Regardless of the time issue what can't you read on the notes ? Seems pretty legible to me.

The two activities are completely different. I file my ticket right away and only prepare disclosure if the matter is set for trial. When the driver responds within the 15 days makes no difference and I don't even hear about it.

All I'm telling you is I've never heard of it. The officer would have to have enough evidence to proceed with a charge. The system allows you to challenge that in court. We have many policies and procedures but not for every conceivable action that we might take. That's where common sense comes into play.

Received my court date in the mail yesterday. I am going to request the disclosure this week. Does anyone know if the officers have some sort of "guidelines". "manual" or "rulebook" outlining procedures for setting up road side stop traps? They must have certain procedures that must be followed, such as distance, view of intersection etc.

140(4) reads "No pedestrian or person in a wheelchair shall leave the curb or other place of safety at a pedestrian crossover and walk, run or move the wheelchair into the path of a vehicle or street car that is so close that it is impracticable for the driver of the vehicle or street car to yield the right of way."

The Act doesn't say change lane to the left, it just says change lane 'if it is safe to do so'. It will be up to you to prove why it was unsafe to do so but if there was no other traffic and you are relying on the fact that there were ramps and you didn't see an accident then you're going to have a hard time of it.

You received a huge break - you would have lost your licence and vehicle for a week and your insurance would have likely been close to unsustainable. Personally I'd pay the fine and move on.

What I mean is that you will each have your own trial set and your issue and the other driver's issue should be dealt with completely separately. You may still be able to make a deal on trial day.

You are ALWAYS better off dealing with things, however late. I don't think you can go to jail for this but better to deal with it over time. Communication is always good !
