Re: How long do demerit points stay on your record in ontari

HwyBear, I seem to remember reading a post from you a while back, that indicated demerit points stay on record for 2 yrs from the date of conviction. Which is correct: date of conviction or date of infraction?

Thanks. :-)

Re: Ticket Turn not in safety - Police not at the scene

Is this as simple as having the officer on the stand and asking them what they saw, knowing they did not witness anything?
Or do we need to do more?.
This is the same as every other collision, officer will be able to provide, vehicle/driver information and pedestrian info. The pedestrian who was struck will give the evidence of being struck etc ...

If within 7 days of offence notice, you could go file it with the court

Otherwise, you might want to frame it 8)

gar- Please remove my comments from this post as they are from another un-related post.

How to remove it ? I do not know what to do.
I actually asked this question under a different topic but it turned out to be here.

gar - I moved the above post from the other thread to here as you are to keep your incident isolated to yours only, this ...

HTA infractions are merged into the Criminal Court for the same incident, therefore this thread is being moved into the criminal area, and being locked

There is no such thing as reckless driving in Ontario.
Is this "careless driving" (HTA) or "Dangerous Driving" (criminal code) ???
FYI...This forum does not deal with any criminal incidents

Re: tailgate

The officer did provide me with an incident number. Should I have obtained a copy of my statement or the other drivers statement ?
The incident # is all that would be provided at a scene. If a Traffic Report (collision report) was done at scene, you still would only have the basics (location, driver, vehicle info) and no statements.

Should I go ...

Re: Careless Driving - no light, skidded right turn, no acci

Today, While i was driving along a street which required me to make a right turn (without a street light) I advanced to cut in front of another person to make the right turn because it merges into one lane.

as per you post above = lane cutting

You know of a right turn ahead....why not wait 3-10 seconds and go in behind the person that is ...

send a request to the court where this happened (address will be on back of ticket, where you mail it in). and don't go all nuts on redundant information that you request in the disclosure, be specific to the incident.

Good for you!!
. While I was waiting for my turn, I saw the prosecutor leaf through my package, smile and show it the officer...... In retrospect, I'm thinking the prosecutor was simply asking the officer if he was willing to fight it or not...

It is not up to officers to go to trial or not......most likely showed the package to the officer ...

Or Subaru was in the proper lane, took evasive action to its left as it seen someone cutting out from the right. Then the Subaru got pushed that much further over as it was struck on the side.
