Sorry but I still say you are mistaken. Even the Crown Prosecutor would have to be in on it.

Officers reduce tickets on a regular basis. I only issued full tickets to someone who talked their way into it. A reduced ticket does not indicate that the officer is unsure of the charge and would not be a 'positive' for a defendant at trial.

Re: class g1 driver unaccompanied by a qualified driver
Your tickets are just three in hundreds that would have been written. There is no way that an officer is going to have a colleague dress up in his uniform and come to court in his place. Why would they both risk $100k per year jobs just to get one over on you. You are mistaken.

Re: First Timer...Please help!
It's only worth fighting it if you think you have a defence - which can include an error by the officer.
Points are administrative and not assigned by the court but by the MTO. Having said that I have heard JPs talk about reducing them although I'm not sure how that happens.

If the two officers were in the same cruiser and both saw the incident then they would only need one of them to testify.

Re: No insurance ticket
You are not going to be able to talk your way out of this. You either did or did not have insurance.
In some jurisdictions it is the person who is insured so if you had insurance on one vehicle you might be insured 3rd party only on another (but generally not one you own). In Ontario you insure the vehicle.

Re: Failing to stop for a school bus / handheld device
If you read this board you will see differing opinions on Early Resolution. I think it's a good idea and that you are likely to get a better deal before the Crown has spent time working on the case and getting it ready for trial, calling witnesses etc. Once trial day arrives he or she is ready for trial so may have less incentive to cut you a break ...

Re: Roadblock question
I would suggest that the road isn't closed in the meaning of the Act. This is a temporary situation hence no signage. It comes under failing to follow directions of a police officer and then the discussion is whether a cruiser with lights on is enough of a direction. personally I always angled my cruiser with the lights on and was out of the car to ...

These are not hard offences to prove assuming it was the police officer that saw you pass the bus. You may want to try to plead to one in exchange for the other being dropped.

We provided our shift schedule and vacation time to the Crown so we were always available. The days of coppers not being there are pretty much gone. Not completely but it isn't like it was in the old days.

1. Remember that you could bring anything to the court and say it was this you were holding. I will be up to the JP to determine which side has more credibility.
2. Absolutely you should have notes with and refer to them.
3. Yes completely. There might be something the officer says in testimony that you want to question in cross examination ...

Remember it's beyond reasonable doubt....not absolute proof. The JPs are not idiots. If you say you've holding a scientific calculator to your head whilst talking to yourself you're not going to get very far.

If it were for a highway traffic matter I can't imagine a JP being at all happy with a copper taking a dash cam. If it were something criminal, dangerous driving causing death for example, then the evidential value would be there to justify doing so.

Actually if you knew anything about me the picture of how you see coppers and how I policed are completely at odds.
The reason I said I suspected was due to some simple elements of statement analysis that I am not going to get into here. I do disagree that you can hit something and not know it unless it was something very soft.
Bottom line is you ...

Here's the first one that pops up:

Except that doesn't say when you do have to identify yourself. Following this will, in some circumstances, get you arrested for failure to identify.
Not very useful.

If you are willing to plead to a lesser offence then why hire a paralegal. They won't get any better deal that you can get yourself and will then congratulate themselves on a 'win'.

Re: Careless Driving - Bad Road Conditions 30+km/hr
If you are willing to settle for a minor traffic conviction then absolutely you can speak to the prosecutor yourself. I would be very surprised if you weren't offered something like Fail to Drive in Marked Lane. I wouldn't worry about the points - they only count if you get a lot of them. The issue with most tickets is the financial aspect firstly ...

Re: Failure to stop by crossing guard?
They would need to identify you as the driver and they could only do that if you admitted it.
I suspect the likely outcomes are (in order of likelihood):
- the guard whistled at you and did nothing more
- the guard reported your plate and you get a letter cautioning you not to do it again
- they launch an investigation into who was driving and ...

Re: Recommended charge to plea down to?
That may be true in many cases but often I have sought a second version to the story which has resulted in no charge being laid. If you say nothing the officer can only rely on the other person's version of events.
On top of that is the tactic I recommend to my friends: be friendly and apologise. Often that will get you a warning. Of course if ...

You got lucky with the officer. Any of the coppers I know would have said bring it on.....we get paid to be in court, I couldn't give a hoot how long you keep me on the stand and the JPs I know would have shut you down pretty quickly.
