Cchapman, i got 2 tickets of this type (already posted in the forum) no left turn 7AM-9AM, one against a by-law, one against HTA.
Both charges were voluntarily dropped by the Crown when i showed up in court (Markham & 401) although cops were there on both ocassions.

...I asked him to mail the disclosure but he refused that. He cannot prseume that I'll lie even if I get it in mail. His demand is unreasonable as I have to take a day off at work to pick up the disclosure. Now, it's plenty of time and the prosecutor can easily mail it. .....

I would be worried more about insurance implication, not sure if there is.

If the cop shows up, the prosecutor will tell you that he is there if you ask.
If the cop is not there (yet), the prosecutor could say "he won't be here today" or "he may be late" if you ask.
I would check the court docket first, if the cop's ID appears with many drivers names on the docket, i would guess he will show up.

I don't think you need them when you go to your trial. You can retrieve your offense number, officer's ID# from the court docket posted in front of the court room.

It looks like there is witness other than the police officer required to make out the offense. Your disclosure will tell if there actually is. And if so both of them have to be in court for the prosecutor to secure a conviction against your uncle.

The time frame is within the guide line of "unreasonable delay" for a s11(b).
If you are going for s7 (improper disclosure) for a stay, an additional s11(b) will strengthen the application.

If the event happened long ago, many officers don't remember exactly what happened unless there was something unique that jolts their memory. They pretty much count on their notes.

If it is your 1st ticket, it may not affect your insurance rate, you have the option to take the plea bargain from the prosecutor, no point, less fine.
In any case send out the request for disclosure, then you have a month to research and decide what to do at trial.
