1) While radar is tested before and after each stop, laser only requires a test at the start and end of each shift.
2) I know the example you're talking about, but I don't really understand it. When a vehicle isn't travelling directly towards a radar/laser, it does cause what's known as a cosine error, meaning the speed reading isn't as accurate ...

You have to select the trial option for any type of deal, the other two options are simply you pleading guilty to the Justice of the Peace. Don't get too hung up on points, since they have very little impact unless your wife has numerous other convictions.

I have no doubt they'd allow you to plead out to red light fail to stop. In fact, I'm not sure why you wouldn't have been charged with that originally.
The offence carries 3 points and a $260 ($325 total) fine.

That's the normal record of suspension which appears on an abstract. It doesn't get removed even if the charges are stayed.
The suspension record is still just an administrative one (i.e. not the result of a conviction) so therefore should be excluded by your insurance provider.

Re: Fighting the Camera Ticket need some math help
If the photo evidence shows you crossing the stop line on an amber, then you didn't commit the offence, and the charge should be withdrawn. It's only an offence if you enter the intersection on a red, not if it changes to red afterwards.

Re: HTA 144 (18) - Mississauga
If you're certain the light was still green when you crossed the stop line, you didn't commit any offence. The offence of red light fail to stop requires you to cross the stop line AFTER the light has turned red. If you're already in intersection, you're simply expected to proceed through with caution.

Red light camera tickets will not affect your insurance rates because youre charged as the vehicle owner, not the driver. They do not appear on your record, unlike if you were stopped by an actual police officer and charged as the driver.

Re: S. 62 (7) Headlight Modified = yellow DRL?
So what is the officer's allegation? That the bulbs on your vehicle are tinted? If they produce a natural yellow light, then no, they should not be illegal. If the bulbs have a tint or coating that give the yellow colour, then it might be problematic.

Re: Wrong last name on ticket
Unless the officer issues a corrective summons to you and your son, I wouldn't worry about it. Even if a conviction was somehow entered based on the ticket, you could easily have a JP examine it and quash the conviction since charges against minors can't proceed by regular offence notice.

Looking at the intersection on Google Streetview, I'd say the signs are well posted and clearly visible. Unfortunately your wife can't use your poor directions as a defence in Court. I'd suggest speaking with the Crown about the possibility of pleading out to a bylaw offence, which wouldn't appear on your wife's abstract or increase her insurance ...

You'd have to check with your insurance company since each company/policy has different rules. Some overlook your first minor conviction, others may raise your rates a bit (5-15%).

Re: Running red light after already completely stopping
My understanding is that the camera only activates if you cross the stop line above a certain speed (typically 25-30 km/hr). If you crossed from a dead stop, then you should be ok. That being said, I don't think you have a defence in Court if you were caught, especially since the cruiser didn't actually go through the intersection. My suggestion ...

1) Many are retired, some may have quit. I think very few were fired, since something warranting termination from police employment would probably make working in a legal field difficult. It's not a bad career if you already have a pension, good money for even better hours (especially for ex shift workers).

Sometimes they will withdraw the charge, but an incorrect date isn't a fatal error. It can be amended at trial.

Re: Need Advice on Bicycle-Car Collision
The driver of a motor vehicle does have a duty to yield to pedestrians and traffic when leaving the roadway like that, but the fact that you were riding a bicycle on the sidewalk against traffic complicates matters. I've seen a similar case where the driver was charged, but the Courts found him not guilty. The Courts felt the driver still executed ...

I'm wondering if the prosecutor was offering you a plea deal to a different offence. While they can't change the points associated with your charge, they can allow you to plea to a different offence with fewer points and/or a reduced fine. I'd personally pass on the representation if all they feel they can do is obtain a lower fine, since you'd ...

You'll have to select option 3 on your ticket (request for trial) and then inquire at the Courthouse how to book a first attendance meeting. First attendance meetings are basically a brief one on one meeting with the Crown where they try and work out a resolution with you to save the time/expense of a trial. They will typically offer you either a ...

I'm not quite sure why they would use the term "police privilege', when in fact the police have nothing to do with adding or removing anything from a driving abstract. That's all done by the MTO. I'd start with calling them.
I think they may be referring to the fact that such suspensions are added at the request of the police. There are methods ...

Re: Need Advice on Bicycle-Car Collision
I would suggest reporting the matter to the police. By law, any accident with over $1,000 damage MUST be reported and failure to do so can result in a charge.
If you truly were at fault in the accident, then yes, you probably would be responsible for the cost of repairs. However I would never blindly accept one person's claim of expense. I'd want ...

Re: running a red
Did you come to a full and proper stop before turning? The charge of failing to stop for a red light applies to anyone who fails to stop, regardless if you're proceeding straight through or turning. If you never fully stopped, then the charge is correct. If the officer is claiming you're just not allowed to make right turns on the red light, then ...

Re: 11B Victory, How To Remove Record From Drivers Abstract?
The charges of speeding and stunt driving shouldn't appear on your Dad's abstract since he was never convicted. More likely the abstract is showing that your dad was suspended for 7 days when he was originally charged. Abstracts show all suspensions and the reasons behind them. I'm not sure how you'd go about getting the record of the suspension ...

Re: Failure To Provide Insurance Card?
I would still try and ask for a first attendance meeting. Most Crown's in my experience are pretty good at withdrawing charges when there is no prospect of conviction. A lot simpler to have them withdraw the charge if possible then spend all day in Court for a trial.

You could reasonably fight the cell phone ticket since you were off the roadway using it. As for the val tag, see my response in your other post. Really should merge the threads, not sure why you started two posts for the same charge.

Re: Expired Validation Permit...
I suggest selecting option 3 and speaking with the Crown. Some will withdraw the charge if you can show everything is in order. At the very least they will probably offer you a reduced fine in exchange for pleading guilty. The Justice of the Peace can only reduce the fine, not withdraw the charge on a guilty plea.

Speeding tickets can be, and regularly are amended by the Crown at trial back to the full amount. The fact that a ticket has been reduced is rarely marked on it. Sometimes there will be a letter "R" in a box marked code, but its not required. Basically the Crown gets a copy of the officers notes prior to trial and will see the original speed you ...

Looks like it's $282.71, but I'd call them to confirm. As long as the top half has the ticket number they should be able to look it up.
FYI speeding by more then 15 over in Nova Scotia results in a 7 day suspension upon conviction. I'm not sure if that applies to out of Province drivers or not, but you may want to confirm prior to pleading.
