I did find some case law with respect to external testing that does not support this argument.
See R. v. Laarakker 2008
The heart of the issue is the defendant Laarakker did not challenge the officer's assertion that he tested the device in accordance with the manufacturer's instructions. We ARE CHALLENGING that assertion! The officer is not ...

If the officer failed to write down the time of the test after the ticket you are out of there.

Re: self-testing devices
Not bashing anything that was previously written but lidar devices do have a form of "antenna" testing. In order for the unit to properly gauge when the light pulse leaves the gun, a small portion of the beam is redirected into it's "timing" circuit. The radar gun may also do the same thing as a reference to the frequency shift it is looking for ...

Re: self-testing devices
The cosine error comes into play at 10 degrees and up. If you shoot a beam, radar or lidar down the road 400 meters, you'd have to be 35 meters off the road inorder for there to be cosine effect and a lowered reading. If you are an officer sitting in the median taking readings, there is no cosine error. If you read through the users manual for any ...

There is no error in the reading.

With what you just wrote, I wouldn't want to answer the questions........ However, HwyBear has mentioned in the past that there is a fourth test. It is completed in the office by a guy on a computer. This test simulates the emitted radiation, light with LIDAR. However, at no point is the actual intensity of the LIDAR beam tested. As I understand it ...

Re: Lidar - Multiple User Testing
We are talking about the internal test. There is no need for multiple alignment or fixed distance testing. However, if the unit is dropped, bumped or the lens takes some sort of damage, scratches or someone places it facing the sun, then it should have the full gauntlet of testing. And, of course, all the testing shall be in accordance with the ...

Re: Lidar - Multiple User Testing
I think that what Radar Identified was getting at was that if Officer "A" tags a car then Officer "B" tags a car, was there time to run the test(s) in between and does the test by one officer count as the testing by the second officer, i.e. If Officer "A" tests after he stops a car can Officer "B" use that test, in his notes, as his before the stop ...

If you are sure that you were doing 82 and with a heads-up display then it should not be that hard. Fight the ticket and ask for disclosure, see http://www.ticketcombat.com as far as disclosure requests go and make sure you ask to see the user manual for the Lidar gun used. Once you get your info the picture will be come clearer.

In addition what sort of burden do the police have to meet in order to pull somebody over? i.e. can they stop any driver to check for a DL, or is there some minimum standard? What Im expecting is that I was pulled over based on "movements" which the officer attributed to suspicious actions, rather then similar benign actions.

There should be a section listed, it looks like (S.128). However there are specific fines for the amount over the limit. If your measured speed and the zone are not on the ticket you could beat it with some research. If you don't feel comfortable arguing this in court you could also use a paralegal like X-Copper, for example. Usually the ...
