Re: Perturbed

There are so many variables involved in each stop and each officer is different.
Some deciding factors I use are:
- admitting to offence (honesty)
- polite
- music off or low
- all windows down
- interior light on at night
- not an offence that has directly affected me (cutting off my cruiser, fail to move left)
- pull over prior to light ...

Re: Speed traps

I could make a list like that...but how fair is that

Easier to remember ... 129km to 56km on Hwy 401. Slow down.

Average 4 officers per shift. Variety of radar and lidar used. Marked and unmarked units, motorcycle and the aircraft takes a tour here as well. All radar units here are "dual antenna" (front and rear) so that we can monitor ...

Re: Just wondering re - Speeding Ticket Revenue

My area is Provincial Hwy and revenue goes right to the Municipality....and I work for the Province. Municipality runs the courts.

Not sure at year end if any percentage goes back to the Province or not as it was a Provincial Highway where the offence happened. OR if the Municipality just pays the JP's wages and keeps the rest

Re: "It's just a dog, you can get another one"

I have 2 dogs, so I'm the animal lover.

Had similiar situation about 2 weeks ago. I told them to drive the speed limit and I followed them to the animal hospital...to ensure the story was not BS. And then gave the driver a warning for the speed! (my animal heart)

Have also stopped persons rushing to hospital. If practicable I will get them into ...

Racer: Stunt Driving is only 6 demerit points, falls under same section 172 as racing

Maybe a section for "Commercial Motor Vehicles". Usually fines are doubled for any driver of a CMV.

Re: Parking wrong way on road

Can the officer prove YOU were the one that parked there? Did he see you park there?

You wouldn't want to take the stand and lie about who was driving, but there's nothing wrong with ensuring the Crown can prove their case by proving who was driving.

Is this just not a plain ole parking ticket? that does not go on a driver's licence anyway ...

McKenzie...so full of BS. but hey that is what sells the papers.

I don't think anywhere in history is there going to be someone who thinks any stat is truthful. Everyone can twist things to make their own perceptions look better or add in the what ifs until the cows come home.

(ie police weekend stats...well civilian side now blames gas, weather ...

Re: Errors and Omissions

- specifies moderate traffic- it was rush hour.

That is a common misconception I encounter in court all the time. I work the highway and varying times, 24hrs a day. I can tell when traffic is what traffic, light, median, heavy or "oh my god". Some one that travels the road same day, same time always thinks it's "rush hour" as that is when they ...

Re: Parking wrong way on road

If the residential street is small enough, less than 150 metres, the U-turn would be illegal but parking facing the wrong way may not be.
So the u-turn is also a bylaw?
And park parking signs...the city would then have to put signs up facing the wrong way, just in case someone parked the wrong way? Otherwise the next defence would be the sign was ...

Re: Parking wrong way on road

I've seen signs stating you must park facing the same direction of traffic and you should find examples of them to show in court. Your argument: there was no sign, a reasonable person would expect a sign if it was illegal to park that way.

A reasonable person would not drive across the path of oncoming traffic just to park on the opposite side ...
