There's no dBA level chart or anything like that when it comes to a charge like this.
An officer will use his own discretion. It's up to him to determine whether your noise is unnecessary and/or a hazard to yourself and others around you.
It's not all about being annoying to neighbors, but hearing horns, warnings, and not being a distraction or ...

Re: Warning for careless, How long on record for?
I would have easily been able to get out of an actual fine since he got the model of my car wrong and was totally BSing me the whole time.
You'd be wrong. There's nothing about a wrong model that would make your case easily winnable. Also, when talking about HTA offenses, careless driving is up there as one of the worst.

If you request a trial, they'll still make you an offer beforehand. You can request disclosure while you wait for your trial. Either that or just request an early resolution meeting. It's up to you.

Re: 57 or 58km/hr in 40 zone & Insurance Card Tickets
the officer was standing about 25m down (i think) from the sign that marks the beginning of the 40km/hr zone from a 50km/hr zone, and was waiving at me before I even reached the sign (I know this because I noticed the sign, and then noticed him waving, so I was still in front of the sign at the time). Does this help in any argument in that he ...

Re: 57 or 58km/hr in 40 zone & Insurance Card Tickets
He mentioned our interaction was being recorded, BUT said he stopped me because he clocked me at 57 km/hr, however the ticket says 58 km/hr.
I'm not sure what the story is here, but with that said, speeding is an absolute liability offense. You were either speeding or you weren't. I don't know if I'd go down the 57km or 58km route. You'd still ...

Re: Failed to Surrender License
Go to a Drivetest Centre and see if they'll print you out another one.
In the meantime, select an early resolution meeting. Don't plead guilty. By the time the meeting comes around, show them your license that was valid at the time and they will probably drop it.

Re: speeding ticket by local cop setting on side walk on hwy
1- is he allowed to do speed trap on hwy 9 ?
Yes. Is there some reason you believe he shouldn't? Maybe i'm missing something.
2- if he is allowed to the speed trap is he allowed to do the speed trap while parking on the side walk ?
Yes.

I believe an officer will usually look up the plates for an owner and address. From there they make a visit and will ask some questions.
Radar Identified is correct. Don't be afraid to report it and let them do the rest.

Thanks for the reply. But just wondering if you or anyone else has answers to my other original questions? Does the prosecution take into account any prior convictions when offering a deal?
Yes and no. It depends what the previous convictions are and what you're being charged with currently. If it's simply a fender bender and there were no ...

Re: Failing to yield from private driveway (collision)
Drivers Handbook is a guideline only. It'll say that in the opening of the book. There are some instances in the book where it'll tell you not to do something (safety and common sense first), but it doesn't mean it's illegal under the HTA.
As you read, remember that this handbook is only a guide...For official descriptions of the laws, look in ...

Re: 105 in 60, officer lost sight
Radar Identified was pretty spot on.
If you want to make this argument, you'll have to have a full blown trial.
That being said, you're making a case out of assumptions. You have no disclosure and you're interpreting what the officer did and did not see. An officer doesn't need a 100% visual of your vehicle at all times anyways.
Also, your story ...

I guess the above doesn't matter though as its not in the officer's notes.
