded your speed, until ...

Re: Failiing to stop for a school bus

My wife got a ticket for failing to stop for a school bus. We're figthing that in the court. We've requested the disclosure package and we're told that they'll call us to pick up the package. We never received a call so far and we have a court date in 3 weeks. What are our options? Under which section/sub-section of the highway act it mentiond ...

Re: proceed contrary to sign at intersection 144(9)...2009

I just got a ticket for a prohibited right turn. Bay St. southbound onto Richmond. Is the bilingual defense still valid?

As an aside I told the officer (and I wasn't lying) that I just saw a fight break out between a guy in a black 2 door Accord and a guy on a bike at Bay and Queen. The guy on the bike beat the hell out the Accord and then the ...

Re: got a ticket too

I got a ticket too and it happens to be invalid (old version)!, Interesting.

In my case was a friend who was driving my car. Is there any chance I can plead guilty (Option 2) and get a lesser fine?.

My record is clean, this is the first ticket I got and now I know the ticket is invalid.

Is it for sure that this kind of ticket is not going to ...

Backroom bribery, i second that.

Cchapman, i got 2 tickets of this type (already posted in the forum) no left turn 7AM-9AM, one against a by-law, one against HTA.

Both charges were voluntarily dropped by the Crown when i showed up in court (Markham & 401) although cops were there on both ocassions.

Re: Disclosure, change court date

...I asked him to mail the disclosure but he refused that. He cannot prseume that I'll lie even if I get it in mail. His demand is unreasonable as I have to take a day off at work to pick up the disclosure. Now, it's plenty of time and the prosecutor can easily mail it. .....

I think the rule says that disclosure is not to be mailed. You must ...

Re: not enough time to request disclosure

You may see other fishes he caught on that day in the same court room, so stay back and watch how the prosecutor deals with other fishes then decide.

I would be worried more about insurance implication, not sure if there is.
Do you know? if not call your insurance anonymously to find out.

This seems not a serious violation compared to stop sign ...

Re: Disclosure, change court date

If the cop shows up, the prosecutor will tell you that he is there if you ask.
If the cop is not there (yet), the prosecutor could say "he won't be here today" or "he may be late" if you ask.

I would check the court docket first, if the cop's ID appears with many drivers names on the docket, i would guess he will show up.

To ID him, you can ask ...

I don't think you need them when you go to your trial. You can retrieve your offense number, officer's ID# from the court docket posted in front of the court room.

Re: Following too closely Police Report AND Ticket are incorrect

It looks like there is witness other than the police officer required to make out the offense. Your disclosure will tell if there actually is. And if so both of them have to be in court for the prosecutor to secure a conviction against your uncle.
There may be a chance that one of them does not show.

Re: failure to obey lane sign - Fine $110

The time frame is within the guide line of "unreasonable delay" for a s11(b).

If you are going for s7 (improper disclosure) for a stay, an additional s11(b) will strengthen the application.

Re: Court proceedings?

If the event happened long ago, many officers don't remember exactly what happened unless there was something unique that jolts their memory. They pretty much count on their notes.

He possibly make an error or he may have differrent interpretation of what's on the note, you may want to post more details, Hiway Bear may be able to help you to ...

Re: Improperly Passing a Streetcar

If it is your 1st ticket, it may not affect your insurance rate, you have the option to take the plea bargain from the prosecutor, no point, less fine.

In any case send out the request for disclosure, then you have a month to research and decide what to do at trial.

If the cop and the TTC driver show up you either take the plea bargain or delay ...

Re: Improperly Passing a Streetcar

I don't like to drive in toronto either, too many cops these days, no more comfortable and enjoyayable driving, i just have to keep my guard up constantly.

Ok so the cop did not see what happened, then he needs the TTC driver on the witness stand. Disclosure it is. Once you get disclosure you will have a clearer picture of how to proceed with the ...
