Re: At what age does parental responsibility end

Based on what you told me, you have, as Simon Borys says, no liability or responsibility. They cannot fine you. There is the highly remote possibility that you might get a Justice of the Peace who is poorly trained and thinks he can, but that would be tossed on appeal. If you're concerned about it, you could seek out a paralegal and get a ...

Re: section 136 (1)(a) Disobey Stop sign

We can't help you prepare a "good defence case" until we know what the evidence is against you. You'll have to wait until you get disclosure. When you do get it, then post the information (editing out personal/officer details) on this thread and we can help you. Right now, trying to give you a defence strategy would not be a good idea. There may be ...

Also the officer will not necessarily immediately stop a vehicle. They need to find a place where it is safe to do so. For example, if it is an expressway and the shoulders are six inches wide, but they widen out to a full car width about a half-kilometre away, any cop who's got any semblance of intelligence will wait until the shoulders widen out ...

Oncoming traffic would be affected. The oncoming drivers may not see/recognize that there is a designated left turn lane there, particularly at night.

Re: Transcibed officer electronic notes

I guess they've had a number of issues with people being unable to read officers' notes - hence the transcribed version. That way it nullifies the argument "I can't read the notes, therefore I didn't receive disclosure." As for accuracy, in court you could ask the officer if these are, indeed, a true and accurate representation of his notes. (He'll ...

Hwy 401 - 171 km/h in a 100 zone

Copied over from another subject.

Hi man,

I have an exact case like yours, i was charged in Ajax, Ontario for 171km/h, my car was impounded for a week, my driver license suspended for a week, and i am sent to court for two charges, stunting and speeding.

Please i would like to know what was the outcome of your case, as you attended the court ...

Will FULL DISCLOSURE not include information on where the officer was parked, and what his line of visible sight is. Also, all his notes that he was taking on what he witnessed

Officer's notes probably won't be that precise. He might've written down his approximate location, etc. However, his notes do not have to be extensive. In this instance ...

I also use Ashtonbee to bypass Eglinton, although the craters, cracks, etc., are ridiculous. I think my car will need some suspension work if they don't re-pave that road soon. But, it's worth it instead of dealing with Eglinton along the Golden Mile.

I must say, I always do a double take when I see a Crown Vic, just to make sure.

Insurance companies are prohibited from "permanently" retaining your information and using it to determine your rates.

Generally, your first minor conviction will have little or no impact on your rates. But if you have had a second minor conviction in the last three years , it will most likely affect your premium. If you have had accidents where ...

Correct - if it is New York or Michigan. However, they're the only two US states to have signed full reciprocity with Ontario. Every Canadian province and territory also has full reciprocity. The 40-odd other states signed an agreement with Ontario similar to the American Non-Resident Violators Compact, which only kicks into effect if the fine is ...

If your licence is suspended you cannot drive anywhere. You are disqualified from driving. Should you get pulled over in the United States, the police will check your licence validity, and yes, they do have access to this information. When they see it is suspended, you will be charged. In many states, this results in you being arrested immediately ...

Agree with Stanton.

You are not charged with "Drive with no licence." You are charged with failing to surrender your licence, which, by your own admission, is exactly what you did. You could try to get a lower fine by speaking to the Justice of the Peace at trial, however it won't necessarily be successful.

Re: Concerning Stunt Driving - driver from US

The reciprocity with 40+ states is for non-paid tickets. So if the ticket is not paid, then Ontario will report it. As for getting his physical licence back, I'm not sure what the OPP does for out-of-province motorists who get caught stunt driving. Generally they're few and far between. I'd imagine it would be mailed to the person's home address ...

Impaired drivers they'll go after. If it's just a matter of someone speeding, going through a red light, rolling a stop, turning/changing lanes without signalling etc., in the GTA the police are not likely to respond. It's different in other parts of the province, though.

I've only called in collisions, impaired motorists, and one road-raging ...

They don't. Usually they will post one of those big circular "NEW" signs that warn drivers of a change. As for ticketing, police can use any law that is in effect, no matter how early it is. For example, the first motorist caught under the stunt driving law was pulled over just 1 minute ...

Whether the officer was actually present or not does not matter. The JP was going to adjourn if the trial option was pursued, so they would have received an adjournment regardless. It's still a delay that keeps the "11B clock" ticking. Even if the officer was not there, they still could have requested an adjournment due to the officer not being ...

The worst part of the construction was that they were changing which lanes were closed every other day. And then for a few days there they had only one traffic light for NB Vic Park @ Lawrence, and the wind (or somebody) blew it off to the side, so you couldn't even see what color the lights were (or if the advance green was up). Well that's a major mistake by the officer. It does not "invalidate it" immediately, but delivering the ticket to the wrong defendant should be sufficient to get the charge quashed. Probably the other guy has "your" ticket as well. They have up to 6 months to withdraw the original charge and issue a new one against you, but chances are they won't ...

If you had valid out-of-province insurance, you had valid insurance. Check with ICBC to see if your policy is/was valid, then see if they can send you a letter indicating that you did, in fact, have valid insurance on the date of offence. Present that to the Prosecutor and they should drop the charge. Otherwise, if they don't, ask them to cite a ...
