Re: Internet has it's Dis-Advantages

I disagree.

Speed governors do not make drivers pay attention. They do not make drivers stop for traffic signals, pedestrians, stop signs, etc. They do not force drivers to wait in their lane until it is safe to pass, instead of pulling out with a truck barrelling at them. They do not make people slow down in slippery conditions. They don't make ...

Re: Failure to Stop - Amber

I doubt if it would go double. The total payable for running a red light is $325, so you might be looking at something in the $200 to $250 range if you lose. But, your insurance will probably go up unless you either win, or plea-bargain it down to something less than Disobey Amber Light, so that's something to consider.

Therefore, I like to think ...

Any reputable, licensed paralegal is a better option than going in there with none. Not much else I can tell you right now, since you've done the right thing by seeking legal representation.

Re: Failure to Stop - Amber

The fine might be worse, but the demerit points and conviction record will not be any worse.

Red light cameras are set to photograph drivers who go through the red only. They are triggered by sensor plates embedded in the road - so when the light is red and you go through, it snaps a photo of your vehicle entering on red, and then in the ...

Re: advice requested on a fail to stop 216(1) charge

Just out of curiosity... your relative was in the curb lane... was the officer in the median when he came out? Or was he at the side of the road?

Usually the best thing to do is stop and see if the officer waves you on, but based on the fact that the other driver stopped, the officer wasn't gesturing, etc., there's a possibility he may be able to ...

Re: Driving Under Suspension On motorized mountain bike

The 3-year suspension is an administrative action by MTO. Your first Impaired Driving conviction will net an automatic 1 year licence suspension; the second one is 3 years. The 1 year prohibition for 253(b) is actually a bit different, in that instead of being an HTA "suspension," it actually DISQUALIFIES you from driving. If you Drive Disqualified ...

Bring a letter from your insurance company stating that you had valid insurance at the time of the infraction. That should do it.

The guy who cut you off sounds like a total nut-job.

Lucky you were able to avoid the crash, and he was also lucky that it was you, and not someone who was equally crazy as he is, or possibly armed. Sooner or later, if he insists upon continuing that sort of behaviour, he will run into someone who is.

Re: Parking Tickets & Licence Suspension

In theory it could lead to a licence suspension... in a LONG, roundabout way.

If you don't pay the parking tickets, as OPS Copper says, they won't renew your plates (eventually). That said, the municipalities have been rather inept at notifying MTO of unpaid tickets. If you then get caught driving with invalid plates, that could eventually lead ...

Careless Driving is very steep for the collision you described. You should be able to get it plea-bargained down to Follow Too Closely or Fail to Turn to Avoid Collision... both of which are substantially less onerous (as manwithaplan says).

Re: Are cops encouraged to park on private property ?

Police may use private property if conducting traffic surveillance, but the property owner does have the right to ask them to leave.

In some cases, people may avoid the business. In other cases, the business and/or residents have asked police to set up there because they have complained about people driving too fast, etc.

The fact that you were unfamiliar with the area won't hurt you in court. Unfortunately, it won't help much, either. HOWEVER, things that could help you are what the one paralegal mentioned:

As the others have said, no new regulations came into effect in Ontario. It's probably one of those internet rumours... the first clue was that "it applied to all traffic enforcement, not just localized." You can get the latest version of the Ontario Highway Traffic Act here:

Well if the officer says words to the effect of "I put 156 because of radar tolerance," a good paralegal or traffic lawyer would demolish him during cross-examination. For a serious charge like stunt driving, I'd recommend getting professional help.

No fine at all?!

I'd say you probably could get out of it, although the procedure may be a bit complex... Put the paperwork together (file the ticket, choose option 3 for a trial, etc). Basically it is a "default and appeal" process that's recognized by the courts in Ontario. What will happen is that you will get a trial date. If there's no fine ...

Actually the law got tougher in August 2010... not much help there.

You can't get this "removed" from your record, but for this offence after three years (I think) it drops off your driver abstract. (Could be wrong though, might be a longer period.) Demerit points stay for two years, and almost all HTA convictions for three years. You can try ...

Respectfully, your parents are not choosing a wise course of action.

Since you said you've never had anything to do with the police before... you'd obviously have a clean driving record.

You've got the First Attendance meeting, so there are several options here. When you go to the First Attendance, they'll probably offer you a lower speed. In your case, I'd say it would either be 29 km/h over (which is 3 demerit ...

What you'll need to do is go to the courthouse to re-open the case. You'll need to explain why you did not appear. Then, when you get a new trial date, you should do what Stanton says and that should take care of the "drive without insurance" part of it.

Your husband should probably take some notes about what he recalls, including the conditions, the speed, his experience in driving the fuel truck, his noting the amber light, etc. There are also some good cases that you can read up on that may apply to your situation, such as the R. v. Sandhu case. In Sandhu, the defendant was charged with running ...
