Re: Summon, driving w/out insurance, first time offense

Your first post talks about a desperate times call for desperate measures type deal where you took your chances driving without insurance in order to get to a job interview. It didn't seem in that post you were under any other impression other than you were not insured. There was no transit so you rolled the dice. It was the only time you had ...

Re: Summon, driving w/out insurance, first time offense

Based on your charges, it sounds like there's a bit more to this story that you've left out.

You temporarily stopped coverage on your vehicle, kept the invalid insurance card, and tried to pass off the invalid card to the officer as if you had insurance?

Re: 106 in an 80 while passing

I missed the part about being an unmarked car. That's my mistake.

Your assumptions however of the officers intentions I feel are a little off base. The officer didn't need bait you into speeding. You're already speeding when you're following him at a pace greater than the speed limit. Had the officer really wanted to pull you over at that moment ...

lol. On a single lane highway, you decided to pass an officer who was already doing 15km over the limit. Did you ever stop to think this might not be a good idea?

Which is a bit hypocritical considering he was trying to impeded the flow of traffic, within the confines of the law.

Not sure I follow. How is the officer, who is on a single lane ...

Re: What do you think about this accident?

I don't know if the answer is so clear cut.

Common sense would dictate both drivers have their own lane and if both followed the rules of turning (keeping to the left most or right most lane depending on turn), then there would be no accident. Obviously, the driver making the right didn't get the memo.

However, the HTA puts so much responsibility ...

This happens from time to time in Ontario.

By that I mean the driver unknowing driving without a valid license, whether by days or even hours.

The provider would deny coverage and the driver has no other choice but to take them to court.

Re: two questions - suspended license and failure to report

Hello, Just signed up for this forum... I have two issues:

In Feb I got pulled over by the RCMP with their video license plate scanner. I was going to my dad's funeral. The police said I was drinking, I said no I wasn't... so they issued me an alcohol test which I passed with flying colors. They then said my license was suspended for an unpaid ...

You're still relatively early in the stages of the charge. I think it's safe to assume no one has yet provided you with disclosure so you're doing a bit of assuming here.

Re: Recommended charge to plea down to?

I've asked for a meeting with the prosecutor. They referred me not to my local POA court (e.g. local to where I live and to where the offense took place), but rather to one 30 kilometers away. Can they do that?

Some municipalities will have what they call satellite buildings. They're locations you can go to when you want to just pay a ticket or ...

Re: Received Notice of Trial - need advice on next step

Your situation is pretty common. Rule of thumb is you want to send in your disclosure request as soon as possible.

Trial dates can be weird like that. You can get one for 5 months or 5 weeks. You can also have your request fulfilled in 2 months or 2 days.

If you don't have disclosure before your court date, they'll likely adjourn the trial to ...

My questions are:1. Does the fact that the cop reduced my speed and fine means that he wasn't sure that I was driving that fast?

No. Reduced charges are quite normal.

2. Can I play MY dash cam in court, and how do I do it?3. In the COP notes, he made a mistake on his location where he was standing, he wrote that he was at an address A 1/2 KM ...

The purpose of the first picture isn't to show you in the intersection.

It's to show you approaching the line while the light was already red.

Im not saying the sign was blocked by traffic, it was blocked by parked cars.

I believe this is what is meant by the following from book 5, page 20 of the Ontario Traffic Manual
"All-way stop controls should not be used under the
following conditions:

Re: Suspension for 6 years, Racing for 3?

If you were suspended as a result of your conviction, it can and will be used against you for the purpose of insurance. I believe the max suspension is up to 2 years for your offense.

If you were suspended roadside, that suspension shouldn't impact your insurance. It's an administrative suspension. At that point in time, you were not convicted of ...

Re: Disobey stop sign, stop signs on both sides of intersect

A stop sign on the left side of the road doesn't cancel out the sign on the right.

A stop sign being placed so it is visible by the driver at 60 metres is to insure it's not placed behind a wall or fixture, not that the on-road traffic may at some point block your view of the sign.

When you get a ticket like that, you, go back to like a beginner driver. So each year, after, will lower your rate (if ticket free).
After 3 years of no tickets/no claims, you could shop around a bit, but most likely your present place will suit best.

However the officer's video is grainy and it has a poor frames per second issue in the dark.
If you look at the other lights in the video, many appear to be blinking and expanding; some appear to be even moving when the officer is turning.
Have you considered the poor quality of footage, with the poor night time ISO, not adequately capable of ...

Re: Unintentionally failed to stop for a school bus

1) School bus drivers are pretty aware of their surroundings. They're not going to expect incoming traffic to immediately halt on the drop of a dime with a flick of the lights. It sounds like the driver was aware and waited for you to clear before throwing the sign out.

2) If you were not pulled over at the scene, the owner of the vehicle would ...

If you need disclosure, ask for it. If you need a fax, email, etc for the prosecution office, you can contact the court house and find out. You can also do it in person. They may have a generic disclosure request form you can fill out also.

I was under the impression this was a major offense.

It most likely wont. Basic disobeying of traffic signs and signals are minor. Special circumstances involving kids, schools, etc will make it a major. Same goes for speeding, passing, etc.

e.g. Not stopping for a stop sign is a minor. Put that stop sign on a school bus and pass improperly and ...
