Re: Clarification re: s.199 Failing to Report

I'm usually not a betting man, but I'd bet good money that your co-worker will have his charges dropped or will win at trial. I would advise against a plea-bargain, particularly since he has documentation, signed by the victim no less, that she was NOT injured. He stopped, he checked on her, he did his due diligence - just like Stanton said. I ...

Re: Driving in South Africa

Pretty much, although they will flag down drivers and check their licence status periodically. Oh that's another thing - South Africa is chock-full of unlicenced drivers.

That said, in all fairness to the South African Police Service and the other police agencies across the country, they've got higher priorities to tackle with limited resources.

Driving in South Africa

In late January/early February I was in South Africa. Incredible place, lots to do... you can even go dive with Great White Sharks or, for an even more thrilling and scary experience, drive on their roads. Cape Town was pretty civilized but the rest of the country...

Re: Police Cruiser driving backwards

The insurance adjuster will get all of the relevant information. I wouldn't worry too much about the officer's failure to hand it over. They'll track down the York Regional Police's underwriters and deal with them.

Re: Failure to slow for an emergency vehicle

Its not a BS charge as there has been many officers that have lost their lives as a result of this.

Usually when people state that the "failure to slow down or move over" is a BS charge, or a "cash grab," I use this analogy:

Police/firefighters/EMS etc are working on the highway, so they are "at work." Would you like someone driving 80 km/h (or ...

Re: Careless

Did you get summoned to court or is it a Provincial Offences Notice (part I)? The total payable should be $490, set fine of $400. If he wrote a set fine of $265 with a total payable of $325, you have a fatal error on your ticket, my friend... but only if it is a Part I notice and not a Summons.

Re: Turning Left at an intersection

(A) Even if I have the red light, and the oncoming traffic (from either side) has the green?

Correct. Lengthy explanation to follow:

My driving instructor if I correctly remembered told me that blocking the intersection while under a green, going in one way-direction was not permitted. (I guess not then. . .)

You cannot drive straight ...

Well that's odd... I'd say that the stay should've been granted right then and there... but I agree with iFly55.

Re: police officer gave me a ticket under section 144.18

1) Officer wrote my last against the space for "first name" and my first name below it. And its not separated by any comma
2) He misspelled my first name and did some overwriting to make it up.

Those two issues are not fatal errors. The name does not need to be separated by a comma. Some overwriting isn't a fatal error either, at least in this ...

Re: Careless

So insurance says because of the incident report we are 100 percent at fault, if we can prove that we were pushed will that change in the eyes of the insurance company?

Yes. It's a completely different scenario according to the Fault Determination Rules, which the insurance companies use to determine who is "at fault."

Wouldn't the fact that ...

If the officer did not file the ticket within the required time, you are home free.

Re: Careless

Well that explains the careless driving charge...

It does make a difference. If you got hit first and got slammed into the vehicle in front of you, that's a completely different situation for insurance purposes. You could dispute it, but it will take some time. The question is, how did they figure that you were the first one to cause an impact?

Re: Two tickets, same time - how many convictions?

1. You will get two convictions on your record.

2. Yes to both questions.

3. Fail to stop for amber... it depends on how well you can testify in court, how well you prepare your defence, etc. Usually if a person gets up and makes a convincing case that they were unable to safely stop their vehicle, took their foot off the gas, checked all ways ...
